* * * Custody Hearing 26 Mar 2010, 11am, Phoenix * * *

I just got here and I'm super happy but confused. Why contempt? What did she do? Not talk? I thought she had the right to take the 5th?

The KHPO video says there will be footage from the courtroom of her tonight, so maybe that will clarify it. I thought you couldn't be held in contempt when you take the 5th, so I'm not quite sure.

Maybe she misbehaved in court? I wonder why the contempt as well.

I truly, completely, thoroughly, and genuinely hope this is because he is still alive and she thinks they will find him.

if she had killed him why cry when dad gets custody?

I'm curious about what point she cried. And if she really cried. And if they were sad tears or angry tears.

Well now that makes sense. I'll bet that's why.

Me too! When they reported at the last hearing that her "lip quivered", I did not see that. They made it sound like she was incredibley sad, but again, that's not what I saw.

I would like to think she was crying because she gave him away...I would love to think that's why she was crying....but I'll have to wait to see if they put it in video to see it in perspective.

McQueary's attorney, Craig Mehrens, asked McVey to find Johnson in contempt for violating his December ruling that awarded visitation rights to McQueary.

McVey set a hearing for April 28 to review the contempt allegation.

Mehrens said McVey could order Johnson to produce the baby, or force her to remain in jail in contempt of court until she does.

WOW! Could that be an indefinite sort of thing? Like, forever if he isn't found?

So if she is held in contempt, and she tells the court the location of Gabriel, what charges would she face at that point? All the same charges?

The reason I ask is because if she is still facing the same charges, what will encourage her to come clean? I don't see that happening...

I think it is tears of defeat. she thought she was in control of everything...well, guess not little lady...maybe she will crack...let's hope so....

I hope so too. I think if she was emotional at the hearing, it's only because she "lost". I don't see her surrendering, unless some of the charges are going to be dropped. I think she is far too stubborn to crack now. In her head she has to "win" something....Even if her "win" is knowing Logan can't be with Gabriel. This girl drives me crazy!!!!!

I'd be curious to know if her attorney asked any questions ???

I think Judge McVey has no tolerance ( thank goodness)...however, you can't get water out of a rock? She knows already she's going to spend quite some time in jail for charges already against her. So she's probably thinking, so what, add this to the tab I already have....I just want to choke her!

The child's mother, Elizabeth Johnson, refused to answer any questions from Judge Michael McVey or McQueary's attorney about where Gabriel is. She began to cry on the stand when McVey asked who she gave the boy to and whether she has any information about Gabriel's safety.
