Drew Peterson's Trial *FOURTH WEEK*

I believe it's normal in a trial to do this. Defense will ask the judge for DP to be freed because the State was not able to prove it's case due to lack of evidence. jmo

It is totally normal and every defense attorney does so automatically. But in this case, there is a higher probability because this judge has made several comments indicating that the state has not met it's burden of proof.

He said two things today. One, was something about the state ' not placing the defendant at the scene of the crime..' And the other was about them not having any evidence of staging of the crime scene...

And the way he berates and discredits the state attorneys makes me believe this judge would LOVE to rule that they failed.
 
I can't wait to hear what Judge Jeanine Pirro has to say about all of this on her show Saturday night. She was already furious this morning, so she will be foaming at the mouth on her show this weekend.

The Honorable Judge Burmila needs to catch her show.
 
I have just left the screen up and been awol most of the day. You know when your neighbor comes over and rings the doorbell holding one of her famous chocolate pies you will let her in and treat her like royalty!


I think Kathleen's letter should be allowed in without any portion being redacted. That would be too good to be true, though. So much has been kept from this jury that if they do find DP not guilty, they will after the fact be pissed off about the information that didn't make it in. <snipped>

If I knew how to tweet I would be tweeting J Ruby right now and suggesting he do an entire one page of the paper again outling to the jurors what they did not see etc. Kinda wish there was someone after the FCA trial i Florida that had the b%%s and money to have done that AFTER the mury got home as I want the jurors to see it all in the paper!

Sue Doman: She had a laceration on her head. She became dazed. She had black and blue marks all over her.

Are we sure this is the article going to the jurors? I sure hope so.
 
The Defense will immediately ask for the judge to rule on a motion set forth.

The DT will say that the state did NOT prove their case, did not prove there was a murder, nor that their client was ever at the scene of the 'non-murder' and that lack of evidence and total lack of forensics, requires the judge to ' direct a verdict' of case dismissed for lack of evidence. :eek:


eta: A "motion for a directed verdict" asks the court to rule that the plaintiff or prosecutor has not proven the case, and ...

Seriously; WTH????

I'm thinking that with DT putting Harry Smith on 1st to get their proof of KS what ever they're saying she lied about, the PT under cross can bring in the issues so critical that the judge has ruled admissable, namely, the letter?! Also, I've been trying to remember the actual evidence that's been heard; that she feared him & believed he might kill her. That was from her sister, did she indeed get to say all that? Then the magic towell, that he had broken in & sneeked up on her all dressed in black & made threats before, the differing coroner's findings, the interview with SP being so bazzar, these are things presented, in piecemeal! that are not hearsay. Ya'll can jump in here!! But I'm believing that all of these alone wouldn't allow ANY REAL or LEGITIMATE judge to find that there's not enough evidence to continue with this trial. At least that's what I'm praying for with the added bonus of keeping my fingers crossed!!!

I hope it is. But I am not sure. Because they said 'an interview'---and this a is an interview, but has a lot of extra opinions thrown in.

I wonder if there are more straight interviews out there. Maybe it was a video from a NBC show and they are just going to show the transcript. Wasnt he on Dateline?

IMHO in almost all capital cases this is standard to do, no matter the evidence that had been supplied by the prosaecution so that it on record in case of appeal and to preserve on record. They would be remiss if they did not ask for IMHO,

Maybe they are going to just give the transcript from his interview with her on GMA.

I hope so because it is perfect for the jury to read.
