Jennifer Dulos disappearance: Michelle Troconis refuses to answer questions in lawsuit

The attorney representing Jennifer Dulos’ mother is asking a judge to compel Michelle Troconis to provide information on Fotis Dulos’ business dealings after she invoked the Fifth Amendment as a response to every question asked during a 45-minute deposition this week.

Troconis’ attorney, Andrew Bowman, fought to quash the subpoena requiring her to be deposed in the lawsuit, which accuses Fotis Dulos of failing to repay the Farber family for loans made to his real estate development company, Fore Group.



A judge previously ruled Troconis must attend a deposition, but said she could invoke the Fifth Amendment to specific questions after Weinstein agreed to not ask about the disappearance of Jennifer Dulos.

“In support of this motion, plaintiff (Farber) asserts that the deponent Ms. Troconis has had a long-standing relationship with the defendants Fotis Dulos and the Fore Group; the plaintiff maintains that there are substantial funds owing to the plaintiff as a result of loans from Hilliard Farber to the Fore Group; that the defendant Dulos in particular has wrongly utilized assets of the corporation for his personal use and not for corporate needs,” Weinstein wrote in a motion filed Thursday, requesting a judge to require Troconis to answer his questions.

Weinstein wants a judge to review his questions and determine which ones Troconis should be required to answer.

“The court would test and determine the appropriate invocation of the constitutional privilege against self-incrimination on a question-by-question basis,” Weinstein said.


He is also seeking to have Wednesday’s deposition sealed so Troconis’ criminal case is not prejudiced by any inference of her fears of self-incrimination.

Farber filed the lawsuits [non-payment $2.5mil loan] against Fotis Dulos and his company in 2018 as her daughter was embroiled in a prolonged divorce.

"Chief Justice Richard Robinson granted attorney Norm Pattis’ application to have the state’s highest court review the gag order put in place on Sept. 12 by Judge John Blawie. Pattis must now file a legal brief by Oct. 9. The state will have until Oct. 28 to respond and the hearing will be scheduled for sometime after Dec. 5.

i hate to see this happen however other courts have imposed gags before trials....NP just thinks he is special. This may prevent problems later on.

The 2 and their lawyers think they are smart as IMO the 2 are communicating. The Judge reviewing the questions asked of MT is a good idea and she should answer the ones approved.

AT some point they will not get their way. I hope the Judge throws FD in jail. That would stop communication that is currently going on. And NP might as well join FD both for violating the gag order.....all IMO

it is a shame that people like FD and NP can make a joke out of our court system....and it’s a shame that the Judges and all feel they have to pussy foot around these characters. The law needs to be tougher. JMOO

will go back to bed now...storms let up a bit.

Earlier today, Fotis Dulos went before a judge with his attorney's associate Kevin Smith representing him.

State's attorney Rich Colangelo spoke at the hearing and brought up Dulos' recent comments to a Greek media outlet about Jennifer Dulos' mental health. Colangelo said it was a clear violation of the gag order in the case.

The judge stated that his comments were in fact a violation of the gag order, but that due to an appeal filed by Fotis Dulos' attorney, Norm Pattis, the judge could not make a ruling or decision in the matter until the Supreme Court modifies or vacates the appeal. bbm

The judge warned Dulos that the gag order is still in effect.

Both sides then moved on to the motion to dismiss, which was the primary reason for today's appearance. Smith argued that Dulos can't be charged with hindering prosecution because that requires some other felony. He said the tampering charge doesn't hold up because there's no evidence to back it up.

The judge didn't rule today and says he will consider the arguments. He says the issue will likely be revisited when Dulos is back in court Nov. 6 bbm

More than half of the 32 ‘Justice for Jennifer’ rocks placed around New Canaan have disappeared, according to a note left at our Elm Street office.

Created in support of Jennifer Dulos, a local mom of five that’s been missing since May 24 and is presumed deceased, the anonymously painted rocks have been placed at public buildings such as Town Hall and the New Canaan Police Department. They are not collectors’ items, the note said. On Sept. 27, which would have been Dulos’s 51st birthday, a statement issued on behalf of her family said, “The heartbreak goes on even as time moves forward.”

Jennifer Dulos case: Pattis files formal gag order appeal with state Supreme Court

Pattis filed a 12-page brief to the Supreme Court, arguing the gag order has left his client defenseless against police leaks and the intense media scrutiny surrounding the disappearance.

Robert Scheinblum, senior assistant state’s attorney, filed a response, supporting an appeal hearing and also contending the Supreme Court should uphold Blawie’s order.

The court granted Pattis' request for an appeal earlier this month.

Pattis will have until Oct. 28 to file his brief seeking to have the gag order overturned.

Scheinblum will have until Nov. 22 to provide a response.

The Hartford Courant also filed a brief in support of Pattis' move to have the gag order overturned, but it was rejected, likely because the state Supreme Court had not yet agreed to hear the appeal.

Blawie intended to limit speech that could affect Fotis Dulos’ ability to have a fair trial. But Pattis is arguing that since it’s Fotis Dulos' Sixth Amendment right to a fair trial, he and his attorney should be allowed to speak.

Fotis Dulos is fielding offers from television shows, Pattis said, and it will be up to his client if he wants to appear.

The judge did not ban all speech in connection with the case, Pattis told Chaz and AJ.

"We cannot talk about the credibility of victims, witnesses or other trial participants," Pattis said.

Michelle Troconis Arreaza has been at the center of the divorce battle between Jennifer Farber Dulos and Fotis Dulos since Jennifer filed for divorce in June 2017. In the divorce documents, Jennifer Dulos referred to Michelle Troconis as Fotis’ “paramour.” She also said that he had been having an affair with her, which led to her filing for the divorce, along with accusations of controlling behavior and emotional abuse.

It is not clear how long Troconis and Fotis Dulos had been dating before the divorce. But it is clear that they remained together in the years after Jennifer left her husband. Troconis and her daughter moved into the multi-million-dollar Jefferson Cross mansion that Fotis Dulos had built and owned with Jennifer using money from her father. Troconis’ involvement in Fotis Dulos’ life and the lives of his children led to disputes throughout the two-year divorce case and child custody battle, court documents show.


Jennifer Dulos said Fotis Dulos threatened to take their children to Argentina, “to be with his paramour,” and hide them at a ski resort owned by the father of Troconis’ daughter. Jennifer Dulos said when she told her husband he was leaving him, “he informed me that our children and I will continue to reside in the marital home every weekend and during the summer, so that we all (his paramour and her daughter included) would be together.”

In later court filings, Jennifer Dulos said that Troconis and her daughter had moved into the Farmington home with Fotis Dulos. Judge Heller wrote in a court order, “In view of the close bond among all five children, the court finds it highly likely that all five of the children have been adversely impacted by the breakdown of their parents’ marriage, the defendant’s relationship with (Troconis) and the pressure that the defendant has placed on them to lie.”

During the child custody battle, Fotis Dulos fought to allow Michelle Troconis to be present when he was with his children. At times during the two-year ordeal, Troconis was not allowed to be around the Dulos children. But a future ruling allowed for her to be a part of their lives.

Fore GroupMichelle Troconis and Fotis Dulos worked together at his home builder company Fore Group.

Michelle Troconis has been working with Fotis Dulos at Fore Group, his luxury custom home building company, which is based at the Farmington home where they live together. It is not clear if Troconis was working for the company before she became romantically involved with Fotis Dulos.
