I think the judge should just declare DP innocent and get it over with. He seems mesmerized by the defense and the defendant. Man crush.

I'm sure they will pursue the mistrial tomorrow. It appears that the defense is really gunning for a mistrial. They want to prolong this case big time (but I also haven't been following super closely to this trial until now). And this judge seems to be inclined to only offer the two remedies.

Let's hope and pray that the judge isn't inclined to grant a mistrial WITH prejudice. But you never know maybe if he's pro defense he will.

Haven't heard much about this Judge is he generally a pro defense?

It is very odd that ABC is saying that the motion was denied, but on HLN they are saying that the defense needs time to think it over on how they want to proceed. Court to reconvene tomorrow. ABC has some explaining to do.

I hope the defense do pursue a mistrial, because I think that would be favourable to the prosecution. The pros don't seem to have their act together at all, a bit more time might benefit them.

RE: Jean C's 'what else can the jury think.....' bit explaining what the Judge meant: Isn't that how trials go? The PT presents their witnesses and testimony and the DT gets up to argue the other side with their cross exam and then the reverse happens when the DT presents their case?

If I'm on the jury, I'm wondering what this witness has to say that has the defense not just objecting but asking for a mistrial.

Maybe they are both right. Maybe the motion was denied but the defense wants more time about how to remedy the testimony to their satisfaction.

See you all later. I hope tomorrow will be better than today. This trial is jerking my emotions around too much. I don't want to be angry all of the time and I cannot help it with this one.

They won't have a next time if the judge grants the mistrial with prejudice. It means the prosecution can't ever prosecute him for this crime again. Then again the judge could grant it without prejudice and the state would have the option to retry him.

ABC's reporting seems to be very sloppy. The Mistrial request hasn't been denied, it is on hold, and it wasn't Kathleen's driveway that the bullet was found in, it was the neighbor's. Sheesh.


Somebody totally got it wrong. Better get more beer.

What does the defense have to consider, if the judge has not made a decision yet?

Oh get this, the judge said very politely to the defense [ paraphrasing]-- ' why not take some time to consider what you would like as a remedy in this matter.'

I don't think the judge is going to take it that far. I believe the defense will want the entire testimony thrown out, but the judge will have some of the testimony stricken from the record and tell the jury to disregard.

This is not going to end good. The pros are acting like law-school rejects. I cannot believe this.

I guess this judge, no matter how old the suspect is or how young the victims are, is lenient on the perp if they have no priors as in this case that Burmila ruled on last year ~

Imagine how he feels when a suspect is former LE!

Imagine how he will feel when the perp in that case from last year gets off probation and reoffends. Oh, wait...this *prior bad act* will not be allowed to be used against him.

Sorry to be so sarcastic lately. I am just pretty fed up with our judicial system as it is. With all the courtesies extended to the perpetrators these days, they rarely pay for what they do. And with that, they continue to do!

Everyone find ways to take care of yourselves and stay safe because our courts are not likely to hear your voice should you or yours become crime victims.
