witness Jentzen says there is nothing unusual about Savio's position in the tub, other than she fell.

[ So he is saying she fell backwards and landed in the tub? ]

Not even the position of her feet? Hopefully the jurors will see how ridiculous that sounds.

In Session “The pelvic crest . . . is that the hip bone?” “Yes, the hip bone, on the front portion . . . it’s the bony prominence where there’s an attachment of a number of muscles . . . it’s generally visible on individuals.” “How many bruises did you see on the pelvic crest?” “There was one bruise.” “How do you know it was one bruise?” “It was a bruise accentuated in coloration in areas . . . but when looked at in totality, it was one bruise; it looked like one bruise with a small area of folding in the middle of it.” “Were there three bruises, or only one?” “Only one.” “Can you age this bruise, or other bruises?” “This bruise appeared to be an acute bruise . . . I could call it recent . . . I can’t age it with certainty, but I can say it was anywhere between two minutes to two hours to two days, or possibly even longer. It had a purple appearance, as a recent bruise.” “Can you date it?” “It’s difficult.” “Can you say this bruise is nice and fresh, as Dr. Blum opined?’ “It’s a recent bruise. It could be a couple hours old. Or it could be a couple days.”

In Session The jurors and the witness are now gone. Prosecutor Connor addresses the Court, claiming that “the colors don’t look right” in an exhibit the defense is hoping to use. Judge: “You’re not suggesting that they altered it?” Prosecutor Patton: “No, absolutely not . . . I think it’s a matter of consistency . . . I just don’t want to confuse the jury.” Judge: “They can use their photograph, if they want to do that.”
 
#DrewPeterson defense says they plan to wrap up their case tmw, calling Savio & Drew's son Tom tmw - just 3 days, must be feeling confident...
 
So the jury has to accept that Kathleen was home, studying for exams, and she decides to take a bath. And then, totally sober and healthy, she for some reason, falls backwards and slams her head against the tub, and then falls inside fully, in a fetal position and drowns.
 
This should be too easy for the prosecution. Can any fellow sleuther tell me how she slipped and where she slipped in the tub, according to the defense?

You certainly could not slip in a half full tub, as the weight of all of that water would slow your first step when you got in. Are they saying she slipped while the water was still running, when there was very little water in the tub?

If so, who turned off the faucet? We know KS didn't.

The tub would have had to be full already. And she would have had to slip and fall BACKWARDS, hitting head on side of tub. So how did she end up lying in the tub in that position? And wouldn't there be a lot of water on the floor if she fell with force into a full tub?

And why all of the bruises if there was water in the tub?

Poured juice and heated her water for tea, went in for a bath and did not turn on the light. Okay. That makes sense.

Plus if she did not block her fall and fell on her left side she would have hit water so how did she get bruised that badly on her left side. If the tub were dry I might buy it but it was suppose to be full of water?????? jmo

In Session “Did you notice a pattern of injuries to Ms. Savio?” “I did . . . Ms. Savio was lying in the bathtub on a left lateral position . . . she was lying on her left side, with a one-inch laceration on the left back section of her scalp.” “Most of her injuries were to the left side of her body?” “Correct . . . the injury patterns I saw on Katherine [sic] Savio were on the left side, over bony prominences . . . these injuries are classic for an individual who falls. When people fall, they fall on the corners of their body, their elbows, their chins . . . <snipped by me>

So if all the injuries were like she fell on her left side, does her left elbow have bruising? Even if her arm was stretched out straight when she started to fall, wouldn't it end up bent because of the shape of the tub? Wouldn't that make her elbow hit somewhere and cause a bruise?

From what was posted here, I hope the PT calls the bathtub drowning expert that was on Judge Pirro's show the other week. Someone who can explain it in simple terms and at least cancel out this guy's opinion.

Then how in hades did all the water drain out if it was full? As you said, where is all the splashing of water that certainly would have been outside the tub.

I ask anyone who has a tub to enter it and I'm sure you will see you naturally hold on to the side tile while getting in. Not only that, you enter one leg/foot at a time, thus making it IMPOSSIBLE for her to end up in the position she was in.
 
And........having injuries on her left side consistent with a fall doesn't explain the injuries above her breasts, does it?

Yeah. And the woman who was so fearful of DP that she put a deadbolt on her bedroom door didn't bother to lock that one OR the deadbolt on the front door of her house first. Uh huh. Sure.

The jurors and the witness return to the courtroom. &#8220;When she struck the back of the tub with her head, did her head bounce off?&#8221; &#8220;Yes, I believe it did.&#8221; The witness is asked about the bruise to Savio&#8217;s left breast. &#8220;In my opinion, it&#8217;s a recent bruise . . . it could be a matter of hours to a matter of days old.&#8221; &#8220;Can you date it with any more specificity?&#8221; &#8220;No.&#8221; &#8220;Can you rely on Dr. Mitchell&#8217;s autopsy?&#8221; &#8220;Yes, it&#8217;s a common practice.&#8221; &#8220;Do you believe that Dr. Mitchell performed a sound, competent autopsy on the body of Ms. Savio?&#8221; &#8220;Yes . . . sufficient so that I could render an opinion.&#8221;

Would he say the same of the autopsies that disagree?

I wish the PT could just ask each witness "do you believe DP killed Kathleen?" I bet there would be waaaaaaaaaaay more yes's than no's.
 
witness: bruises Savio sustained on her clavicle are symetrical, which is indicative of a fall not "an assaultive injury."

[ sorry, but that is not always correct...]
 
expert witness Jentzen says Savio's clavical bruises are too evenly distributed to have been the result of an attack, assault
