Didnt Baez and company ask for a mistrial three or four times in the early days of the trial?
This is moving very differently than the C.Anthony trial, IMO. From just the news reports throughout the day, from Beth Karas, the Prosecution is not doing well here at all. They're ticking off this judge bigtime, and I hope you're all wrong about this judge already being bias. It does sound like the prosecution is not allowed to get anything in, and with so much "hear-say" as this case seems to be, he could get off. I hope not~
I'm hoping this day was a blessing in disguise. That the prosecution will tread more carefully, wisely and tactfully so they can win this thing!

I wondered about that too. Good thoughts on why the defense would even mention she had sex that weekend. I honestly could not see a point or purpose of mentioning such, until your post.

they just want to drag her name through the mud. Just like DP is saying that Stacey just up and left her kids for another Man never to look back. A Man might think that's possible but the majority of Mothers know that is not something any decent Mother would do. Stacey appeared to be a good loving Mother. How sad her kids were robbed of their Mom. DP is such a selfish ***hole only thinking about himself and nothing for his kids. He is a physcopath and I have to believe they will find him quilty or I will go crazy.

Want to thank everyone for keeping us posted. I'm selfishly happy I am at work and cannot follow minute to minute, just reading every now and again makes my blood boil. I know it is doing the same to all of you, sorry.

I have a question. Why is the prosecution throwing the case?! Are they buds with DP?

it does almost look like the pros is throwing the case, doesn't it???

I guess the Lifetime channel's made up their minds!

This prior bad act involved the victim of the case, so I'm having the same problem understanding as you are. Events that happened toward the end of the marriage would be relevant I would think because they all led to the final outcome - murder.

I still have pages and pages to catch up. Your comment wasn't stupid, the prosecution forgetting to disclose it to the defense was, imo. That is an enormous mistake on the prosecution and time will tell if they can overcome it. I'm hopeful they can because the blood description that I have read, doesn't match up with what I would expect from a head wound and the bruising may be defense wounds from Drew, not from having sex as the defense seems to be hoping to imply.

So, the judge lost an election to the current DA? Is that correct? Why in the heck is this judge presiding over this case?

Trials can also be won or lost in the various motions that are argued long before the trial ever begins. If the judge has ruled against the state on several key items in the past (again, before the trial ever got started), the state will be behind the proverbial 8-ball.

It's important to understand past motions and what was allowed in versus what was not. Before saying the state is blowing it, determine how prior motions went and to what extent their hands are tied before setting foot in the courtroom Day 1.

Just adding my feelings of disappointment and dismay to others here over the way this case is unfolding.

When this case first began, with the disappearance of Stacy Peterson, I had high hopes that Stacy's remains would be found and DP arrested and tried for her death.

During those first few months, I based my hope on the fact that DP had gotten away with Kathleen's murder and had grown sloppy, never even once thinking that Stacy's disappearance would garner the national media. Cassandra going to the state police to report Stacy's disappearance in the wee hours of the morning on October 29, 2007, didn't leave DP a lot of time to dispose of Stacy's body, and here again, I hoped that caused DP to be sloppy.

I have always believed that LE made a huge mistake in not following DP when he went off on his motorcycle for a three-day trip to "clear his head." I believe those three days were crucial to the permanent disposal of Stacy's remains. I don't think her remains will ever be found.

This puts a lot of pressure on this case, the murder of Kathleen Savio, with the hope of a conviction and justice for not only Kathleen, but for Stacy and any other victims. And I do feel there are other victims.

Over the past years we've learned about other strange deaths and disappearances. One that I find intriguing is the young man who was found hanging in his garage. The young man's sister, Monica, a teenager was a girlfriend of DP's during his first or second marriage. DP was sneaking her into the house. The young man confronted DP and told him to stay away from his sister. DP found him hanging in the garage. No suicide note, and the young man's family and friends said there were no signs of depression or anxiety. I think this may have been DP's first victim.

I have no doubt whatsoever that if DP is allowed to go free through a mistrial or acquittal, he will kill again. He will think he's truly untouchable.

Those who have testified against DP or have spoken out against him will be harassed. One ex-girlfriend, Kyle Piry, has said in interviews that after she broke off with DP he harassed her with parking or speeding tickets.

Many would have to watch their backs. At the top of the list is Sharon Bychowski, members of Stacy's family, members of Kathleen's family, and those who testify against him in this trial. :(

The hinky parts so far (to me):

1. Drew insisting on getting a locksmith. If you think there's something wrong/an emergency, you'd want to get in stat, which would mean breaking down the door.

2. Drew staying in the foyer and letting the 2 neighbors go upstairs to look for Kathleen. That just seems so obvious. He wanted/needed other people to find KS in the tub.

3. The state of the bathroom, the tub, no water, etc, etc.

4. Drew saying right away to someone that people would think he has something to do with KS's death. If you're innocent, why would your mind even go *there?* You'd be thinking drowning, not homicide!

I swear some of these guilty husbands are the ones who shine the red light of suspicion on themselves right from the get-go. They make comments and do things that normal innocent people just wouldn't!


Still catching up. I agree. Let's hope these points haven't gone unnoticed by the jury.

Asking for a mistrial is very commonly done in just about every case I have ever seen. If they do not ask for a mistrial on a certain issue they cant bring it up on appeal. It is to get it on the record.

Having said that. I have been very worried since Opening Statements yesterday. I totally believe DP is 100% guilty but I am not sure the state has a strong case. I hope I am wrong but they sure are starting out on the wrong foot and the foot has landed right in their own mouths.

I dont think the Judge is biased. Whether most people in America hate DP with a purple passion the Judge must see to it that he gets a fair trial so the case wont be dumped in his lap again due to DP winning his appeal if convicted. I think the state has already given the DT two issues for an appeal if he is convicted and we are only on day two. The last thing a Judge wants is for this to be retried again due to his error.

The issue today is very serious and this time the DT had a valid agrument. I am a stickler for fairness from both sides when it comes to a court of law. The prosecutor's answer to the Judge about the screw up today was nonsense and the Judge knew it.

I have been a juror several times and on a couple of cases we had the Judge strike the entire testimony of a witness. We knew we could not use that testimony when we came to our verdict and we didnt. But as I was sitting there both times it happened I felt the witness had lied on the stand for the Judge to take such drastic measures. It is never a good thing when the state, who is supposed to be the honest guy in the white hat, has the entire testimony stricken of one of its witnesses. If it happens again, and nothing about this trial will surprise me... the jurors will begin to lose faith in the prosecutors.

I dont want the state to screw this case up but as of now they are looking very inept. I hope that they can get it together and stick to the Judge's rulings whether they agree with them or not. If another incident happens then I do think he will really consider a mistrial and it could be without predjudice God forbid.:( Where will that leave Kathy and her family? With justice denied because of the missteps made by the state who has had a long time to prepare for this case.

The defense has lost no opportunity to drag Kathleen through the mud and paint her as a witch. If Kathleen's death was really accidental, and DP had nothing to do with it, there would be no reason to go after her like this. The defense wants the jury to dislike Kathleen. They want to make sure no one on that jury feels any sympathy for her.

I'm sorry, but to hear DP was stunned is funny. The pompous arrogant :censored: needs something to shake him up.

Still catching up, but I don't think the jury is stupid. I hope they don't declare a mistrial. Residents of Bolingbrook should/would know there are area's in BB that are very bad. I've been in some, when I sold real estate, where cops literally drove through older subdivisions and told residents to keep the doors and windows closed and locked - in warm weather. I don't know how close DP's homes were to these older bad subdivisions.

Just because a bullet was found in a driveway, doesn't automatically mean it came from DP and I think the jury would know that.......

If the defense is asking for a mistrial at THIS point, that tells me they are NOT confident about their case, the judge, the jury, or any of it.

A witness mentioning a bullet outside on a driveway is easily impeached upon x-exam by the defense.

Courtroom tactics often resemble a poker game. Lots of bluffing. The defense just tipped their hand--this is the 2nd time in 2 days they have brought up the word mistrial.

Where there's smoke...

We need to ask ourselves, why does the defense want this particular trial to end right now?

ITA. Wow how wild would it be if there was a larger force at work here, one of police and elected officials involved in some serious wrongdoing. IMO if there was rotten-ness in the police dept, Drew would have been in the thick of it. Now maybe, a huge cover-up that necessitates DP being set free to save the higher-ups and the police dept. Just a thought- JMO- but shew-weeee!

Im not sure I think that is going on. Now the Judge may think the state doesnt have the evidence to prove guilt. He pretty much knows the evidence in the case since he has to make rulings beforehand.

When Kathleen died the local LE called in the State Police.

I've had the same thoughts.

I've been in the Illinois court system (we own a lumber company and had to sue to try to get paid by someone--NOT a good experience and we had NO luck). Anyway, we hit brick walls every where and this was just a civil suit! :banghead:
