As Michelle Troconis’ hearing approaches, CT prosecutors move to close courtroom, seal records

State prosecutors have filed a motion to have the courtroom closed to the public during an upcoming hearing in the case of Michelle Troconis, the ex-girlfriend of Fotis Dulos, and have any records related to the hearing sealed, records show.

I'm surprised Schoenhorn isn't also asking for a closed courtroom.
Here is a snippet of the legal issue which I hope is ok to quote: "The motion, signed by Assistant State’s Attorney Sean P. McGuinness, said the hearing is expected to cover two issues: whether a cover letter written by Troconis’ attorney Jon Schoenhorn to attorney Tara Knight falls under the category of privileged communication and, if it does, whether that privilege should be waived."

If it’s privileged, why did Schoenhorn turn the letter over to the prosecution? That is entirely on him. I think I know why he did it-intentionally engineered this issue.

The state filed the motion with the Superior Court in the Stamford judicial district on Feb. 9, ahead of an impending privilege waiver hearing that is set to take place sometime between March 9 and March 16, prosecutors said in the motion.

In November, Schoenhorn and prosecutors argued over their efforts to disqualify each other from her murder conspiracy case in a dispute over the handling of a contested letter. They appeared before a judge and met privately to argue whether prosecutors improperly — if inadvertently — obtained confidential communication between defense lawyers.

Troconis’ case was scheduled to be tried in 2022 but was sidetracked by an ongoing argument over a box containing a sweatshirt, a screwdriver, a wrench and the contested letter written by Schoenhorn to another defense lawyer.

Schoenhorn has argued that prosecutors should have known they were not entitled to the letter and should be removed as a sanction for its wider distribution. Prosecutors have said the letter isn’t privileged and demanded that Schoenhorn be disqualified from defending Troconis because they intend to call him as a witness at her trial to testify about the box and where he got it.

According to the newly filed motion, Schoenhorn is expected to introduce evidence of his privileged relationship and confidential communications with Knight. Prosecutors said in the motion that protecting attorney-client privilege overrules the right of the public to attend the hearing.

McGuinness said the state filed the motion not to agree or concede that the cover letter is privileged but in an effort to move the case along as quickly as possible.

According to the motion, Troconis agrees that the proceeding should be closed to the public.

Troconis is released on bond as she awaits trial. She faces charges of conspiracy to commit murder, evidence tampering and conspiring to hinder the police investigation by disposing of evidence in the death of Farber-Dulos.

This is all about the box. I think JLS thought he could put this all on the exchange of client files between Attorney Bowman and himself but he was wrong -- Bowman wasn't having it!

Bowman said Troconis did not give him the box, but he could not remember who did, according to the prosecution motion. MOO

I recall reading that JS didn't give the letter to LE. Tara Knight gave them the box but apparently didn't open it before she did to see the letter in there with the "evidence." She didn't tell them who gave the box to her, but LE found JS's letter in there and read it. JS felt they violated atty-client privilege by doing so.

I recall reading in an earlier report that Bowman said he couldn't remember who gave it to him--but that it might have been Norman Pattis.

Thank you for finding this! I am searching everywhere and can't find the listing anymore. I recall sending it to a friend joking about buying the house but when looking through my texts, the listing is now no longer on realter.com. I did find this article though. I think this is why the house wouldn't sell.

I wonder why Schoenhorn gave the box to Tara Knight instead of giving it directly to the prosecutors, then…and if I recall, someone (NP?) had this box, or its contents, for quite a while

Pawel, the employee, told LE he found a red pail in his truck that had a sweatshirt in it and put it in FD's laundry room. So, if it's the same sweatshirt, who, but NP, would have had it after FD's death?

It’s unlikely to have been anyone but NP, who had it. I imagine that the sweatshirt does belong to Pawel, and we know that fD used his truck for sure. He likely knew that PG regularly left the swetshirt in his truck-probably wore it, hoping to get Jennifer’s DNA on it. FD was hairless himself, at that point, since he shaved himself down, so that only PG’s hair might be present. I am more sure than ever that fD meant to “frame” PG for Jennifer’s murder, which infuriates me. FD handed the sweatshirt over to NP, so that he could direct the attention there.

That was some interesting reading. One of the Judges on this list was Judge Donna Heller, who was involved in the Dulos custody issue.

Anyone going to chime in? All of the property, estate proceedings, etc, are irrelevant to where Jennifer is or what happened to her.
I still think she was incinerated. I remember LE saying some of the trash went through the incinerator before they could stop it and search through the rest with the dogs. I hope I'm wrong and I hope she is found.
