If their reputation has been unfairly damaged, they're perfectly within their rights to the money.
I think Fox News paying would be an admission that they did the wrong thing.
Unless Fox apologizes they can always say they made a business decision to settle the case. That is always what a company says when it settles a case.

I'm not a lawyer, but if Fox offers them exactly what they are asking for, then Dominion might have no choice but to drop the suit. What further reason could be given for them to pursue action?

I don't want them to settle because this case needs to set a precedent or news agencies will have free reign to spread whatever malicious lies they wish.

No matter how this turns out, there are millions of people who still believe Trump really won the election, including my dear husband- we recently had a discussion that went something like this: me: 60 judges (many appointed by Trump) threw the case out of court due to lack of evidence for fraud-
him: that's because the judges didn't allow the evidence to be presented.
Now, tell me how you can argue with that twisted logic? there is no way.

With more than $4 billion in cash on its balance sheet as of the end of 2022, Fox could probably cover even the maximum amount that Dominion is seeking without having to sell any of its existing assets to do so. In its most recent quarterly earnings report, Fox said it did not expect the “ultimate resolution” of any claims from the suit to have a “material adverse effect” on its business.

Wall Street analysts say the publicly traded company’s stock is likely to take a hit as a result of the suit.

Bank of America Securities estimated in a March 28 note that for every $500 million in damages, shares of Fox Corporation would lose about $1 per share. The company’s stock, which was trading at $33.62 late Monday morning, has fallen by more than 10% since Dominion filed its lawsuit in March 2021, a period in which the Dow Jones Industrial Average rose more than 2%.

Fox News filed a motion late Sunday evening asking the judge to reconsider restrictions that he had placed on its case that would have barred Fox from using evidence that other parties, including former President Donald Trump, were making the same claims about Dominion that the network aired in its defense.

In its lawsuit, Dominion originally had asked for $1.6 billion in damages. In its motion filed Sunday night, Fox said Dominion had knocked off more than half a billion dollars from that figure.

The motion referred to an email Dominion lawyer Brian Farnon sent to Fox's legal team on Friday afternoon. "Dominion will not be presenting its claim for lost profits damages to the jury, given that it is duplicative of the lost enterprise value damages," Farnon said.

Taken literally, the email suggests a honing of the case for the jury's consideration. It also served potentially as a message to Fox that Dominion might be receptive to negotiation talks at the eleventh hour.

Dominion struck back against that notion later Monday morning.

In a statement released through a spokesperson, Dominion said, "The damages claim remains. As Fox well knows, our damages exceed $1.6 billion."

Carlson, a longtime Fox News employee who previously sued and has voiced opposition to her former network, wrote on Twitter on Sunday night that Dominion should refuse any settlement and bring the case to trial.

"PLEASE Dominion --- Do not settle with Fox! You're about to prove something very big," Carlson tweeted.

Carlson did not specify what exactly Dominion would "prove" in the lawsuit. In a follow-up tweet, she said a nondisclosure agreement would prevent her from saying whether she was ever asked to make things up while working at Fox News.

"Here's my take on Fox-Dominion case-(as I'm sending telepathic messages to Dominion to not settle!) I can talk about the current case-but I can't then answer next logical question (b/c of my NDA)-'Did Fox ever ask you to make up s*** when you were there?' Therein lies the problem," she wrote.

Carlson in 2016 filed a lawsuit against former Fox News CEO Roger Ailesclaiming sexual harassment, prompting others to also come forward with their own allegations. She ultimately settled that lawsuit, which was depicted in the film Bombshell, for $20 million and has since become an advocate against sexual harassment.

In a 2019 interview with BuzzFeed News, Carlson alleged that she was told to take positions she did not always agree with at Fox News.

"And with regard to Fox News, listen, we all have producers in the morning who set the agenda, and there are many times that you don't agree with what you're going to be saying that particular day," she said. "And you pick your battles."

Dominion has also asked for punitive damages. The difficult part of the suit seems to be that Dominion will need to prove "actual malice" on the part of Fox. MOO

Fox News is also facing a $2.7 billion lawsuit from voting company Smartmatic in a New York court.

Last week, they settled a smaller suit brought by a Venezuelan businessman who was identified as a key player in the bogus stolen election claims.

If Fox is allowed to settle without any explanation or apology for their actions, there is nothing to stop them from continuing on with their lies of all kinds since all they do is lie every day about all kinds of things.- I read they have enough money to pay 1.6 billion without really hurting their bottom line.
