if HHJP allow the Decomposition Odor Analysis in, I'm going to pass right out.

If Dr. Vass is allowed to present his Decomp Odor Analysis I will have to decide whether or not to pass out or do the happy dance. History will be made and once again by JA!

I could almost, as I read this order, read between his eloquent words and hear HHJP saying hey, DT, I like Dr. Vass, he rocked, and your expert sucked. Good luck at trial with Dr. Vass! How cool is this ruling? LOL

What am I missing about the plant growth? Was there another motion after the one on Feb 15th (state responding on March 7th) that HHJP did not respond to - this one was filed 3/18/11..

http://www.wftv.com/pdf/27242166/detail.html

is an order sating that since Dr. Hall is giving pure opinion testimony it isn't subject to Frye and Grants the state's motion to strike the defendants motion to exclude unreliable evidence (plant or root growth)

HELLPP!!!

The way I read it, this only relates to the chloroform. No mention of decomp. :waitasec: BUT, based on this motion, I think the decomp air test by Dr. Vass are also coming in. :great:

Anyone got a "Sweep" smiley? :giggle:

Here ya go...

HLN just announced AIR SAMPLES ARE IN !!!!

Let's wait on the Order before we assume HLN got it right.

I think we can interpret this better than the media, quite frankly. I'll believe it when I see the Order, but I admit the wording in the chloroform order makes me believe he is leaning toward letting it in.

I think this ruling is more vital than the Odor Analysis-- I like Dr. Vass very much, but Caylee will glean justice even if this work isn't allowed. jmo

Here is the order:

CJBP cites the same 3 things in this one, as in the previous DENIED motions. I'm begining to think the Air IS coming in as well. :great:

WOW :laughcry:

DENIED :denied: Thank You Judge Perry :cheer:

I also like this part at the end of the Order

"With respect to the Defense's motion in Limine to exclude any reference to the existence of chloroform or computer searches regarding chloroform, the Court finds no legal basis to grant such a request. Defendant had access to the computer and it may be circumstantially inferred that she was the one who conducted the searches in question."

It is funny but something just popped into my head. People are speculating, myself included, that the DT is going to say the chloroform was just left over from the cleaning done by Casey or Cindy.
So the next question is, WHY the need for a heavy duty cleaner like pure chloroform in one's car trunk, if it is only full of pizza and old swimsuits?

If the Anthonys say they concocted chloroform to clean the car, they might as well hammer in the last nail in ICA's coffin.

The level of chloroform in the trunk was too high to use the excuse it was "left over" from any cleaning product, such lies, and in Dr. Vass's research, in 20 years, he has never seen levels this high.

What it means Lola is that Baez and Cheney better get something together because they are in a huge amount of trouble with this case. But I don't think they care that much as long as they have the notariety and I am sincere about that.

31 days IN
911 calls IN
tapes of KC's talking to LE - IN
chloroform IN
cadaver dogs IN
heart sticker IN
PICTURES IN (after June 15th) IN - that is a killer
HAIR BANDING IN
STAIN IN TRUNK -IN

How much worse can it get?

And then we have the witness testimony - Rick Plesea will be interesting. His mother will be interesting.

What is that song - I'm a steam roller baby....

And it is going to be over in two months and she is off to Lowell and like Scott Peterson, she is yesterday's news.

ADD to the above IN....the Cell Phone and Computer Forensic Reports!!!!

Ah, I cannot wait to see Dr. Vass in front of the jury. They are going to love him. His enthusiasm for science will not only show through but make him that much more credible to them. I am so excited about the chloroform being in!!!! I just hope the decomp motion goes the same way!

I am trying very hard not to get too excited. In his ruling HHJP talks about the chloroform only. He says the method used - the GCMS ( I can neither pronounce the name of this equipment nor spell it out correctly) - is generally accepted and gives other reasons for allowing the chloroform in. He does talk about Dr. Vass and how he used the GCMS, but he does not specifically talk about the air samples being used to determine decomp. So I don't think this ruling covers both, just the chloroform.

BBM
I agree...
As I read it, this ruling only covers Chloroform..it did not address the Decomp Air Samples..there is no mention of that in the ruling...just Chloroform.

I agree, but I don't think the SA need the decomp air samples at ALL. I think George & Cindy's testimony about the car smelling like a damn dead body is more compelling and I'd rather Judge Perry err on the side of caution.

The chloroform was the most important test! Even LKB was terrified of the chloroform getting in and even threatened Judge Perry on 48 hours that it would be an appeal issue. When I heard her say that I knew the DT was petrified of the chloroform and it won't be appealed. This test has been used forever.

bbm
Not only George and Cindy's testimony...add Dr Vass, Yuri Melich, the dogs alerting..

Thank heaven for a judge who "gets it" and thank heaven that ICA gets it thanks to her DT.

He used the mass spectrometer ? (carp I can't spell THAT!) on the sample that LE sent from the trunk of her car.

When he performed the search at the ranch, he used a machine he called "LABRADOR", please don't ask what that's an acronym for... I have NO idea. But it's not the same as the mass spectrometer.

I smell someone begging for a plea deal .. or is that rotting pizza?? Is it too late for a plea deal?

Aweeeee!! That's our Peach!! Always thinking of us!! :D I got two reasons to celebrate. I had a wedding in my house Saturday!! I gained a daughter!! I am beyond thrilled. Sorry for the O/T , but I had to share the wonderful news, and now this!! :woohoo::great::woohoo::great:

She's a lucky girl ! :loveyou: :cake:

I keep coming back to RM's testimony, the Chloroform was posted on his website first...Why did he immediately take it down, Will his depo add more to the picture. Did that give her a clue? Going back to read after I cook dinner. My brains are falling out of my head... doesn't that prove premeditation?
