Elizabeth Johnson Trial - Day 2 - 1st Day of Testimony, Monday, Sept 24

Logan was relying on LE to obtain records (some) . . . he has not re-listened to recordings or re-read texts just before court . . . relying on Atty's . . . . Logan's Dad thought Jack's name was Rich . . . Logan thought it was Jacky . . . CPS may have given info about the Smith's . . . . when he couldn't find EJ @ the trailer . . Logan's Dad and he looked up phone numbers on computer . . . found their numbers for their work . . .Logan got TPS number and called her . . . first talked to TPS . . . first impression thought she was a pretty nice lady - had a normal conversation . . . had no thought Gabriel was with the Smiths @ that time . . . . 12/25/09 Xmas day returned to the trailer . . . talked to EJ . . . had computer and a Wii in the trailer and if EJ looked up anywhere to go . . . Malcolm Phillips - roommate @ trailer would not allow Logan in to take his items . . . EJ had moved in a roommate just shortly before . . . Emergency custody order (12/21) and 12/27/09 (not including the 27th) . . . got something on Myspace and Logan sent something back . . . Logan attempted to record phone calls with EJ and TPS with digital recorder via suction cup microphone . . . .not every call recorded . . . didn't know how to save all conversations . . . . every conversation with EJ and TPS recorded . . . . @gma's house . . . just left her house - 10 min away . . . EJ texted "I killed him" Logan tried calling over and over . . . EJ didn't call back . . . .text message after that from EJ . . . they talked - she hung up . . .

Logan called her after text message . . . . looking @ trailer knewshe was gone . . . he had a phone number for EJ from Jack & TPS . . . . he trusted them and didn't attempt to call her . . . . they said let us take the wheel - we are friends and talk to her to convince her to come back . . .both Jack and TPS asked him not to call EJ.

Logan got ahold of EJ . . . kept asking where she was over and over . . . ask where she was @ . . . she said "yes you made me kill my baby boy . . . I kept saying no you didn't and she said I suffocated him until he turned blue, put him in diaper bag and put him in the dumpster . . . he had pulled over to side of road while talking to EJ. . . . his phone was dying . . . .I said I have to go . . she said why are you going to tell your DAd or LE? he said I have to go . . .he turned off his phone . . . went to his Gma's house told family what was happening . . . went to Mesa LE office . . . Mesa LE turned him away said he lived in Tempe and told Logan he had to go to Tempe LE. His phone was dying that is why he had to get off the phone with EJ . . . he turned around and went back to Gma's house . . . Mesa LE station was right across the road from Gma's house . . . went to Tempe Station . . . showed papers to LE proving he had temp custody . . . turned phone back on to show text messages to show LEO . . . 4 or 5 more texts came in . . . put Logan down , called him a coward ***** . . . Logan waited in waiting room @ police station . . . until late into the night.

Okay, I'm frustrated...Logan has had almost 3 years to nail this stuff down as far as dates and what took place. Why hasn't he!

and I have to say - his manner of speaking does not convey the gravity of the subject. He is testifying now about her statements that she killed Gabriel, and he just has a kind of nonchalance about him. I'm not saying that he isn't sincere or that he doesn't feel devastated. it's just an observation about his demeanor.

Logan opens package and identify's his digital recorder and photosof his cell phone and texts on the phone . . . numerous pages of photos Logan leafs through . . . . id's photos officer took. 12/28/09 . . . the day they were to go back to court for next cusody hearing . Tempe LEO came with or showed up there @ court . . . ordered custody to Logan . . . EJ did not show up @ hearing nor call in . . .duringtime w/officer turned phone off and on . . . doesn't believe received texts from anyone but EJ. Eventually he stopped trusting the Smiths .. . Logan and Jack got in conversation that Logan didn't like . . . the Smiths tried to get him to sign adoption papers . . . if Logan wanted Gabriel safe he was to sign papers over to the Smiths so EJ would return Gabriel to the Smiths - he would be ok. Logan still used recorder when talking with the Smiths . . . after 28th custody hearing he ended all conversations with Smiths . . . Tammy causing more harm than help . . . didn't trust them.

Gabriel was sitting in his stroller watching his Dad build the deck . . . changed diapers, fed him, played with him, took care of him . . . last time saw Gabriel 12/8/09 .

Lunch break from 12-1:30 Jurors be back @ 1:25.

I can understand why he is in a numb mode, mainly because he's having to go thru all this BS when its obvious that tart did something horrible to his child and is able to sit there dolled up like halloween. She makes me ill and so does our justice system often times.

Just a quick note . . . I do not profess to accurately transcribe each and every word . . . I just try to catch most of the conversation and the "gist" of what is being asked and answered. This is mostly for those folks who cannot watch and do not have access to video to see how things went down in court. Please . . . If I got something wrong or it doesn't sound quite right . . . correct me so that others can have the benefit of all of you observing and listening as well. I know alot of people think she gave Gabriel away and thats bad enough but I believe she murdered him and threw him away like trash. IMO she is guilty guilty guilty and shouldn't even have the benefit of a trail. She should be killed by fire or stoned to death.

Well, Texas needs to file charges against her. If they've got Det. Salame's recording that allegedly EJ confessed to killing Gabriel to him, then they need to file murder charges against her. Period.

You bring up a good point artsy . . . since she confessed to murder in Texas . . .it would appear if they could prove more likely than not she did in fact suffocate Gabriel they would be able to file further charges. Texas is not known to be "kind" toward convicted murderers.

I am wondering why Texas never searched the landfill - given they had a reasonable time and date and location of the trash that she confessed to throwing her baby boy into.
