I am trying very hard not to get too excited. In his ruling HHJP talks about the chloroform only. He says the method used - the GCMS ( I can neither pronounce the name of this equipment nor spell it out correctly) - is generally accepted and gives other reasons for allowing the chloroform in. He does talk about Dr. Vass and how he used the GCMS, but he does not specifically talk about the air samples being used to determine decomp. So I don't think this ruling covers both, just the chloroform.

I agree, but I don't think the SA need the decomp air samples at ALL. I think George & Cindy's testimony about the car smelling like a damn dead body is more compelling and I'd rather Judge Perry err on the side of caution.

The chloroform was the most important test! Even LKB was terrified of the chloroform getting in and even threatened Judge Perry on 48 hours that it would be an appeal issue. When I heard her say that I knew the DT was petrified of the chloroform and it won't be appealed. This test has been used forever.
 
Ya know...I kinda feel validation...not like anyone here really needs it...but what we saw, what we heard, what we discussed and analyzed for ever and a day...we were right.
It's all so damning.

Ya know...from early on I knew KC deserved the DP...now for the first time, I really think she will get it. With all of this evidence I just don't see how a jury could sentence her to anything less than Death. I would be fine with LWOP but I can't say I will lose a wink of sleep if they put her down. :wink:

BBM: I agree with you 100% on this. While it would be nice to have the air sample decomp stuff in and I would love to see Dr. Vass get recognition for this test so he can use it more often, I would rather it not come in then turn out to be an appealable issue. You are right, the vivid testimony from people - including KC talking about a dead squirrel - is going to have quite an effect on the jury.

He talks about Vass' testimony being admissable as expert testimony. This was a denial of Jose's motion...and as far as I could tell, Jose did bring up the issue of chloroform and a decomp event.
 
Judge Perry, at the conclusion of the denial:

"Defendant had access to the computer and it may be circumstantially inferred that she was the one who conducted the searches in question."

But I thought all the brew ha ha about the Manson ranch was that he should not be able to interpret the sample as a "decompositional event" based on his "database" that he stood to make pennies off of.:waitasec:

He used the mass spectrometer ? (carp I can't spell THAT!) on the sample that LE sent from the trunk of her car.

When he performed the search at the ranch, he used a machine he called "LABRADOR", please don't ask what that's an acronym for... I have NO idea. But it's not the same as the mass spectrometer.

Just popping in to point out that the air "decomp" tests are a separate issue and a separate motion--no ruling yet on that one.

After the SA tells the jurors that George & Cindy were both at work during the "How to make chloroform" searches and Vass explains how high the levels of chloroform were in the trunk, there will be absolutely no doubt in the jurors' minds that Casey is a cold calculated killer. The chloroform evidence is no junk science - mass spectrometry is an accepted and reliable science. WooHoo for Caylee!

Whoa. You guys! You have to read the ruling!

Now it doesn't mention decomp or the air tests relating to it, but it DOES mention the air tests in relation to the chloroform - holy crap! Is this what we are going to see in allowing the decomp air tests? I got chills down my body reading this! (And I love subtle smackdown of the defenses expert too, LOL).

I am so trying to not get too excited, but WHOA!

ITA! I truly think the air tests for decomp are also going to come in...how AWESOME for our angel, Caylee!

And not too shabby for Jeff Ashton, to be the one to get in ANOTHER major new science....( for some who may not know...JA is the one who got the first DNA test in to a trial)!

I think the single most important reason for the chloroform being allowed in is that it proves that this was premeditated.

I still do not understand why or how the chloroform was used (I'm not convinced that it was used to subdue Caylee before murdering her?). I do know that it is not an accident that searches were done on "chloroform" and "how to make chloroform" and then massive amounts of chloroform were found to be in the trunk of Casey Anthony's car. The same trunk where a body was decomposing (cadaver dogs, testimony about the smell, and possibly the air samples)... and that the body that was decomposing in the trunk of that car was in fact Caylee Marie Anthony (hair banding).

It all ties in together and I am really happy that the jury is going to be able to decide for themselves how it all adds up. I have no doubt that they will all come to the same conclusion as the majority here... that Casey murdered Caylee... not only intentionally, but that is was planned and carried out.

I think we will get the plant growth and the 31 days admitted.
But I think the air samples are still kind of iffy.

But with everything else in, no problem. imoo
 
This passage from the ruling is why I believe Dr. Vass will be able to testify about the decomp signature.

"When an experts opinion is based on generally accepted scientific principles and methodology, it is not necessary that his opinion be generally accepted as well. The fact that experts may disagree on how to interpret the scientifically and legally reliable data is not a valid reason for excluding their opinions."

I think the judge has said in this ruling that the scientific principles and methodology are generally accepted so Dr. Vass' opinion of what the data means (chloroform level or decomp chemicals) would be left for the jury to agree or disagree with.
 
It is funny but something just popped into my head. People are speculating, myself included, that the DT is going to say the chloroform was just left over from the cleaning done by Casey or Cindy.
So the next question is, WHY the need for a heavy duty cleaner like pure chloroform in one's car trunk, if it is only full of pizza and old swimsuits?
