Elizabeth Johnson's Court Hearings & Charges

  • #1,081
Grrr, I am not able to cut and paste... anywho.

I am just trying to figure out these charges. I wasn't looking too much into it before on the off chance thay I would receive a jury summons. No such luck.

How are they going to prove kidnapping? To do that they have to prove that she intended to harm the child. How much evidence of that is going to be allowed? What is the prosecution's strategy going to be?

Trial to begin next week for Elizabeth Johnson, mother of missing 'Baby Gabriel'

By: Mike Sakal, East Valley Tribune

The trial for the Tempe mother of missing ‘Baby Gabriel’ is set to begin in less than a week...

Johnson’s grandfather, Robert Johnson, of Scottsdale, told the Tribune on Monday that he does not plan to attend the trial and still speaks to Elizabeth about twice a week.

“It’s too boring,” Johnson said. “I’ll just watch it on TV. These people aren’t Perry Mason types where it’s all scripted. There’s too much hemming and hawing.”

When Johnson’s grandmother, Sylvia Puckett, was contacted by phone on Monday, she said, “I have nothing to say,” and hung up.

More at link.

I have no words.

Here is more... about custodial interference. Note what it says about child born out of wedlock. If EJ is convicted on only this charge I think she is only looking at time served.

I have a very bad feeling about this. Arizona...please prove me wrong!

Here's the indictment.

It states reasonable apprehension of injury to the child. I guess this must be based on the testimony of her former neglect, and possibly also because IIRC there was a witness who saw the baby in the motel room and remarked on his sick-looking and deplorable appearance. It also states she knowingly placed him in a place where his health could be endangered.

Please tell me the jury will be able to hear the phone convo with Logan where she tells him, she killed Gabriel and the text message she sent him?????

I will be SO upset if this brat does not get convicted.

Is there another recorded (documented) phone conversation with TS, EJ stating she didn't kill the baby but was only telling Logan that to mess with his head? Or was that just TS' testimony? I don't remember.

Mike Sakal's article has been revised to include a quote from EJ's attorney Marc Victor:

...“I, the judge and the prosecution are all working together,” Victor said. “We’re all doing everything we can to ensure she gets a fair trial and that all the evidence is presented. The elements we are focusing on are the remaining charges against her.”...

Well. Sounds like a real kumbaya moment. I wonder how Elizabeth feels about all this togetherness. She despises the prosecutors and has complete contempt for the judge.

more from Sakal's article:

...Johnson then hopped a bus to Florida to meet her grandmother who was moving from Boston to Florida after buying a home in the Tampa area, according to court documents...

bbm

JMHO, but I don't believe grandma intended to or did move to Tampa. Florida, yes , Tampa, no. And what to make of this meet-up plan? Here's what grandma said on 1/1/2010 (part 1 released report):

..." Mrs. Puckett said she had not heard from Elizabeth in a long time, probably since the court date after the September arrest when she damaged the apartment she and Logan lived in." ...

Not even a phone call at Christmas! So how was this all arranged?

Victor said that the whereabouts of Baby Gabriel will not be addressed at the trial. “The status of the baby will not be a question that is answered,” Victor said. “That is not an issue at this trial.

Sounds like they are fighting to keep it all out. How on earth are thwy possibly going to keep that door closed? Oh, and by the way... where is the child now? You think that won't come up?

the only ones I know of are the phone call she made to Logan and the text that she sent him; both said that she killed Gabriel and put him in a dumpster.

I'm thinking there is, But I'm not sure.

I know there was at least a text to Tammi, something about "me and Gabe are fine...."

I have been waiting for this trial all summer.

I have doubts that the defendant will make it
through the entire trial.

I am sure she will not want to come to court on days.
She has a habbit of that doesn't she.
It will be interesting.
I bet Tammi will be in front of the T.V. with popcorn!

Do we know if the trial will be streamed online like TS's was? I hope so.

As for TS... it would NOT surprise me ONE BIT if she showed up as a spectator in court. EJ is about to take away her 15 minutes of fame, nd TS will not like that.

Wasn't it in the Judge's order that TS have nothing to do with anybody who was involved in this situation? I know it inferred Logan, but I am trying to remember if it could also apply to EJ.

Good thinking. IIRC, the order only applied to Logan but I'll bet her attorneys tell her to stay away. I was wondering who might show up to support Elizabeth.

Her attorneys can say mass, I bet you she will do something stupid. She can't help herself.

As for supporting EJ, I doubt anyone will show up. In a way I feel ****** for her. NO, I am not an EJ supporter and I think she should tell us all where Gabe is; but can't help but feel sad for someone so young and so angry at the world.

I think she is not allowed to have anything to do with anyone involved.
You might see her or Jack do another interview,on how the case is going
I agree with the post before she cannot help herself!
Or maybe that will be in the book she is writing! hmmmm.......
