She clearly has more money than brains. IMO
I hope you're dog recovered completely. So sad.

Yes she does have money- huge house on a private street. Husband was CEO of a company with major contracts!
Thanks for asking about my dog, she's healed except for fur regrowth, but doesn't understand why I've stopped walking her.

Many owners do have guard dogs. They are still liable for their dog's actions. There really is no defense just as there is no defense if your kid causes damage to someone else. The owner/parent is responsible.

Exactly, you are entitled to guard dogs for protection, but noone needs vicious dogs for protection!

Subpeona, that's why. We will have the owner in our case served by the sheriff, hopefully at her work, which is a local elementary school! Everyone there will know about it and talk about it, wish I could be there to see it happen!

I meant we were baffled why our neighbor didn't resolve it out of court. Liability was clearly on her and no way would she win. Now it is a matter of public record.

This is heart breaking! I am a proud dog owner as well a firm believer that it is my obligation to teach my dog right from wrong.

I have always lived in a state with Leash Laws, so your stories are even more upsetting!
Can you push for Leash Laws in your state?

Ironically, my dog was on leash when she was attacked, and she is a big dog. The dogs who attacked her escaped from their unlocked yard.

They escaped from a fenced yard? My dogs are smart but they haven't figured out how to unlatch the gate, fortunately. (One of them did figure out how to unscrew the infant safety gate across the laundry room door.)

Owner claims the gardener left the gate open, therefore she is NOT responsible- she was at work and got called by one of the witnesses to come pick up her dogs. He apparently recognized them. Animal control determined there were no locks on her gates.

Ah, that is great! The owner acknowledges the fault lies with her staff! Most gates don't have "locks" on them. Who knows how or why the dogs got out but if the owner acknowledges liability, you have won your case. They really sound like terrible dog owners, imo

RSBM

I have often wondered that myself. After a dog bites someone to the point where he/she gets a taste of human blood, does it lose its' natural inclination to prefer dog food or whatever ?

LOL. No, that is an old wives tale. I have had many dogs over the years and on some occasions they have quite literally lapped up my blood (if I accidentally cut myself or whatever). They did NOT go crazy and try to eat me afterwards!

Likewise my mastiff bit the heck out of a guy's forearm when the guy tried to grab him without permission. It didn't change my dog at all however it did change me as now I specifically tell strange men that take an interest in him NOT to touch the dog! I have realized some people have absolutely no sense!

Oh, but she's not acknowledging liability, it's not her fault! Fired her gardener and ignored our letter two weeks ago for our vet bills, which she could easily afford and we can't. It's time to threaten her with taking her to court.

You should and good luck!

Do you have photos of your dogs injuries?

Recently , a woman's greyhound was viciously attacked by an "running at large dog" that did significant damage and a thousand plus dollar vet bill. Owner behaved like your neighbor.
Greyhound owner called the local newspaper they ran the story with graphic color photos of injuries on the first page. And now everyone wants laws passed increasing the fine and holding dog owners more than just responsible for bet bills.
I can't figure out how to find it to link it for you...it scrolled off my newsfeed on my fake Facebook account;)

Let me search the web...brb...

^^^^I've never examine my homeowner's insurance with respect to dogs. Do you know how this usually addressed by the insurance company?

I use State Farm and I don't believe they ban any breeds. When getting a homeowners or umbrella policy you can ask them if they ban certain dog breeds, or ask your insurance agent now (but don't offer too much info on your dogs, ya know? Especially if you are applying for a new policy).

Now if there is an incident and a claim is filed with the insurance company by an injured party then you can expect them to change things.

Yes, we took pictures, also of the blood stains that won't come out of the backseat of my car.

You are right. The dog reacted out of instinct and the kid wasn't supervised. Terrible combination but it is wrong to totally blame the dog. My city passed an ordinance last year that makes it illegal to chain a dog for more than 20 minutes because unsupervised children have a tendency to provoke chained dogs and it makes them more aggressive.

We also have a law where I live that you cannot keep a dog chained more than two hours daily. I think every city should have a law like this because it forces the owner to have some kind of contact with their dog. I don't understand people who get a dog just to have it chained in the backyard. Leaving the neighbors to hear the dog bark all day and all night. They are not protection because nobody knows if the dog sees someone because its always barking. I have called animal control on so many people for leaving their dogs on a chain. One dog was mauled to death because it was stuck on a chain and another dog came along and killed it, the poor dog couldn't run from its attacker. If you see a dog who is constantly chained call animal control you can stay anonymous. I personally would rather see a dog in a shelter where it may be killed instead of watching it suffer with no food, love or kept warm in the winter and cool in the summer. Prisoners are treated better than some of these animals. They are innocent animals who only need food, shelter, water and love.

My insurance actually covers my dogs if they bite someone. I don't tell my neighbors this because they may try to provoke them into biting them. Of course my dogs are never out of my site, but someone could come to the door and they could get past me. They don't bite but they are big and scary looking, and they do jump up freaking people out.

I agree about the dog chaining.

I don't even understand people who leave their dogs outside all the time. Dogs are pack animals. In absence of a dog pack, the human family becomes their pack. They want and need to be around people. They need to know who is in charge, and they need to feel wanted and loved. They need exercise WITH their pack, just as they need food and water. Giving the dog a job (like watch dog or guard dog or carrying an object dog or service dog, etc.) is wonderful for them as well, but not if it comes at the sacrifice of companionship. Knowing this about dogs, WHY would anyone get a dog who doesn't want to give that dog what it needs?

This is a tough one for me. I am a huge dog lover. But I also love children and feel strongly that its not hard to keep a child out of harms way if your actually watching the child. All to often I see cases like this where the care giver was careless.

I've worked with dogs all my life. And studied to get a diploma to train dogs. And I guess I just know not to trust any dog unless you know that dog. I would be flipping out that my child was allowed to get that close to an unknown chained dog.

But maybe this dogs life could be spared but its going to IMO have to go to a educated and responsible dog lover. The dog obviously has food aggression IMO and that can be worked with. There are people with no children who would give that dog a great life.

At the same time as much as I love dogs. I wouldst hesitate to put down a dog if it was for everyone's safety.

This wasn't a warning nip, the dog took the child's face off in a sustained attack. This is a breed of dog, by the way, responsible for a clear majority of fatal dog attacks in the US. Of course it should be put down. It has the capacity and propensity to cause serious harm, next time it could be much worse.

This breed of dog is also the breed of choice for some of the most ABUSIVE and NEGLECTFUL dog owners in America. There are a LOT of pits in this country, I would like to see the actual statistics compared to the number of dogs within that breed (not just the total fatal attacks).
