Here's the full article. It sounds like they want those 2 former school employees to give their testimonies while they're still alive and well enough to do so, as they're very elderly at this point.

STAMFORD — A Superior Court judge has ordered the deposition of two former Norwalk school workers in the murder trial of a man charged in the 1986 homicide of 11-year-old Kathleen Flynn.
The order came at the request of Assistant State’s Attorney Joseph Valdes as he seeks to expedite the proceedings against 59-year-old Marc Karun, accused of kidnapping Kathleen as she walked home from school and then killing her in September 1986.
Valdes wrote in a February motion for deposition that the two witnesses, an 83-year-old and a 77-year-old, are former employees at Ponus Ridge Middle School, where Flynn last was seen alive.

He wrote in the motion that “their testimony is required at trial” but, because of repeated delays in the case, the state is “concerned about the availability of these two witnesses at trial.”
Karun’s attorney, Lawrence O’Reilly, fought against the state’s motion during a pretrial hearing at state Superior Court in Stamford Monday. He argued the taped deposition violated his client’s right of confrontation and would provide inadequate opportunity to cross-examine the witnesses, but Judge John Blawie ultimately sided with the state.
“I want to move this along,” Blawie said prior to his decision.
It was not clear what positions the two witnesses held at the school at the time.
Karun, whose case has been floating around the court system since June 2019, originally was slated to begin trial this January; however, his then-attorney Todd Bussert eventually was forced to withdraw from the case because of “a new position,” Valdes said in the motion.
The case has been stalled on and off for nearly six years, in part because of superseding federal charges brought against Karun in Maine. Karun, a felon, was arrested on federal charges stemming from 60 weapons and nearly 15,000 rounds of assorted ammunition found at his home in Stetson, Maine, during his arrest in connection with Kathleen's homicide. Karun is not allowed to own any firearms because of his prior convictions.
In February 2024, Karun entered conditional guilty pleas to federal charges of possession of a firearm by a felon and possession of a firearm with an obliterated serial number. The case hit a snag ahead of sentencing, however, when Karun’s then-attorney Harris Mattson was nominated to become a local judge and was forced to withdraw from the case.
Mattson was later replaced by criminal defense attorney David Bate, who is reviewing the case with Karun — though the conditional guilty pleas remain in place, according to Assistant U.S. Attorney Chris Ruge.
Ruge said on Tuesday he expected the case to be set for sentencing soon, clearing a path for Karun’s murder proceedings to move forward.
Karun was arrested on June 14, 2019, in connection to the killing of Kathleen near Ponus Ridge Middle School in September 1986 following a decadeslong investigation conducted by Norwalk police.
The case sat with the department’s Cold Case Unit for more than 30 years before Karun was charged with murder, murder with special circumstances and first-degree kidnapping. The murder with special circumstances charge is an offense defined as a homicide that occurred during the course of a kidnapping, sexual assault or other felony or involves the death of a child under the age of 16.
Karun, who previously was convicted of first-degree sexual assault, attempted first-degree sexual assault and other charges in unrelated incidents, faces a life sentence without the possibility of parole if convicted.
Kathleen’s body was found one day after she was reported missing on Sept. 23, 1986, in the woods behind Ponus Ridge Middle School where she was a student. Her mother filed a report with police after her daughter failed to make it home that afternoon.
Karun, who grew up in Norwalk, was 21 years old at the time of the homicide. He was living less than 2 miles from the school and was considered a suspect within the first few weeks of the investigation, police said.
In January 1986 — eight months before Kathleen was killed — Karun was charged with sexually assaulting a woman at knifepoint in the woods behind what now is Norwalk Community College. He was arrested on charges of first-degree sexual assault and kidnapping. However, the kidnapping charge was nolled and the sexual assault was reduced when the victim did not testify. As a result, Karun served only a few months in prison.
Between 1986 and 1988, Karun was implicated in at least two other sexual assaults, an abduction and an attempted kidnapping, according to an arrest warrant. During one of these incidents, Karun told a sexual assault victim — a stranger — that “he would either have to marry her or kill her if she became pregnant,” the warrant said.
Karun eventually was sentenced to 10 years in prison for his two-year crime spree, and later was entered into the sex offender’s registry for life.
Karun remained on the Norwalk police’s radar for Kathleen’s homicide.
In 2012, the investigation focused on Karun after his DNA was linked to Kathleen’s fingernail scraping, his arrest warrant said. However, later testing determined it was inconclusive, the warrant said.
In 2017, police obtained a warrant from a Stamford Superior Court judge to obtain additional DNA samples from Karun in Maine.
On Oct. 3, 2017, Norwalk police Sgt. Alex Tolnay met with Karun in Maine at the Penobscot County Sheriff’s Office and collected the swabs. Karun then refused to have any further conversations with Norwalk police, according to his arrest warrant.
The samples were taken to Connecticut’s Forensic Science Laboratory for analysis and examination.
In 2017, DNA technology had advanced significantly over the last three decades. A new Fusion 6C test kit allowed further DNA testing on evidence that had been examined previously.
The similarity between Karun’s other cases and Kathleen’s homicide — along with DNA evidence — ultimately resulted in his arrest in the nearly 33-year-old case.
