Judge John Blawie said that the statements made by Fotis were NOT under any of the exceptions listed by the gag order. Issued a warning to the defendant and said the gag order is “binding” until any other court, I.e. Supreme Court, rules otherwise

    Blawie says since Supreme Court is going to hear arguments on whether gag order stays in effect he won’t take action today but puts Dulos on warning.

    Blawie is now questioning Kevin Smith as to why Dulos didn’t violate the gag order in answering questions from Greek newspaper. Blawie is now Saying Dulos statement is not an exception.

Blawie is now hearing the issue of dropping charge. On hindering prosecution charges Smith is arguing that there is no predicate felony charge to which Dulos could be charged with hindering.

Michelle Troconis is supposed to go before the judge around 2pm. Her attorney requested today’s hearing. There’s nothing in the public file to explain why, but I’m hearing it has to do with questions about whether to gag order applies to her.

Judge Blawie said the court would take some time to review the arguments. They will revisit the issue at the next court date on Nov. 6.
