Interesting also that they complain about Greer making statements on Twitter. Seems the defense is very attuned to the idea of using SM / internet public forums to sway public opinion on a case. Hmmm...wonder where we've seen that before?

Greer will inevitably file a response to this #555. In regards to the complaints from AS about Greer using Twitter (which he's tweeted about this case a total of about 3-4 times, lol!), I hope he points out all the times one certain defendant, DS, has "reached out" to the media to make her points. (Until, IMO, "someone" finally got to DS and told her to be quiet and not solicit interviews from the media anymore-- that it was harming her case.)

In comparison, the plaintiffs have been completely out of the media since mid 2013-- the Dr. Phil show was about the last time they appeared in public talking about the case.

Yes, there was a lot of coverage of this case in 2011 and 2012-13, but very, very little coverage of any type since then.

Really, in the past 3-4 years, you can count on one hand how many times a year this case has been mentioned at all by the media. So cry me a river that Greer tweeted a few times-- GMAB!

I had a thought. Maybe the Zahau plaintiffs did indeed "turn down millions", but the millions offered were not officially a "settlement" offer from one or more of the defendants.

For example, it's possible someone other than a defendant offered the Zahau plaintiffs "millions" to drop/ withdraw their lawsuit. Someone quite wealthy, with an intense interest in concluding this whole messy thing. Hmmmm......someone who might be willing to throw a lot of $$ at a problem to make it go away. Speculation.

Perhaps Greer was simply letting that "slip" in the interview, that money was offered to the plaintiffs to drop the suit. If AS wasn't the source of the so called "settlement" offer, then he and his attorneys have a legitimate foundation on which to act all "aggrieved", and accuse Greer of being a liar. Verbal gymnastics.

I think the plaintiffs were offered "millions", but it was not an official "settlement offer."

That's my take on the settlement revelation in SD ROA document 555, reading between the lines.

I agree with KZ. Zahaus were likely offered moneys to drop the lawsuit but without stipulation of guilt. I think the profferer was Jonah.

I'm curious what Nina Romano's role is in all this. Why was she dropped as defendant from WDS? Seems she likely turned witness for the plaintiffs...

Here is the introduction from #560, from Plaintiff's attorney:

In their complaint, the heirs and estate of Rebecca Zahau ("Ms. Zahau" and collectively
"Plaintiffs") allege that the Defendants conspired to, and did, murder Ms. Zahau. The heirs reside
in Missouri and thus did not witness any of the events leading to Ms. Zahau's death. Moreover,
since the only witnesses of the actual crime are the decedent and the person(s) who killed her, this
is case of circumstantial evidence.
Fortunately, both the Coronado Police Department and the San Diego Sheriffs
Department investigated the incident, and collected evidence reflecting all the events of the
evening that Ms. Zahau was killed, i.e., the knives, the rope, the gag in her mouth, debris in the
area where the murder occurred, etc. In conducting their investigation, the police identified
everything they thought was relevant to determining whether this was a murder or a suicide,
collected the evidence, photographed it, performed tests and interviewed witnesses they felt were
relevant to the investigation. Reports were written of the investigation and the officers' findings,
and the San Diego Medical Examiner performed an autopsy and issued a report. This material
comprises the "police investigative files," that all parties have copies of. This evidence is
further supported by the testimony from "investigating officers" and personnel at the Medical
Examiner's Office, that all parties have.
Evidence outside of the police investigation are the autopsy report of Cyril Wecht, M.D.,
performed at the Plaintiffs' request, and an interview with a tourist, Jim Haager, who said he saw
Defendant Dina Shacknai at the Spreckels' Mansion (i.e., where the murder occurred) the evening
of the murder. In addition, Plaintiffs produced a box of Rebecca's belongings, constituting all of
the documentation from Rebecca in Plaintiffs' possession, including an envelope addressed to her
parents, containing $420 and various checking, credit card account and personal papers. All of
the parties in this action have all of this evidence.
Plaintiffs have also responded to interrogatories identifying her parents were financial and
psychological impacted by Ms. Zahau's death. What little documentary evidence they have in
their possession has already been produced. At this point there is simply nothing left to give.

Defendant Shacknai as thus far served Plaintiffs with 249 Form Interrogatories, 430
Special Interrogatories, 193 Requests for Admission and 469 Requests for Production of
Documents, i.e., 1,341 separate discovery demands, even though everyone already had all the
evidence. (Greer Declaration at 'if 3). The vast majority of these requests are duplicative, as they
are propounded on Ms. Zahau's deceased father and his estate and on the decedent and her
estate. Since the decedents and their estates are one-in-the-same, half these discovery demands are
completely duplicative. (Greer Decl.'i[ 4) Moreover, since the vast majority of the discovery
requests are either contention interrogatories or demands for documents relating to the murder, by
answering one of the five or six sets of demands, Plaintiffs' have fully responded to the other 80%
of he demands. (Id.)
Because of the sheer volume of these demands, and the additional challenge caused by
each set of demands being organized slightly differently, it was very difficult to sort through and
organize them to determine the most efficient way to respond. Moreover, nearly one-hundred
Requests for Admissions asked the deceased parties to admit that they had no personal
knowledge regarding events cited in the complaint. (Greer Deel. 'i[5) Since it is clearly impossible
for a dead person to attest to his or her personal knowledge, it really appeared to Plaintiffs'
counsel that either someone was purposefully being unreasonable, or at a minimum not making a
reasonable attempt at efficiently preparing discovery demands. (Greer Deel. 'if 5).
Overwhelmed and frustrated, Plaintiffs' counsel finally asked counsel for Defendant
Shacknai to attempt to organize this massive accumulation of discovery requests so Plaintiffs
could respond. (Greer Deel. 'if 6). Plaintiff Pari Zahau does not read English, and is also still very
distraught over the loss of her daughter, so it was even more important to present the discovery in
a logical and concise manner. (Greer Deel. 'if 6). Defendant Shacknai's counsel responded with
several tables of numbers that correlated all the discovery and identified many of the duplicate
demands. (See Exhibit A to Greer Deel.). Plaintiffs then attempted to reconcile their prior
response to determine if any additional responses were warranted. The goal. was to prepare
responses for each defendant regarding demands that called for their personal information, and
respond to all demands and then respond to all contention interrogatories and document demands
through Robert Zahau. (Grer Deel. iJ7) A chart reflecting this organization is attached as Exhibit
2 B to the Greer Deel.
As discussed in detail below, at this point Plaintiffs submit that, with the exception of a
few demands that got lost in the mass of over 1,300 demands, they have produced all non-
objectionable evidence and information their possession that is relevant, or likely to lead to the
discovery relevant evidence.

There is no appearance by Attorney Greer, though he scheduled a telephonic appearance via CourtCall.

The Court notes that she had hoped Mr. Greer would appear today so the could could discuss discovery
issues with counsel.
The Court encourages parties to come ex parte for discovery meet and confer.
The Court informs counsel that it does not have time to hearing the motion on 4/14/2017 unless some of
the hearings on that date are vacated.
The ex parte application is granted in part, and defendant Adam Shacknai's hearing is advanced as

How does Greer's office keep up with such excessive, usually duplicate requests? Shouldn't the judge be doing more to rein in the defendant's attorneys? It's ridiculous how much they've been allowed to abuse the court system.

The Zahau family has given them the same evidence over and over and over. Defendants have access to all the evidence and have all along. This is just harassment.

Time for the Judge to do the right thing and move forward with the trial.

is obtainable from some other source that is more convenient, less burdensome, or less

(2) The selected method of discovery is unduly burdensome or expensive, taking into account the needs of the case, the amount in controversy, and the importance of the issues at stake in the litigation."

Well, Dina Romano Shacknai knows all about abusing the court system. Remember the WDS she brought againt Jonah Shacknai? That woman had the balls to not only abuse the court procedure, she ridiculed both Jonah Shacknai AND the judge.

Anyone remember the judge's admonitions he gave her to blue-pencil her nonsense?

Her WDS was a total farce.

She and her lawyers as well as Adam Shacknai and his lawyers are doing the same thing here imo.

Thing is, imo, its all gonna come back to bite them in their a-sses.

Given that GS & ES have a new baby SISTER in Paradise Valley, the powerful one would like nothing more than to eradicate any and all memory of Rebecca Zahau.

This is not my theory or what I think... but I wonder if it's possible that Rebecca's boyfriend was actually victimized, threatened, punished by some enemy or interested business association. After all think of the shady shifty people he was involved with through his work pre and during his Medicis days. The only thing I think anyone who believes Rebecca was murdered knows for sure is that for SOME reason, Gore. Not J, called it suicide. Which I believe a lie.

Very interesting that Keith Greer did not call in or contact the court at the Ex Parte on March 1. That was extremely rude and disrespectful to the court, IMO. Judge Bacall even commented on his absence in the notes.

We will see.

Who's KM? Jonah's 1-year-old daughter mom has initials LP. Rebecca was murdered in 2011. Doesn't look like he cheated on Rebecca. The residual hurt and scorn of Dina must still be strong to be so vindictive as to sling mud against Rebecca and her healthy, "peaceful" relationship with Jonah.

As Greer already pointed out in his last filing, defendants already have access to this information. The same information has been supplied multiple times. There are actually laws against this kind of harassment and the judge should really consider penalizing the Shacknais and Romanos. It's long overdue. I suppose justice isn't balanced or equal after all. If you're rich, you can get very favorable treatment in some courts.

Yes, it recalls the remarks Jonah's friend Howard made regarding the great relationship Jonah and Rebecca had. Howard had nothing to gain by saying those complimentary things, he apparently liked them both a great deal and his thoughts were from the heart. But I still can't reconcile Jonah's love for RZ and the way he's allowing Adam's attorneys to behave so abusively towards Rebecca's surviving family. They experienced enough stress and tragedy. Why is he allowing them to be harassed this way?

I agree with much of what you say. I'll just add that over time Jonah, like most people, overcame the grief and love for Rebecca and pretty much moved on with his life...When he was 'hit' with the WDS, he likely wanted it to go away ASAP. And like most businesspeople, whether sociopathic or not, concentrate on money and how not to lose any of it.

I'm not condoning it. Just explaining how love and money tends to intersect and diverge.

There are a number of reasons this might happen, including a separate settlement deal with Nina, but the far more likely reason is that the Plaintiffs think their evidence against Nina is weak and want to make the Complaint stronger by cutting out the weakest links. Not unusual when there are multiple defendants, and especially likely to be the explanation since apparently Nina had filed a Motion for Summary Judgment that hadn't been ruled on yet.

The Nina Shacknai vs Nina Romano name discrepancy is almost certainly no big deal.

When a case is dismissed with prejudice it's generally because case is found to be an overreach by plaintiffs. I wonder why the judge felt this way towards Ninas motion and not the other two defendants?

it seems to me her admission to police to being physically present at the mansion gives her opportunity to commit the murder. Motive is clear. She's aunt to a boy who was severely injured on Rebecca's watch. And means? Well dina and ninas dad used to take them boating so ropetying should be easy for either sisters.

So which of the defendants offered millions in settlement?

Despite the latest development, the case continues moving forward with Adams motions next up in schedule. When will Dina finally ask for summary judgment?

Here's hoping justice prevails for Rebecca.
