The decision on a resolution or trial for the contempt charge is still up in the air, but Troconis is due back in court November 13, at which time, attorneys seemed confident a decision could be ready.

MORE TROCONIS: Michelle Troconis' family spoke briefly after the hearing about their continued push to get her conviction overturned. Troconis filed a habeus corpus petition, alleging violations of her consitutional rights during the Jennifer Dulos investigation.

Troconis appeared in Stamford Superior Court today for a hearing in the case regarding motions filed by the defense. One was to subpoena the videographer that recorded the trial, who lives in Massachusetts. To testify for the defense at trial. That was granted.

Of particular note, defense attorney Robert Frost saying, “I’m surprised this is still being pursued.” His belief is this charge all boils down to the videographer shooting something he was told not to, Troconis’ laptop.

Moran disputed that, saying the case isn’t just about that. She pointed out the state was alerted to the report by an audience member in court, not from someone who saw the livestream. It was only when the state investigated that they saw the report on the livestream.

The woman convicted in the disappearance and presumed death of Jennifer Dulos will go on trial again - now for the contempt charge she's facing. Michelle Troconis appeared in Stamford Superior Court Wednesday for a hearing in the contempt case, during which Judge Alex Hernadez set a trial date of March 11. Troconis’ attorney, Robert Frost, told the judge he expects it will be a bench trial, but his client wasn’t waiving her right to a jury trial yet.

In court Wednesday, both sides discussed motions made by the defense, including one for a bill for particulars, requesting specifics on the charges beyond what's in the arrest warrant in order to prepare trial.

“It was not clear to me whether the state was alleging a contempt that was based on mere possession of the sealed custody evaluation report or what seemed to be the thrust of the arrest warrant,” Frost stated, “that Ms. Troconis had put a portion of the report or a page of the report on her laptop in an effort to essentially disseminate it publicly.”

Assistant State's Attorney Elizabeth Moran said the state would be proceeding on both theories—possession of and publicizing the sealed document. A new charging document details that with Troconis now facing two counts of contempt of court.

Frost also requested the court orders that Troconis is accused of violating. Initially, the custody report was sealed in 2019 by Judge Donna Heller, who presided over the Dulos divorce case. But it came up before and during the trial several times with Judge Kevin Randolph reiterating the report would remain sealed despite the defense’s attempts to get it admitted.

Although Michelle Troconis has been convicted and sentenced in the 2019 disappearance and death of Jennifer Dulos, court proceedings will likely continue for years.

Mawhinney has pleaded not guilty to a conspiracy to commit murder charge. He is taking his case to trial, which has yet to be scheduled.
He is accused of trying to provide an alibi for Fotis Dulos the morning of the disappearance.

Troconis is appealing her conviction as she serves her sentence in York Correctional Institution. She also was arrested three times during the case, including on charges that she tampered with evidence and hindered prosecution. A jury convicted her on all counts. State Superior Court Judge Kevin Randolph, who oversaw the trial, dismissed one of the tampering with evidence charges, calling it redundant.

Prosecutors, however, are appealing the dismissal, saying the judge erred when he dropped the charge.

The appeals from both sides remain pending.

She also has a new attorney in that case, who raised concerns about the charge, including about when the document had actually been sealed and that any order about it had not been directed to Troconis.

In July, while in York Correctional Institution, Troconis wrote a letter to NBC Connecticut’s Shannon Miller to address the case.

The four-page letter details in part how Troconis claims Fotis Dulos deceived her and other people who were a part of his ongoing divorce and custody case. It also addresses what’s at the center of the criminal contempt case -- the sealed custody study report involving Fotis and his estranged wife, which investigators said Troconis had illegally displayed on her laptop during her criminal trial.

Darnell Crosland is now representing Troconis in this case.

“Michelle didn’t disseminate it,” Crosland said. “Her attorneys have this report. This report was made clear by the GAL Meehan that it was not to be sealed or to be made private until months later.”

A trial on the matter was originally set for next month, but she now is due back in court on April 18.

Troconis was officially charged with criminal contempt of court after the verdict came down for allegedly displaying a court-sealed custody report pertaining to the Dulos divorce case on her laptop.

The report was part of the ongoing contentious custody battle between Jennifer and Fotis Dulos. It was completed in April 2019, but neither party was allowed to have a copy of it.

The guardian ad litem for the five Dulos children said each parent and their attorney had to come to his office to view the evaluation. The following month a family court judge sealed the report just before Jennifer Dulos vanished.

On May 26, 2021, Judge John Blawie ruled Troconis’ defense counsel could get a copy of the sealed report but with the restriction that it could not be shared. The State’s Attorney’s Office said Troconis was present for that proceeding.

Troconis knowingly violated a court order by “unlawfully possessing the document that she knew was sealed from herself and the public, uploading it to her computer and displaying it in open court in the direct line of sight of media personnel currently live streaming the proceedings,” the warrant stated.

During the trial, News 12 asked attorney Jon Schoenhorn if his client had the report, “to my knowledge she does not have that report. She did not get it from me. Let's put it that way.”

His co-counsel, attorney Audrey Felsen, sat beside Troconis at trial, including when the alleged document was on her screen. But Felsen told the court she didn’t know anything about it.

“I have not reviewed the report in its entirety. I’ve never seen it on a computer. I have reviewed the last four or five pages that I was provided, and they were in paper form. I can say that I have never shared the contents of the report with Ms. Troconis. I don't know in fact whether she was reading from a memo or what it was,” Felsen told the judge.

Jeffrey Kestenband, one of Mawhinney's attorneys, said the murder of Jennifer Dulos was senseless.

"We want to express our condolences to her five children," said Kestenband.

State's Attorney Paul Ferencek said that despite the judge finding probable cause for the warrant in 2020 and an investigation by the State's Attorney's Office, the state doesn't have the evidence to prove a conspiracy to commit murder charge.
 

BREAKING NEWS: The state will not move forward with the conspiracy to commit murder case against Kent Mawhinney in the disappearance and death of Jennifer Dulos. Instead, Mawhinney today pleaded guilty to a lesser charge of interfering with an officer.

The family and friends of Jennifer Farber Dulos released a statement on Friday afternoon.

"We want to thank the state’s attorney’s office—in particular, Paul Ferencek, Michelle Manning, and Sean McGuinness—for their long-term commitment to this case and their careful consideration in seeking justice. We also express deep gratitude to the investigators and other law enforcement personnel for their dedication.

"Today’s development does not absolve Kent Mawhinney of conspiracy to murder. His arrest warrant includes evidence sufficient to bring that charge, but the burden of proof is great by necessity. The conspiracy charge was dropped for multiple reasons, including the fact that another lengthy, complex jury trial would come at a substantial cost, financial as well as emotional, to all involved. We are in full support of the state’s attorneys’ decision.

"Recently, we marked the six-year milestone of Jennifer’s disappearance. Many questions remain. It is clear that Jennifer was the victim of a systematically planned, ruthlessly executed murder, and her body still has not been found. We believe that someone possesses additional knowledge about where she is, and we hope fervently that they will come forward with that information.

"We miss Jennifer every day, in every way, and ask that you please respect the privacy of her family and loved ones. Thank you," Carrie Luft said in a statement on behalf of the family and friends of Jennifer Farber Dulos.
