Nel is back on his feet. He is discussing again the difference between matters of fact (on which the state cannot appeal) and matters of law (on which it can). The issue of Pistorius’s intention when shooting is a matter of law, he says.

It’s common sense, Nel says, that the line of distinction between matters of fact and matters of law is “very thin”.

Me: I totally agree on this point! I thought that Masipa's verdict there was craazy.

I get the feeling that Masipa might well allow the appeal to cover her back as well as getting it off her back and so shunt the question as to whether the State is appealing on questions of facts or law along to the SCA and let them decide. I don't personally think it's gonna work even then but I really hope the judgement will go to appeal and be looked at if only to settle the questions that have left so much discontent once and for all... even if some would not accept the SCA's findings either whichever way it fell.

ROUX: in every paragraph, where the state says it is our error, we give the proper page numbers to show every point, without exception, has been dealt with by us already. The court did take those factors into account.
