A Delaware judge, once again, has found that a conservative news outlet broadcast false and defamatory claims about the role a voting technology company played in the 2020 presidential election. This time, that network is Newsmax, Fox News' upstart rival, which is fresh off a successful initial public offering.

In his opinion, Judge Eric M. Davis says Dominion "presents clear and convincing evidence" that shows Newsmax broadcast segments with inaccurate information that "would likely cause reasonable viewers to think significantly less favorably about Dominion than if the viewers knew the truth." He also noted that Newsmax's "clarification" posted in mid-December 2020 about a lack of evidence of voter fraud showed that Newsmax "acknowledged the falsity" of several lies regarding Dominion and the election.

If the lawsuit heads to trial as scheduled later this month, the jury will be asked to decide whether to award damages and how much, and whether the broadcasts were aired with "actual malice," which means knowledge of falsity or disregard for the truth.
 

U.S. District Court Senior Judge William J. Martínez concluded certain statements disseminated by Clayton Thomas "Clay" Clark and his "Thrivetime Show" were not simply opinions or hyperbole. Instead, the defendants publicly conveyed that plaintiff Eric Coomer committed a crime by purportedly altering the outcome of the election.

"In the Court’s view, this was not mere political invective or opinion statement; rather, Clark unequivocally told his audience that Coomer literally committed the crime of treason," wrote Martínez in an April 25 order.
 
"Years after the 2020 election and in the wake of a landmark $787 million settlement with Dominion Voting Systems, Fox News is continuing to fight back against a $2.7 billion defamation lawsuit brought by voting machine company Smartmatic.

In its 12-page filing, Fox laid out a litany of what it said were Smartmatic's "ongoing reputational problems" in an effort to give credit to some of the claims made on its air about the company in the wake of the 2020 election. They say that "none of it was defamatory."

In its own filing on Wednesday, Smartmatic claimed that Fox News "deliberately deceived its audience" when it reported claims of fraud surrounding Smartmatic after the 2020 election -- and claimed that the top officials at the company, Rupert and Lachlan Murdoch, "knew President Trump lost the 2020 election" and "mocked" him in private.

In a statement Thursday, Smartmatic's attorney Erik Connolly said, "Fox is running the same playbook as other abusers, trying to sully the victim." "

On June 4, Lindell wrote on social media that "My employee-owned company and I are in jury trial NOW and need your support!" He included a link to a landing page on his company's website that includes the line, "Use promo code JURY" to receive a "free Multi-Use MyPillow 2.0" with any purchase.

The website also includes a link to "Mike Lindell Legal Defense Fund," which asks for donations of between $10 to $1,000. The fundraising effort notes that Lindell has spent "nearly all his resources ... to exposing corruption in our election systems."
 

A defamation trial more than four years in the making is wrapping up at the federal courthouse in Denver.
