Emergency Hearing re: remains-UPDATE MOTION DENIED

  • #241
ORLANDO, Fla. – A judge has denied a defense attorney's motion to inspect a child's remains found near the home of a missing 3-year-old central Florida girl.
The motion, filed by Jose Baez, was denied Friday. He represents the girl's mother, 22-year-old Casey Anthony, who is charged with first-degree murder in the disappearance of Caylee Anthony.
Orange County Sheriff Kevin Beary says a medical examiner found evidence among the remains link them to the missing girl's home, but officials would not immediately give further information.
The remains were found Thursday by a utility worker on a wooded lot less than a half-mile from the house where Caylee lived with her grandparents and her mother.

If you have TruTV, they are about to air this proceeding now, on tape with Beth Karas and others.

I can't believe there was hair - my heart aches.

Correct me if I'm wrong, but I always thought hair and nails were already dead and didn't decompose at the same rate as everything else does on a body? Is that an old wives tale?

Just posted on the other thread, TruTV is airing the hearing on tape right now, with Beth Karas and others.

I haven't even gotten to the last page of this thread -b/c it's so slow - but - it's very possible KC put the tape on Caylee's mouth AFTER she was dead to make it look like she was in fact kidnapped. Not that it makes things any better.:behindbar

In the end, it doesn't matter if it is before or after, in one sense. It speaks to premeditation. If it is before, then it surely increases the horror and cold-bloodedness of the crime.

I don't know what it is, but Baden, Baez and the KFN lady all give me a feeling that they "belong" together. They all give me a "yucky" feeling. I think we can officially call the defense "The Scheme Team".

That seems highly appropriate, currently they're scheming that a Caylee look a like was dumped down the street from her gparents home and what a sad day it is for some other family.

The scheme team and KC so deserve each other.

You know he was pushing really hard to go to some other child's post mortem. Sort of like an ambulance chaser, trying to drum up business.

To quote Linda herself "we don't believe this is the child" ... so why file their ridiculous motion today??? They talk out of both sides of their mouths. Here's Baez & Lindas presser following the ruling this morning...

I'm wondering if servers don't have a lot to do with it. I can't get anywhere with AOL, but I've been getting on here and posting just fine these past 2 days w/Safari, so try a different server if you're having problems.

AOL has gotten so slow lately that it is ridiculous.

I am glad Judge Strickland ruled as he did. There has been no official identification as of yet. I believe it is Caylee, but there has been no formal announcement.
I think that Baez' motion was stupid and ridiculous.

Judge S continues to follow the law and procedure, so the motion was appropriately denied. I'm pleased, as pleased as the Cheshire Cat.

felt at times like she was tyring to drop names...everytime she mentioned who she was bringing in--she would mention how well known they are....
Guess that means no grounds for appeal based on incompetent counsel, since everyone except Jose is so 'famous'...

I don't know about Florida, but in my state the "incompetent" attorney only applies to a state appointed attorney, never a self chosen one.

The assumption is if you hire an attorney, and they are not capable, it is your problem, not the court's problem. Just like representing yourself in court is allowed, but you can't get an appeal because you screwed up.

In California, I believe incompetent counsel is grounds for a new trial and as far as I know that pertains whether it is someone you have hired or been appointed. John Q is not expected to be well enough informed of legal proceedings to be able to judge incompetency, therefore shouldn't be responsible for the results.

In the back of my mind I recall a judge warning a defendant that his counsel may not be best suited for the case and should the defendant chose not to seek new representation the judge was not going to allow a new trial on this basis.

There is no way this kidnapping story will fly. I can't imagine one juror that would think it's normal to party and play hausfrau when the daughter was just kidnapped - it makes no sense. I too was thinking maybe Casey was going to get off or be found guilty of lessor charges because she did such a good job of hiding the body, but what a dumba$$ to put it right behind your house! No, no my friends, she is toast.

She maybe a dumba$$ but that hidey-hole worked for 6 mos, and her phone pings had thousands of people all over town wasting thousands of man hours. If fate hadn't intervened in the form of a meter reader needing to take a whiz, no telling when she would have surfaced.

This just seems like such a disgusting violation of the baby's rights and the baby's parents' rights, not knowing yet for sure via DNA if it's Caylee.

It even seems to me like a violation of human decency if it is Caylee. She's not an insect to be observed under a microscope. She's a human being. She's been treated, literally, like garbage. She needs all stops pulled out to give her the utmost in dignity and respect.

MOO

I'd also like to confess that I have a wild crush on Yuri.

Me too!

It would infuriate me to live in FL right now. Although I know here in MD I'm paying for someone else's coleslaw and dream team..at least I don't know who they are and what they have done LOL.

I wonder how eager they would be to volunteer if it was the middle of summer in FL? Just wondering? Where I am...FL sounds pretty great!

Play advisor to baez...get some sun, some TV time, interviews, some future payment? Books? Sitting around the hotel pool wondering who will play them in movie?

I need to quit...my sarcasm gets WAY out of hand when I watch these scavengers circling because they want "fair justice" for KC...now where are all those barf bags you guys were talking about? :)
