I can't believe that a trial of this magnitude is not being televised for everyone to see and hear. Personally I would like to hear the evidence with my own ears and not retweets. The phone line is at capacity. JMO

Ninety minutes for both opening arguments​

Each side is supposed to get 90 minutes each for opening statements.
If Judge Davis wants to cram both in today, that should take the day past 4:30pm, which he has said he didn’t want to do.
It was supposed to begin at 1.30pm, but there’s no sign of a start yet.

Unexplained delay to opening arguments​

Opening statements were expected to begin at 1.30pm, but there has been an unexplained delay.

Both sets of lawyers have entered the courtroom, and are waiting for the judge and jury to enter.

No word on what has caused the delay yet.

One hour late, and no sign of a start yet​

It’s now more than one hour since opening arguments were due to begin, and it appears the unexplained delay in the start of the Fox News-Dominion defamation trial may last for some time.

Both sets of attorneys are in the courtroom, shuffling around at the desks, standing, walking off occasionally, but all appear to be in the room and waiting for a start.

Delaware Superior Court Judge Eric Davis has formally named a special master to investigate whether Fox News withheld evidence from Dominion Voting Systems, according to court filings.

CNN previously reported that the judge was planning to bring in a special master to look into this matter.

This comes ahead of the expected opening statements in the $1.6 billion defamation trial against Fox News.

Judge authorizes special master over potential 'discovery issues'


After sanctioning Fox News last week for a delay in turning over evidence, Judge Eric Davis has now officially authorized a special master to investigate Fox News' potential "discovery issues," according to a new order from the judge.

The order comes just before opening arguments in the case are scheduled to begin.

According to the order, the investigation by the special master will "include a determination" of whether Fox News and Fox Corp "complied with their discovery obligations."

The special master, who was previously appointed to oversee discovery in the case, is now "further authorized and empowered" to look into multiple declarations made by Fox attorneys in the case, the order says.

The judge tapped Delaware litigator John Elzufon to look into whether Fox complied with its discovery obligations heading into the defamation trial, according to a four-page filing.

The special master can depose whomever he wishes — and all those costs must be paid by Fox, as Davis explained from the bench last week.

Elzufon must provide a written report regarding the investigation no later than 4 p.m. ET May 15.

I don't think there's going to be a trial. I think they will end up settling because the bottom line is they are both more concerned about their profit line than anything. I do agree with you that it should be televised or online! JMO

Evidently there are 2 lines for trial listeners- 774-258-6500 or 617-944-8933. I just go through on the 2nd one, it's totally dead air.

Honestly this is the most Delaware thing ever with all the delays. Seems like DelDOT is in charge of this cause it's running like road construction around here.
