In Session Prosecutor Connor begins his cross. “You’ve previously testified in this case that it’s possible this case was a homicide?” “That’s correct . . . basically, anything is possible.”

Defense points out symmetrical bruises on Savio's shins Pathologist calls them "insignificant..characteristic of daily living" [ yea, right]

On cross: Jentzen: "It's possible" Savio's death is a homicide. "Anything is possible."

I am one who is of the opinion that KS was drowned in the toilet. IMO, that would explain the bruises on her clavicles, Drew holding her down hard against the toilet to keep her face in the water. Further, if she somehow raised up a bit and he slammed or even pushed her back into the toilet, that could explain the bruising to her diaphragm. Even some breast bruises could have come from there. jmo.

If KS was dead, and was dead weight, and DP picked her up around the waist area to dump her body in the tub, he could have bruised her diaphragm that way too.

I have done a-plenty throwing up (from illness) in the past several years and while I am not going to go back to my toilet to try this theory out, I am 100% sure where those areas on KS would coincide with areas on me where I have spent a considerable amount of time throwing up and my clavicles did make contact with the toilet rim, grose that it is, it's true.

Also, for the past 12 years I have had balance issues, I have 2 bad knees from avascular necrosis, and I have NEVER fallen in my tub.

DT is asking sensible people to abandon their common sense and believe a fairy tale about slipping, falling, landing as she did, is so ridiculous I don't see how DT can suggest these things with a straight face.

If it wasn't so tragic, I might be :floorlaugh:.

Missed all of yesterday and the morning session today.

did I miss anything BIG except for the Letter from Kathy read by the Judge and Mary NOT helping the defense at all, and this Doctor who states she fell and drowned even though she would have to fall from the ceiling, lol.

Anything else?

1. LE Officer Sud admitted he left Kathleens house to go to the neighbors for about 15min. opening up time for Drew to plant the towel.
2. The insurance adjuster testified that Drew did get the million dollar insurance payment because he was guardian to the children. And that Drew pursued getting it a few days after Kathleens death.
3. And someone testified Drew said his life would be easier if Kathleen were dead.
All this from the Defense Teams witnesses!

In Session The witness is asked about a demonstrative. “In this demonstrative, this individual’s legs are not enclosed in any sort of conical bathtub?” “Correct.” “So this bears absolutely no relation to the bathroom Kathleen Savio was found in?” “No, it’s just a person falling.” “So it has absolutely no relation to this case?” “I think it shows an individual who’s falling.” “On a flat surface, with nothing around them?” “Yes.”

In Session The sidebar ends, and the jury is excused from the courtroom. Attorney Greenberg makes an objection about the State’s use of the word “testify,” in regard to Dr. Bryan Mitchell’s testimony. Since Dr. Mitchell only testified at the grand jury, and was never subject to cross-examination in this case, Greenberg insists that it’s leaving the wrong impression with this jury. “It’s improper . . . and you previously cautioned the State not to do it.” Prosecutor Connor responds, claims that Dr. Jentzen testified on direct examination that he reviewed the trial testimony of Dr. Mitchell. “Here’s the problem: there was no trial testimony of Dr. Mitchell. He has actually relied on Dr. Mitchell’s grand jury testimony.”

In Session Judge Burmila takes a moment to look through his notes. “Where did he [Dr. Jentzen] say that he reviewed Dr. Mitchell’s trial testimony?” Connor: “Right at the beginning.” Judge: “You believe he mentioned Dr. Mitchell?” Connor: “I believe I heard him mention the word ‘Mitchell,’ Your Honor. Obviously, if I’m wrong, I heartily apologize.”

In Session The judge decides to take a brief recess at this point, so that he can review the record from this morning’s court reporter (who is not the same person who’s in the courtroom this afternoon). He leaves the bench.

That 'slip and fall' picture they showed the jury makes NO SENSE. She HAD to be inside the tub when she fell for her to end up positioned in the tub as she was. So how do you fall while standing in a tub of bathwater, and have your legs and feet go up in the air like that?
