EW YORK — Media crews and vans were stationed in Pelham Parkway South early Thursday morning awaiting more information on Fotis Dulos’ condition following his apparent suicide attempt this week.

Dulos, who is accused of killing his estranged wife, Jennifer Dulos, remains on life support at Jacobi Medical Center in Bronx, N.Y. Dulos, 52, has been receiving visitors, including relatives from Greece, his attorneys and a woman he considered his “best friend” who helped post his bond and was at his Farmington home Tuesday before and after the apparent suicide attempt.

After two days of frenetic activity at Fotis Dulos’ Farmington home, this morning everything is calm and quiet. The police cars that lined the private road are gone. The mobile crime lab that sat in the home’s driveway is gone.

DULOS UPDATE: We are at Jacobi Medical Center in the Bronx where Fotis Dulos’ attorneys and family members from Greece are visiting him. Dulos remains in critical condition with an outlook described by Attorney Norm Pattis as “dire.”

Lawyers move to appoint receiver for Farmington home as Dulos remains in critical condition in New York
Richard Weinstein, an attorney for Gloria Farber, the mother of Jennifer Farber-Dulos, has filed a motion with Hartford Superior Court asking for an emergency order to appoint a West Hartford real estate agency as receiver to secure the property at Jefferson Crossing in Farmington, due to Fotis Dulos’ medical situation.

Weinstein says the house is currently “unattended” and mentions that the plaintiff has a mortgage on the house of $2.3 million and property taxes due for $21,000.

The attorneys believe is the utilities may be not paid and there is concern over “vandalism, looters and preserving the mechanicals of the home” since Dulos is not currently living in the home and may not be able to return.

The attorneys are asking that Robert M. Giuffria, Jr, of Tea Leaf Realty – the original listing agent, be appointed receiver since he is familiar with the property.

“The first issue is competence,” said Shipman & Goodwin attorney
James Bergenn, a long-time criminal defense attorney, who is not involved in the Dulos case. “Otherwise, you do not have a meaningful Sixth Amendment right.”

White-collar and federal criminal attorney Richard Brown of Hartford’s Brown, Paindiris & Scott agreed.

“The obvious and controlling question is the ability of Dulos to recover from his attempted suicide, and the effect it has on his intellectual capacity to understand what is going on,” Brown said.

Neither Pattis or prosecutor Richard Colangelo Jr. were available for comment at presstime.

Norm Pattis has filed a motion asking the court to continue the criminal case. Here’s some quotes from the 3 page motion.

Mr. Dulos professed his innocence to the grave, and it was his final wish and the wish of his estate that he be speedily tried before a jury of his peers to establish his innocence.

The public at large has convicted Mr. Dulos without due process. Mr. Dulos’ right to confront these charges band to assert his innocence does not die with him. The court should afford his estate an opportunity to clear his name.

Just spoke to two local defense attorneys about this attempt by Norm Pattis to keep this case going even without a defendant. Attorney Lindy Urso told me it's never happened before, and it never will. @News12CT

Attorney Matthew Maddox had this to say: "This is Norm Barnum trying to keep the greatest show on earth going." He too said it's not going to happen and added, "No one can write a clean slate chapter in order to sanitize Mr. Dulos' history for posterity." @News12CT

There is a dearth of authority in Connecticut and elsewhere in the U.S. on the concept of a posthumous or post-mortem criminal trials. There is plenty of authority on the mootness doctrine.
