Good point. I believe his condition worsened because of the onset of another medical problem such as pneumonia prior to the final testing that determined he was brain dead and had no hope for recovery.

What's the basis of the claim that he developed pneumonia? I don't believe his organs would be suitable for donation if he had fever and an infection.

Weren't we told that Rebecca killed herself because she got a call saying Max's condition worsened? So if that's what drove this woman to suicide, isn't it fair to conclude the family was told Max isn't going to make it before Rebecca's "suicide?"

Thank you Jjenny for stopping the never ending morphing story. We really have to work hard here to keep on keeping on keeping this story straight. It's like doing battle with an out of control alien monster.

This is just my lame attempt at humor so please don't take offence. However, your point is well taken and this is a serious matter.

I totally agree that the reason for Rebecca's alleged suicide seems to change with each version of events. However, I do not believe any version of this story logically proves she committed suicide. The circumstances of her death point to murder in my opinion.

Was supposedly enough for Rebecca to kill herself in despair. If Max was still expected to make it why did Rebecca kill herself after that phone call?

Because she was feeling rejected by JS and she was banned from the hospital, he did not stand up for her, and she may have been told by JS that he blamed her.

Also, what if something happened that day, not her fault, but she felt she had to cover for someone else? Would that all be too much for her?

We already discussed this for a while some time back. I don't see anything to indicate this child was actually diagnosed with spinal cord damage while still alive. If one didn't know about the spinal cord damage, his cardiac arrest didn't make sense.

I believe the cardiac arrest came after he was removed from life support.

Brain death can be diagnosed without knowing the cause of it.

Cardiac arrest is what he had after the accident. He had no circulation. Which is called cardiac arrest.

Was pneumonia shown on the autopsy report. I don't recall if his lungs were donated or not but if he had pneumonia I don't think they would take his lungs.

His lungs were not donated. They were still present at the autopsy.

The basis is the fact that his condition did worsen and the decision was made to disconnect life support. I said "such as pneumonia" which would hasten the need to make a decision about life support removal. Not all organs would be unsuitable for donation.

He was diagnosed as brain dead. That was the basis to discontinue life support. Nobody, I presume, would even dream of discontinuing life support because of a condition such as pneumonia, considering pneumonia would be treated with antibiotics.

We got a whiff of the beginning of this 'crusade' back in September of last year. I will have to find the thread and the post, and link to it here.

Websleuths Crime Sleuthing Community - View Single Post - CA - Rebecca Nalepa - suicide or murder? #9

I have now been verified as an insider in this case.

Alright, here are the things I know. LE is aware of everything I am about to share. I just have some tidbits, nothing earth shattering lol.

-Some family members do not believe Max died accidentally. I will leave it at that. Dina has hired a private team to investigate in the hopes that LE reopens the case and believes Max was suffocated before the "fall."

-Since March of this year, Dina told Jonah she did not want Rebecca alone with Max. This is due to her getting "weird vibes" from Rebecca. A background check was performed on Rebecca that revealed things (I was not told what those things are nor will I prod about them).

-Jonah has an interesting past of having his ex wives/girlfriends boyfriends followed, investigated, photographed etc...

-Rebecca was forbidden to go to the hospital to visit Max.

I will share more as I learn more.

### End of post ###

FWIW - Last night on JVM it was told a little differently -

SHACKNAI: Jonah and I had an agreement based on a meeting that she and I had the September prior to this. And at the time that I met her, she gave me a name that she had never used, as far as I knew, in this country. So she had used the name -- she gave me the name Rebecca Zahau, but at the time, her name was Rebecca Nalecka (ph). I didn`t -- she didn`t share with me that she was married at the time. And she didn`t share with me that she did have a shoplifting incident. And so these things were concerning.

In my opinion this article appears to point to a disagreement between Bove and Melinek.

Melinek said that Max’s injuries were inconsistent with a fall and “it would be more accurate to certify that manner (of death) as a homicide.”

Bove said that Melinek proposed a scenario in which Max was assaulted, resulting in his facial and forehead injuries, with his back then contacting the stair railing.

Hallier said “an assault scenario is the only scenario that Dr. Bone and Dr. Melinek, in collaborative consultation, could identify that accounts for the multiple planes of injuries on Max’s body and the scene findings.”

However, Bove said he had "not taken a position" as to whether the incident that resulted in Max's injuries was intentional.

Parents are allowed to make decisions about whether to treat a life-threatening condition or not. I was merely giving an example as to why the decision may have been reached to discontinue life support at that point in time. You earlier stated that you think the parents knew early in the week that the child was brain-dead and I don't believe they did. But once they did know and also knew the child's condition was worsening, they made a very difficult decision that you want to bash.

I doubt organs that have received systemic antibiotic treatment are suitable for donation but that's just my opinion.

Well, I dunno. It hardly really matters, but it seems if she interrogated Rebecca the previous September (2010?) and then had Rebecca 'investigated' it might have taken until March of 2011 to get the results back. Given Rebecca's use of an alias and her shoplifting history, Dina is lucky Rebecca didn't off the whole family and take control of the entire estate in those six or seven months while Dina's investigation of Rebecca was taking place. Just my opinion.

I dont know but I doubt my daughter's friend took a long time to bind her hands and feet together either when she jumped off of a chair in the foyer of her home when she committed suicide.

Every suicide victim has their own individual way they want to carry out their suicide.

Here is a part of the link I was talking about earlier.

Anger and vengeance can be expressed by completing suicide while naked, especially when it is intended to traumatize a survivor. The shock of discovering a naked suicide inflicts an indelible, traumatic memory that can haunt a survivor for a lifetime.12 The person who completes suicide while naked may intend to add insult to a suicide survivor's already devastating injury.

BBM

This assessment doesn't fit the victimology here imo. To me how Rebecca was found dead looked more like a vengence killing aimed at traumitizing someone with whom the murderer was very angry.

It's Nalepa

If I had the energy I would gather the other quotes pertaining to this that have recently been in the media also. I believe they even somewhat contradict the two here. IIRC, somewhere Dina backtracked and said they (her and Jonah) were going to make an agreement and also one statement said that agreement was not about Max being alone with Rebecca but instead about Max being alone with Rebecca when her family members were present. Maybe those two things were in one statement she made. I'd appreciate it if anyone else can provide the recent reference.

Iirc, Jonah was playing golf.

The police has already said that no one was there at the time but Rebecca, her sister, and Max.

IMO

Jonah took a walk or ran down the street to workout at the gym. The gym is now closed.

And to me, how Rebecca was found dead looked more like a vengeance suicide aimed at traumatizing Jonah and Dina Shacknai, with whom Rebecca was obviously very angry.

And I still wonder why Rebecca would not call the detective back that had called her two or three times that Tuesday. THAT says a lot to me.

I think the impossibility part comes with the force it took for him to land on the chandelier and pull it from the ceiling. If he simply fell over the balcony, that would not have happened. He had to be going very fast and very high to bring down the chandelier, imo.

If he were running or skateboading and the tripped and flew he may have grabbed the chandelier but I still have a hard time seening how it can down.

By the same token I don't really see how the puported only other two persons there could get it down either. Does anyone here have any theories on how to pull a chandelier out of a ceiling fixture?

If it wasn't attached well not much force would be needed to bring it down.
