Jennifer Dulos case: ‘Lying lover’ Troconis emotional in court

Troconis, 44, was arraigned Wednesday in state Superior Court in Norwalk on a new tampering with evidence charge in the disappearance of Jennifer Dulos. The hearing lasted less than two minutes with her attorney, Andrew Bowman, making no comments during or after the arraignment.

Troconis, who held her head in her hands before the hearing, will next appear Oct. 10 in state Superior Court in Stamford. bbm

Search warrants related to the case will remain sealed until Oct. 16. State’s Attorney Richard Colangelo requested in June that they be sealed for 90 days. The seal would have expired Wednesday, but it has been extended another month.

The detailed arrest warrant for the latest charge offered a new glimpse into Troconis, who has met with investigators several times since she was first arrested in June on the original tampering with evidence and hindering prosecution charges.

According to the new arrest warrant, police interviewed Troconis on June 2 — one day after she and Fotis Dulos were first arrested — and she “provided substantial amount of information which was self-contradictory and did not bear up under the scrutiny of the investigation.”

Jennifer Dulos divorce: Judge tosses psych exam that favored Fotis Dulos

Emergency custody hearings were held at the request of Fotis Dulos before Judge Donna N. Heller on May 10 and May 17. The hearings included testimony from court-appointed psychiatrist Dr. Stephen Herman who met with Fotis Dulos 14 times as part of an evaluation of the Dulos family to help determine suitable custody of the children.

Herman’s conclusions were summarized in a sealed report dated April 24, according to a motion filed by attorney Rich Rochlin, who is representing Fotis Dulos in the divorce.

Heller has ordered Herman’s testimony stricken from the record, ruled the hearings as a mistrial, since they were never completed, and required that his report remained sealed. Heller also noted in the order that anyone who reveals or releases the report could face sanctions or contempt of court.

Rochlin said Fotis Dulos has also met with Dr. Stephen Humphrey, a court-appointed Hartford psychiatrist, 20 times in the last two years.

Humphrey concluded that Fotis Dulos was a “gregarious and confident person” who had no psychopathic tendencies, Rochlin wrote in court documents seeking a mental health evaluation for Jennifer Dulos’ mother, Gloria Farber, who now has temporary custody of the children.

Fotis Dulos, 52, and Michelle Troconis, 44, have each been charged with two counts of tampering with evidence and hindering prosecution in connection with Jennifer Dulos’ disappearance.

Since his June arrest, Fotis Dulos has been banned from contacting his children. Rochlin has since filed several motions requesting his client be granted access to them.

Facing foreclosure, Fotis Dulos takes home off market

Fotis Dulos, 52, had been living in the home with his girlfriend, Michelle Troconis, 44, and her daughter after Jennifer Dulos moved to New Canaan with their five children when she filed for divorce in 2017.

Farber, who is suing Fotis Dulos for $2.5 million in unpaid loans made to his real estate development company, began paying the mortgage when her son-in-law stopped making payments last November.

The Farber family put up $2.3 million in securities and cash as collateral to secure a mortgage from BNY Mellon in 2012, allowing Jennifer and Fotis Dulos to own the 15,000-square-foot home at 4 Jefferson Crossing, Farber’s attorney said last week.

Guiffria was deposed in the lawsuits Sept. 13. Fotis Dulos emailed him this week asking to take the home off the market, Guiffria said. He checked with Farber’s attorney, Richard Weinstein, before removing it, the broker said.

Farber bought the mortgage from BNY Mellon in July after Fotis Dulos and Troconis were charged in the disappearance of her daughter. Jennifer Dulos’ name was taken off the title on Aug. 20 after her mother bought the mortgage.

Jennifer Dulos disappearance: Reservoir searches hit close to home for Fotis Dulos, local parkgoers

Police have been searching the park’s five small reservoirs, 30 miles of paved and gravel roads and acres of unperturbed forests on and off since at least July 3.

Authorities have honed in on two nearby properties connected to Fotis Dulos since his estranged wife vanished on May 24.

About a five-minute drive away is 80 Mountain Spring Road, a property owned by Fotis Dulos’ real estate development company, Fore Group. According to the latest arrest warrants, police said this was Fotis Dulos’ first stop after driving back from New Canaan the day his wife vanished.

The home at 4 Jefferson Crossing, where Fotis and Jennifer Dulos lived with their five children until they separated in June 2017, sits about a half-mile from the park. The area there is densely forested and spotted with steep, rocky slopes ending along one of the park’s most scenic views, MDC No. 3, the second largest of the group of reservoirs.

Along this reservoir runs the park’s red trail, where rarely a minute or two passes without seeing a runner or biker zooming by. At the westernmost edge, two picnic tables are rooted beneath a sprawling oak tree.

Police have not disclosed whether they’ve recovered anything in their sweeps of the parks. In fact, any evidence police may have recovered during their numerous searches of parks, garbage centers, properties connected to Fotis Dulos and other locations throughout the state remains a mystery. Since a gag order was issued in the case, police officials have declined to comment on the investigation. All search warrants related to the case remain sealed until at least Oct. 16.

Fotis Dulos has been ordered to appear Monday in state Superior Court in Stamford for issues with his GPS monitoring device. Fotis Dulos has been accused of not properly charging the batteries at least four times in the past month.

His next pre-trial hearing will be held Oct. 4, while Troconis is next due in court on Oct. 10.

The attorney for Fotis Dulos, in court filings Tuesday, said he is seeking access to the medical records of Dulos’ missing wife and mother of his five children in an effort to determine whether she was undergoing pregnancy testing or suffers from a serious disease, disclosures that could bolster defense attorneys’ “Gone Girl” theory about her disappearance.

This is the second time that Pattis has attempted to access Farber Dulos’ medical records. Pattis has suggested that Farber Dulos may have staged her own disappearance in a plot similar to Gillian Flynn’s 2012 novel “Gone Girl,” in which a wife pretends to vanish to frame her husband for murder.

On Tuesday, Carrie Luft, Farber Dulos’ friend and family spokesperson, said: “This is yet another desperate attempt by the attorney for Mr. Dulos to distract from the charges against his client. Jennifer has always taken excellent care of her health. She has now been missing for more than three months. Her children, family, and friends are grieving her absence. This is one more gratuitous and cruel legal maneuver that harms her children, now and into the future.” bbm

Last month, Superior Court Judge John Blawie denied Pattis’ first motion to get the medical records agreeing with State’s Attorney Richard Colangelo, who called the motion a “fishing expedition.”

“I don’t think, given the state of this record, you’ve sufficiently shown enough of a basis for the court to grant this motion. I think it is speculative at this juncture,” Blawie said.

In denying the motion, Blawie said he would revisit it if Pattis produced more compelling evidence.

As in the first motion, Pattis said that Dulos has in his possession billing records that show $14,000 worth of medical tests, blood work and other diagnostic treatment from February through April of this year.

Attorney for Jennifer Dulos’ mother questions Michelle Troconis for 45 minutes

WEST HARTFORD — In a quest to investigate the finances of Fotis Dulos, his mother-in-law’s attorney questioned Michelle Troconis on Wednesday about what she knows about the Fore Group’s business dealings.

The deposition lasted 45 minutes at attorney Richard Weinstein’s West Hartford office.

Troconis’ attorney Andrew Bowman tried to quash a subpoena to prevent his client from being deposed in the lawsuit on the grounds she could potentially incriminate herself in the criminal charges.

Bowman claimed the subpoena was “an attempt to gain testimony from the deponent Troconis” and Weinstein would “surely seek to turn this discovery over to the state’s attorney who is prosecuting Michelle Troconis.”

A judge ordered Troconis to appear at the deposition after Weinstein filed court papers indicating he would not ask about the criminal case or the disappearance of Jennifer Dulos.

Weinstein contends in court filings that Troconis was listed as an employee of the Fore Group and may have information on the business’ finances.

“The plaintiff (Farber) seeks the deposition of Michelle Troconis not in regard to the allegations set forth in the criminal case against her, or the circumstances surrounding the disappearance and potential harm to Jennifer Farber Dulos, but rather concerning the outstanding claims against the defendants, her role at the Fore Group, her knowledge and involvement in regard to expenses paid for by the Fore Group or reimbursed to the defendant (Fotis) Dulos from the Fore Group, none of which implicate the present criminal charge(s) pending against the deponent,” Weinstein wrote in a motion seeking her deposition.

Farber is also foreclosing on the Farmington home where Troconis and her daughter lived with Fotis Dulos until her June arrest.

Weinstein has said Fotis Dulos has not paid child support since his wife filed for divorce in 2017 and is attempting to hide assets, which eventually would be part of the children’s inheritance from the Farber family.

The attorney for Fotis Dulos asked the state Supreme Court on Wednesday to overturn a Superior Court judge’s “unprecedented gag order” that silences lawyers, police and even potential witnesses in his criminal case, saying it unfairly hamstrings his attempt to defend Dulos against almost daily accusations that he murdered his estranged wife.

Pattis said the gag order, issued on Sept. 12 by Judge John Blawie, bars Dulos from any effort to clear his name or respond to allegations.

“No court in Connecticut has previously entered a gag order of this scope; and no Court has issued a gag order of any sort without an opportunity for a full hearing,” Pattis wrote. “

Pattis is asking the state’s highest court to hold an emergency hearing and overturn the gag order. He recently filed a similar appeal of a judge’s ruling in the Alex Jones/Sandy Hook civil case and was granted a hearing which will take place Thursday.
