All those motions are for the defense, correct? Can any of those cause yet more delays with the trial date? I certainly hope not but I know nothing about court proceedings & had to ask. This has been going on for far too long:mad: MOO

On my notes I have that more than 400 motions were filed. More than 1/2 came from his public defender. See my post on 1/10 & on 10/25/18 in the notes it says what some of the motions are.

I've been watching the super long-awaited Mcstay family murder trial right now, but I'm almost more excited for this trial. Let's hope that it's recorded or live-streamed.

Trial for Mark Redwine postponed until mid-2019

Lawyers spent dozens of hours this week in 6th Judicial District Court arguing about how law enforcement obtained evidence and what pieces of that evidence should be permitted at trial. Defense lawyers made a case in closed court Friday for why they think the trial should be moved to a different judicial district, likely arguing that significant media coverage and other factors make it impossible for their client to receive a fair trial in La Plata County. Lawyers can request what is called a “change of venue” if they believe a jury pool may be negatively influenced by pretrial publicity.

The evidence in dispute includes statements Redwine made to law enforcement; the findings of a cadaver dog trained to sniff human remains; and media coverage that included local, state, national and international stories about Dylan’s disappearance and murder, including a two-part episode on “Dr. Phil,” among other issues.

Wilson said he would rule at a later date whether jurors will be allowed to watch the “Dr. Phil” shows, in which Redwine, his ex-wife, Elaine Hatfield Hall, and their son, Cory Redwine, appeared on the show.

These delays do not set well with me. I guess I really do not understand "Courts" or "the Court" system as a whole. I cane to the conclusion (due to a friends recent dealing with the domestic courts) that the court system is a "business" and whether there is any justice to be served is not relevant as long as the courts make their money.

OTOH I want all the I's dotted and the "T's crossed correctly so that Mr. Redwine trial is as fair as it can be. If he is convicted I want the whole system to support the Criminal Ruling and his case does not drag on forever!!

I feel certain that the trial will have to be moved in order to ensure an impartial jury. That will be another delay, but nothing that we can't endure so that justice is finally done. (IMO)

Although the State of Colorado allows "Expanded Media Coverage" (EMC) otherwise known as still, video, and audio coverage, Colorado criminal courts essentially permit only Advisements and Arraignments eligible for video/audio coverage consideration by the Court.

However, if the court believes that 1) there's a reasonable likelihood that EMC would interfere with the rights of the parties to a fair trial; 2) whether there's a reasonable likelihood that EMC would unduly detract from the solemnity, decorum, and dignity of the Court; or 3) whether EMC would create adverse effects that would be greater than those caused by traditional media coverage, then the Court may also object a motion for EMC for an Advisement or Arraignment.

Two high profile Colorado criminal cases recently in the news are the Chris Watts and missing Kelsey Berreth (presumed dead and murdered by Patrick Frazee) are good examples of trial coverage by twitter because EMC was not allowed for the preliminary hearing, or status hearing.

ETA: The Aurora Theater shooter James Holmes trial was NOT live streamed. The Judge allowed only a close circuit tv in the courtroom after Supreme Court ruled in favor of limited televised coverage. This exception has mislead many here to believe that all Colorado cases will be streamed and/or have video and audio coverage.

Thanks for that! I was actually thinking of the Holmes trial when I was reading this post. I hope the judge allows it as per your last paragraph. It doesn't have to be live streamed but recorded and uploaded to their YouTube channel like the Holmes trial would be nice. Let's hope the judge allows.

I can not believe Elaine is still waiting for justice.

It’s ironic that Mark even from a jail cell is winning as this is exactly what he wanted when he killed Dylan to make her pay and to ruin her life.

It’s hard to imagine that Dylan would now be 20 if his father hadn’t cut his life short.

Hopefully it's not as long of a wait as the McStay trial. The way that he pulled his BS narcissistic stall tactics from his jail cell hoping to create reasonable doubt was utterly disgusting.

Praying justice delayed is not justice denied. At least he gave the prosecutors plenty to work with, even if only 25% of it is admitted, it's pretty clear what a low-life vindictive man he is. Plus the actual evidence that Dylan did not just up and walk away. Rot in jail, MR!
