Troconis filed a habeas corpus petition on Sept. 13, which claims her constitutional rights were violated during the Jennifer Dulos investigation in 2019. The filing calls for the judgements against her to be vacated. Troconis has been at York Correctional Institution since March 1, when a jury found her guilty of conspiring with her then-boyfriend, Fotis Dulos, to kill his estranged wife and helping him cover up the crime. Judge Kevin Randolph sentenced Troconis to 14 ½ years in prison.

The habeas petition targets her initial attorney, Andrew Bowman, for alleged “deficient performance and/or incompetent counsel” and then-Stamford State's Attorney Richard Colangelo for allegedly failing to honor an agreement in exchange for Troconis’ cooperation.

Troconis also is appealing her conviction before the state Supreme Court. That appeal is pending.

A 27-page habeas document filed in September contends that attorney Andrew Bowman, who represented Troconis prior to February 2020, never told her about the downside of speaking with investigators who were trying to find Jennifer Dulos, never prepared her for speaking with police, and never asked her whether she had any relevant information for law enforcement.

"There is no basis in fact or law to support this habeas petition," Bowman said Thursday. "I absolutely reject any claims that I did not render effective assistance of counsel."
Attorney Adele Patterson, one of the attorneys representing Troconis in the habeas challenge, said Thursday that "the trial dates are set and we expect to move forward."

The state had contended in its motion filed July 9 to have the case thrown out that Troconis' attorneys continued to include claims that Schuman had ordered removed from the habeas challenge. But Schuman said in his ruling that the claims in question were removed properly and then added to a separate part of the updated habeas document, which was not a violation of his orders issued in April.

Attorneys for Troconis argued in its motion that a psychiatrist's custody evaluation would have undercut the state's theory that the murder was motivated by adverse custody rulings.

Nagy wrote that while the state introduced evidence about the custody dispute, the defense was prohibited from questioning witnesses about Herman's report or introducing portions of it because a family court judge had sealed the materials after Jennifer Dulos' disappearance. Nagy argues on appeal that the sealing order should not have been used to exclude highly relevant evidence in a criminal trial and that doing so violated Troconis' constitutional right to confront witnesses and to present a defense.

Troconis is also challenging the legality of police searches at the home Troconis shared with Fotis Dulos, according to the motion.

ROCKVILLE, Conn. (WFSB) - Michelle Troconis will return to court on Monday to argue for release from prison and a new trial.

Troconis has been behind bars since May 2024 after being convicted for her role in the 2019 death and disappearance of Jennifer Farber Dulos.

She was sentenced to 14 and a half years in prison.

Troconis filed a request for release under habeas corpus.

She argues that her attorney Andrew Bowman was ineffective and that she was not properly advised about the repercussions of speaking with police multiple times during the investigation.

Those conversations were later used as evidence during the trial.

Troconis went on to use a different attorney, John Schoenhorn, during the trial.

Monday’s trial was set to start around 10 a.m. at Rockville Superior Court.

Only the judge will hear the case and will have 120 days to file his decision.

After Monday’s appearance, there will be two follow-up hearings on January 9 and 16.

Troconis’s team argues that when she was first arrested in 2019, her counsel was ineffective. The allegations stem back to her interviews with police in 2019 when she was arrested, according to her current team. She waited for her counsel at the time, Andy Bowman. In the petition, Troconis argues that she was never advised of the potential repercussions of speaking with the police.

Her then attorney, Andrew Bowman, has denied these ineffective counsel claims and maintained that his counsel was never a problem.

The petition also argues she was never advised of conversations between Bowman and the then-state attorney on the case, Richard Colangelo, and she was never advised of concerns about speaking with police multiple times.

Legal experts say it is unusual for a defendant to pursue a habeas trial before receiving a ruling on a direct appeal.

“I’m not sure there’s unanimity among defense attorneys,” said Jim Bergenn, a defense attorney at Shipman & Goodwin. “An appeal is limited to what happened within the four corners of the courtroom. A writ of habeas corpus allows you to look at anything, including ineffective assistance of counsel, which often happens outside the courtroom and isn’t part of the trial record.”

Bowman testified Monday that Troconis maintained her innocence.

Brown also asked Bowman about his decision to allow Troconis to speak with police after he had a conversation with then state's attorney Richard Colangelo.

"She's innocent. He's threatening to charge her with murder, and there was urgency because the body, if it was found, he was going to charge her with murder," Bowman said. "And she was persuasive, so I made a judgment to recommend to her that she talk to them. But in the end, it was her decision."

The petition also argues she was never advised of conversations between Bowman and Colangelo, and she was never advised of concerns about speaking with police multiple times.

Those police interviews were later allowed into her trial and offered by the state as evidence to prove she was involved in the plot to kill Jennifer and cover up the crime.

The trial is taking place in Rockville Superior Court, where many habeas corpus petitions are heard in Connecticut.

Troconis is claiming her former lawyer, Andrew Bowman, fumbled her chance at freedom when he allowed her to talk to prosecutors and police in 2019 after Farber Dulos vanished.

Her body has never been found, and Troconis was convicted of conspiracy to commit murder.

Bowman testified during this hearing that he stands by what he advised her to do.
