Dominic Casey: Motion to Strike Notice of Deposition & Motion for Protective Order#2

  • #481
I posted this the other day in another thread and thought I'd bring it over. One may have not anything to do w/another but then again it may...I think DC may be in some serious trouble for multiple things he has done while being involved in this case besides poking around those woods talking to who ever it was instructing him not to call 911 when and if Caylee was found!!

Here is my original post on another thread:
I'm sure this has been discussed somewhere here at WS but since this about DC, thought I'd bring it up.....seems someone left a threatening voice mail for Amy Huizenga telling her to drop the Theft Charges against KC. Could this person be the same person that was instructed not to call 911 if he found Caylee in the woods?!? Sure sounds like DC to me!!

The call originated from New York where CA & GA just happened to be doing Larry King at that very same time also w/them was DC...sure sounds like it could be him to me so if he would make threats like that to a young woman over the phone for the A's and go into those woods as instructed by someone which I believe it Cindy then just how much would he actually do for her?!? I believe it was him threatening Amy Huizenga at the request of Cindy and I believe he was in those woods because of Cindy, just my opinion of course, but, I'm willing to bet we are gonna hear alot of surprising info when it comes to this character!!

1. I think you mean Today Show. http://today.msnbc.msn.com/id/26184891/vp/27318499#27318499
2. Do we know for sure (link if you have one!) that DC was there in NYC?
3. Larry Garrision was still spokesman for them.

Maybe it is about the little old botanist for the DT, I remember in her depo she mentioned that the DT investigator pointed out where the body was recovered. *shrugs*

Does anyone remember how DC came into this case? Did JB contact him or did he volunteer his services? I'm curious as to just how much of a perfect patsy DC could be for the DT and whether he might need to spill all he knows in an effort to save his own hide. TIA!

Yes, the State [not the Defense] is deposing Dominic.
The State put Dominic on the State Witness List ... but he is NOT on the Defense Witness List.

Dominic was just given to the State along with other "possible" Defense witnesses [such as Tracey Wollam], who have not yet been "officially" added to the Defense Witness List - not filed with the Clerk, so the State is taking depositions of these "possible" Defense witnesses.

Because it wasn't a deposition. It was an investigative interview. Since DC was not included on both witness lists, and is solely a prosecution witness, they can talk to and interview him without inviting the opposing party.

While interviews are not sealed, it only becomes a matter for the public eyes if a record was created. A signed sworn statement, a transcript or a recording. Investigators talking and taking notes is work product and does not get released.

Ahhh - Thank you! Got it! That completely clears up what has been bothering me, and kept me :waitasec: Perfect! :skip:

IIRC, JB didn't understand the distinction when it came up back in December 2009. :giggle:

Thinktank summarized the hearing dialog rather succinctly in the following post:

Just to clarify, since he is a State witness, the Defense is deposing him correct?

He is on the State witness list ... but he has recently become a "possible" Defense witness, and that is why the State is doing a "regular" deposition of Dominic now, along with other "possible" Defense witnesses, who are not yet officially on the Defense witness list.

My apologies if this is a dumb question, but is it normal to have all these last minute changes in terms of witnesses, depos and what not?

Asking with respect ThinkTank, do we know that for sure? That the SA is doing this depo because he might be a witness for the DT?

Is it possible they want him as a witness for their own purposes, regardless of what the Defense is doing?

The State already has Dominic on the STATE witness list, so they will use him for the State. He was added to the STATE witness list on March 23, 2009.

A witness can be on both the State and the Defense witness list ... as in Cindy's brother, Rick, and also Mallory.

We know that Dominic is now a "possible" Defense witness, because the Defense has given the State names of "possible" Defense witnesses, and then the State sets a date to take their deposition (even though the people have not yet been "officially" added to the Defense witness list by filing with the Clerk.)

We know who has been filed officially as witnesses on both the State and Defense witness lists because MuzikMan gets all the notices for us.

We know that it is the STATE who is doing the Dominic depo today, because it is written on the Notice of Taking Depo which was filed March 23rd. The fact that the STATE is taking the Dominic depo means that the witness is either already on the Defense witness list, or ... is a "possible" defense witness to be officially added to the Defense witness list later.

Just as in the Kevin and Lisa Gallaway witnesses. Their names were initially given to the State, by the Defense as "possible" Defense witnesses, who had searched Suburban Dr. The State took their depositions, and learned that their testimony helps the STATE ... not the Defense ... so the State officially added the Gallaways to the STATE witness list - and the Defense never officially added the Gallaways to the Defense witness list.

:rocker:

Sounds like someone is looking for any signs of a smoking bombshell for the SA in terms of why DC was searching and who was really directing him, i.e., A's/ICA. :great:

Is this the elephant in the back room?

I think that you are close... but I think the defense wanting any part of DC has everything to do with them going after George and Cindy. DC can not say anything about what happened between JB and Casey from July - October 1st, 2008 because it is work product. From October 1st, 2008 (when DC terminated his contract with the defense) until now... is open for discussion.

Dominic Casey had no contact with Casey Anthony after October 12th, 2008 (from what he says in his LE interview). That was right before her indictment.

Now... Cindy and George have stated on multiple occassions that they have had zero contact with Casey... including exchanging letters with JB (they give themselves away in their jail house letters). So George and Cindy, according to their testimony and media interviews, have had no contact with Casey since October 14th, 2008... so Casey could not have been the one who led Cindy and George to the Suburban Drive location... so if they did not get this information from Casey... then how did they know where Caylee's remains would be? You would think that only the murderer would know the location of the remains... this is what I think the defense is going for. I think they know full well that the Anthony's sent DC out into those woods (Cindy even blurted that out to detectives "I already sent someone out there in November and nothing was there").

They are going to try and create reasonable doubt by saying that the Anthony's are the ones who knew where Caylee's remains were... not Casey, who had proclaimed over and over again that she didn't know where her daughter was.

The fact that Cindy was caught in a lie during her State deposition works really well here. If Cindy had nothing to hide, she would have admitted to knowing about DC being out in those woods prior to December 11th, 2008. She states in her deposition that she didn't know DC was even out there until after Caylee's remains were found... but Lee, in his State deposition, is adament that Cindy did know prior to Caylee's remains found... because he was extremely mad that they went out there looking for a deceased Caylee when Cindy told him about it... before Caylee's remains were found. Cindy lying about the whole thing makes her look extremely guilty about something... that something sounds like she knew where Caylee was and sent her own P.I. out there to find Caylee.

DC also was really suspicious of George and Lee Anthony. He thought that one of them may have been the person responsible for Caylee's death. DC and Luke even stated that it was possible that Lee kept Caylee's remains in his storage unit prior to her being dumped on Suburban Drive.

What I don't understand is why JB would want to open these can of worms? He doesn't know what DC stated in his investigative interview so he has no idea if DC gave even more incriminating evidence against his client, Casey. I think he is taking a huge gamble here... and I am so excited to see just whether JB was dealt a good hand or a bad hand.

I think it is more the state wants to lock in what he will say under oath so they can have a formal deposition transcript to use if needed, should he start saying unexpected or contradictory things under JB's questioning.

Ah thank you, yes - that is what I was getting at but I've been misunderstanding how the process is done.

I can't help but think about Jose crying right now? They have to be about half-way through with DC's deposition... I am sure they are going over the video tape (with audio) with DC. They are going over the emails with DC. They have phone records (hopefully that include the bat phones). The dinner at the Ritz.

I don't know how many people listened to the LE interview with DC, but he was lying so bad... you could tell. I just hope that I'm not getting my hopes up too much!

How great to see someone with the same high anxiety level as I have.:great:

I hope I don't have the same :ignore: feeling I did after reading his emails with the psychics!

Hooray, I've been dying to use that smiley! :skip:
