Evidence subject to Frye - *UPDATED* 2011.05.09 (ATTN: ALL ORDERS IN!)

You know, I really, really, really want the air sampling evidence to be admitted and I just LOVE Dr. Vass. However, if it will cause an overturning of the verdict or a mistrial, I think Judge Perry has given the jury enough. What does the defense have left? There's no nanny, no squirrel, no pizza, no garbage - what on earth are they going to do to defend ICA??

I hope Dr Vass will be testifying...My daughter and her friend are interested in forensics and they want me to bring them to attend the trial just to hear him testify....they are very interested in his work.

If we can't get in..I hope they have a jumbo tron outside of the courthouse or we'll find a local bar/restaurant with a TV showing the trial.

:praying:

I "think" that HHJP is going to allow the air sample/decomp smell in based on:

Dr. Vass' expertise and his testimony that his assistant jumped 2 feet when he smelled the "smell" ...

"It smells like there's been a dead body in the damn car" ... the ONLY TRUE statement EVER MADE by Ms Cindy ...

CA's 9-1-1 call is IN ... so hopefully HHJP will put the "icing on the cake" by allowing expert testimony on decomp smell !

I am still ever so slightly optimistic because there has to be a first time for everything and JA was 1st to try a DNA evidence case...sooooo...we wait whilst holding my breath.

I just love in the Hair denied motion that CJBP cited Petraco! :giggle:

Oh, that must be irritating JB and CM! :giggle:

I hope I am wrong....but me thinks that the chloroform / air samples will be out. Reading between the lines here.....the other orders are in but the chloroform is not....

I sense something here.

Maybe so. But I think the state will have enough with the hair and the stain in the trunk and the duct tape w/heart sticker and the 31 days. imoo

The state would have had enough if Caylee's body had not been found.

Failure to report her missing child for that long, and then the partying pictures, were all it took for me.

Actually, I want the root growth motion to go the SA's way even more than the Body Farm motion (though I LOVE Dr. Vass!).

The root growth proves how long her body was in the woods. I'm afraid the defense could exploit that more than the chloroform/odor evidence. After all we already have a hair with a death band admitted. There is ONLY ONE REASON why a hair with a death band that belongs to Caylee or Casey would be in the trunk of the Pontiac. Obviously, Casey is still alive. The jury will figure that out easily. We need to be able to prove how long her body was laying in the swampy woods behind the Anthony house.

I see where you are coming from Lola. I think the sticker indicates premeditation though. Hush, kisses....goodbye

No accident comes equipped with a sticker..........

Could mean a lot of things in the mind of the demented considering there is chloroform, duct tape, death and the child in the trunk evidence. Good-night kiss? An indication of remorse after death? A game? Anger, rage issues directed at ICA's mother? Kiss off? Placed before or after death? A way of soothing during if Caylee was conscious? Iconic of Casey's many online pics and scrap-booking hobby. Whatever the reasoning the one thing very clear imo is it's very personal and a signature of none other than Casey herself.

Just got here... going back to read

I think Caylee liked the stickers and it was more of "Here you little snot head. Have a sticker " as Caylee was struggling :tears:

That was a rape case though, no DP. I do wonder looking at the other rulings if there is other established evidence that is admissible if it can be allowed in conjunction with that? I can't explain it in legal speak but what I mean is since there is an abundance of other evidence showing human decomposition and chloroform in addition to the scientific experts for decomp and chloroform if that helps lay the groundwork or works in conjunction rather than new science that stands alone. I hope that makes sense?

The hair. The Stain. The Cadaver dogs. And the statements by numerous people about the smell of decomposition. All the State needs is enough evidence to not only prove that there was a decomposing body in the trunk of Casey's car... but the decomposing body was Caylee Marie Anthony. I think having these four pieces of evidence that will be heard by a jury is enough for them to come to the conclusion that Caylee was in fact deceased in the trunk of Casey's car.

The more I think about it, the heart shaped sticker is something that ties back to the Anthony home and it probably the reason it is so important to the State and the reason the defense wanted it thrown out. As long as all the evidence leads back to the Anthony home... it leads back to Casey Anthony. The more evidence that ties Casey to Caylee's remains off of Suburban Drive... the better!

Misy (a member here) pointed out something I had not thought about... and I must say it was a brilliant realization on Misy's part. If the defense is going to come out and admit that there was never a nanny and everything stated about the nanny was a lie... that means that this nanny never had a key to the Anthony home. That leaves only four people (maybe five because of Mallory) who had complete access to the Anthony home before July 15th, 2008. Cindy. George. Casey. Lee.

I am not sure exactly what role the chloroform played in Caylee's death... I don't know if Casey simply read that it had a "sweet smell" and poured it in there to try and mask the smell? I don't know if the chloroform was placed in that trunk after Caylee had been removed... trying to get rid of evidence? It boggles my mind that the levels were so high after the trunk had been opened numerous times during June 16th, 2008 and July 15th, 2008... even being left open to air out for hours on end after the Anthony's picked it up from the towyard.

I guess we'll have to wait a little longer to know whether or not the chloroform will be allowed in... I don't think it is that important. Just because the air samples of chloroform don't come in... doesn't mean that the jury will not see Casey's searches for chloroform, neck breaking, household weapons, etc... only to search for an episode of a television show where the storyline is a nanny kidnapping a child that followed two days later... only for a few days after that search... she searches for "how to make chloroform."

What has been allowed in is HUGE! It puts the time of death prior to July 15th, 2008 and during a time when Casey was telling her own mother that Caylee was with HER and numerous other non existant people in Tampa. That Caylee was fine and having fun! Telling her friends that Caylee was with either her parents or the nanny.

Casey is TOAST!

Stickers are a constant in toddler life - my son gets stickers at daycare for everything (going potty, putting toys away on time, etc, etc), and at the bank when I do my transactions and he is with me - everywhere.

I always considered the sticker someone's really lousy idea of a consolation prize.

His testimony was sooo compelling, wasn't it? I do wonder if HHJP is conflicted and allows him to testify about the chloroform at least. Will any mention of death smell, etc. be allowed? For example: Dr. Vass is certainly an expert with his god given natural sniffer and can testify to what it smelled like to him? I just know HHJP wants Dr. Vass' testimony in and maybe he will but he can limit it?

I agree! I firmly believe that the sticker had something to do with Caylee and Cindy's relationship.Something Caylee and Cindy shared together..no sign of remorse for Caylee, rather a slap in the face to Cindy.

I agree with all the scenarios you paint. Just something about that heart makes me feel like premeditation in the pit of my stomach.

IKWYM.....I'm wondering what the line is to allow the trier of fact to decide these difficult questions as opposed to denying the motion.

It could also show that Casey was fully aware of what she was doing when she duct taped and placed that sticker on Caylee's face. That she knew exactly what she did. Didn't Casey download a picture that had a bandaid with a heart sticker on it... much like what the duct tape with the heart sticker would have looked like?

Maybe Casey was telling Caylee that she made a big "boo boo" by talking too much? ETA: Could be the reason for the "Big Trouble Comes in Small Packages" shirt added with the duct tape and the heart sticker... oh my... Poor Caylee!!

My youngest daughter at Caylee's age would immediately go into a throw herself in the floor temper tantrum when visiting the doctor as soon as they tried to put her on a scale, knowing they would give her stickers. That's what she would start yelling and right away the nurse was handing them to her. She was up and just fine immediately. When we saw the same nurse more than once it was routine to give them to her first. Possibly Casey ripped up the three pieces first layered them, placed on the table or wherever as Caylee watched and Casey seemed to be making a game of it and explaining while putting the sticker on? Want to play Pearl from Spongebob as one poster suggested here a long time ago? Keep Caylee from screaming before the tape was placed if conscious?

Another good theory and in line with the argument and choking with CA.

I don't want to send you to the bathroom vomiting but as LolaMoon just reminded me of her being found in the big trouble shirt and the bandaid sticker you can't ignore so many obvious signs. The spiteful biotch statement to Lee. Where does it end? No doubt Casey does not think and feel like the majority of mothers.
