If SA did in fact take the investigative depo that HHJS approved way back when, why would they need to be taking another depo tomorrow? Has something happened (legally) where they can now question him further - IOW he now HAS to answer questions he may have refused to in the prior depo? Is it just to allow the defense to be present as LG mentioned? Or maybe the investigative depo never did happen (hence the reason we never have seen that one) and that's why they're now taking a "regular" one??? :waitasec:

I'm thinking it has to do with the tampering case. Maybe something that came up there has made it's way into the murder case? It seems like they had little interest in him up until now, and the tampering case seems to have picked up some heat in the last few months or so. Or maybe the state has finally decided to use him to further their case in how hard Caylee was to find? I don't know, but it seems like something has happened that has caused the spotlight to land right back on DC. I am so curious, it's about to kill me!

Isn't an investigative depo sealed? As in a secret? So...I'm guessing something has happened that has caused them to re: depo him openly so information they know would be helpful and found out in the secret one, can be used at trial.

BUT best I nip over to the legal thread and sit at the feet of our legal guru with this question....BRB

I'll go over to legal to see whatcha got, but at some point when the investigation ends, don't they have to release the info?

I posted this the other day in another thread and thought I'd bring it over. One may have not anything to do w/another but then again it may...I think DC may be in some serious trouble for multiple things he has done while being involved in this case besides poking around those woods talking to who ever it was instructing him not to call 911 when and if Caylee was found!!

I'm sure this has been discussed somewhere here at WS but since this about DC, thought I'd bring it up.....seems someone left a threatening voice mail for Amy Huizenga telling her to drop the Theft Charges against KC. Could this person be the same person that was instructed not to call 911 if he found Caylee in the woods?!? Sure sounds like DC to me!!

The call originated from New York where CA & GA just happened to be doing Larry King at that very same time also w/them was DC...sure sounds like it could be him to me so if he would make threats like that to a young woman over the phone for the A's and go into those woods as instructed by someone which I believe it Cindy then just how much would he actually do for her?!? I believe it was him threatening Amy Huizenga at the request of Cindy and I believe he was in those woods because of Cindy, just my opinion of course, but, I'm willing to bet we are gonna hear alot of surprising info when it comes to this character!!

It's at the SA office. Does Baez usually depose state witnesses at the state's attorney's office?

Just to clarify, since he is a State witness, the Defense is deposing him correct?

The notice is linked above. It's the State that is taking his deposition, and after they finish their questions, then the defense has the opportunity to ask questions also.

If it is as I suspect, then the testimony of DCasey is going to result in "fisties" from Casey.

Anyone who has not studied this case, potential juror reading this would get the impression that months earlier, the place where she was found was searchable, not under water, even though they are showing the Brackenwood house. Ah, journalism at its finest.

They could have said "DC searched this area just one month before Caylee's body was discovered"

And if it wasn't secret, why wasn't the defense allowed to attend the depo? And what has triggered this second one? If it is going to start at 2PM, it doesn't sound like it isn't going to be a very long one, does it?

Okay, now I can't even guess what's going on here. I want him to be a "bombshell" witness - it was so starting to look like he had the goods on Baez and the Anthony's after we all saw the video of that shocking and terrible slashing search he did. But then I read those stupid emails with the psychics and all the air whooshed out of that balloon.

I really really want this depo to be important - but...........

They could have said "DC searched this area just one month before Caylee's body was discovered"

Not to mention the picture is at the abandoned house, not the Suburban Drive site.

I agree. That's just how *I* read it. I'm usually wrong, but poorly written is an understatement. :crazy:

Because it wasn't a deposition. It was an investigative interview. Since DC was not included on both witness lists, and is solely a prosecution witness, they can talk to and interview him without inviting the opposing party.

While interviews are not sealed, it only becomes a matter for the public eyes if a record was created. A signed sworn statement, a transcript or a recording. Investigators talking and taking notes is work product and does not get released.
