So the "air samples" are in... and we are just waiting on the plant growth (which I KNOW is coming in)? So that means everything is IN?

What it means Lola is that Baez and Cheney better get something together because they are in a huge amount of trouble with this case. But I don't think they care that much as long as they have the notariety and I am sincere about that.

Okay, maybe I'm confused - were the air tests and chloroform all in the same motion? I guess if he lets them for the sake of the chloroform, he'd have to let them in for the sake of decomp, right? I just want to make sure the decomp air tests weren't a separate issue from the chloroform air tests, does that make sense?

It's the DTs fault...they had me so mixed up in the hearing about who was arguing about what....

The two parts I like best are 1. Where he says as a Forensic Antropologist and Forensic scientist, Vass IS qualified and 2. Where he says ICA had access to the computer and it may be circumstantially inferred that she made the searches.

I think I read it the same way you did. ALL tests that Vass perform, the 'airtrapping' and the carpet sample were included in the ruling.

But I thought all the brew ha ha about the Manson ranch was that he should not be able to interpret the sample as a "decompositional event" based on his "database" that he stood to make pennies off of.:waitasec:

HHJP certainly understands more of the science in this case than any of the DT including the whizz kid Sims...
 
I am trying very hard not to get too excited. In his ruling HHJP talks about the chloroform only. He says the method used - the GCMS ( I can neither pronounce the name of this equipment nor spell it out correctly) - is generally accepted and gives other reasons for allowing the chloroform in. He does talk about Dr. Vass and how he used the GCMS, but he does not specifically talk about the air samples being used to determine decomp. So I don't think this ruling covers both, just the chloroform.
 
Ya know...I kinda feel validation...not like anyone here really needs it...but what we saw, what we heard, what we discussed and analyzed for ever and a day...we were right.
It's all so damning.

It absolutely does. Vass spent quite a lot of time on the stand explaining decomposition and its compositon and the fact that there were four chemicals that were found and I remember Baez saying 4 of those chemicals could be anywhere and Vass said, yes but it is the fact that they are found togehter and in this trunk from something that is the size of a foot and a half - not the size of a hamburger.

So, WFTV does not mention decomp - it mentions chloroform, as well as saying this is the first time AIR samples have been used. I would like a more complete explanation myself.

For now, I will take what I can get and chloroform will do. She must have used a huge amount for it to last a month and a half in that trunk because it dissipates. What did she do? make it in the garage sink.

The thing about the "plant growth" was that if I remember correctly, Judge Perry said that it didn't relate to Frye, but with all the whining the defense did to get it heard... he simply was entertaining them. Jeff Ashton didn't even ask questions of the defense's witness (Jane Bock) or even present their own witness on the stand for the hearing because they didn't have to. It, imo, is a done deal. We're just waiting for Judge Perry to deny it. I think I can safely say that the Plant growth will be coming in.

So we basically only have the 31 days, which if I remember correctly, has been addressed numerous times in numerous ways... so I will say that we can safely say that the 31 days motion will be denied also. So everything is coming in. I will say I am 99.9% sure!
 
I wonder if ICA has a clue yet how bad this is for her or if she still thinks JB can get her out of it or at least the DP?

That is what I am thinking!!! That is why I got chills! I am hoping that we are both right! But yay for Justice for Caylee!!!!

That's because the DT kept clouding the hearing with other nonsense. They kept veering away from what a Frye hearing really is. Dr. Vass will be allowed to testify about his air sampling and the jury will give it the weight it deserves. The science passed the Frye test.
