I wonder what would happen if CHO said OK, Jahi can be moved tomorrow, have your airlift ready to pick her up at 7 am so she can get settled in the New Beginnings facility before Sunday...

Probably the family would sue them for failure to screen the new facility. CHO can't win, no matter what they do. Best they can hope for is damage control. Which, by the way, is best served by doing everything according to California law and accepted medical ethics.

:dunno: Something tells me that they still wouldn't be happy. Seems that no matter what CHO does, it isn't good enough.

How long will the settlement conference last? Will it conclude today, or is it likely to go on for days, weeks, etc.? Will the scope be limited as to what can be discussed? When the conference concludes, does the Judge issue a ruling on how the parties should proceed going forward?

jmo, but imo it will likely last less than the day, depending on whether and how quickly futility becomes apparent. If it isn't futile (which I doubt), the court could continue tomorrow or on a different day, but never would it go on for days at a time or weeks. At best, if agreement seemed likely, the court would send them off to continue to negotiate the details on their own. There shouldn't be a ruling by the settlement judge after the conference. The magistrate will report the outcome to the judge and they'll take it from there. They can discuss anything, but the medmal aspect isn't at issue and Dolan has said he doesn't represent the family in that case. Plus, no med mal complaint has been filed. So the scope of these discussions will most likely be limited to the issues we've been discussing wrt to maintaining medical support, transport, etc. All jmo, fwiw

I guess I would be interested in hearing what excuses are presented for not being able to go through with the transfer after all, and why it's all CHO's fault. I just can't believe they have anything ready to receive a brain dead ventilator patient. They're an outpatient facility, the chances are they won't have a spare ventilator just lying about. What about the 24/7 nursing staff? What about the doctor? Who are they gonna call if something goes wrong? Is there anyone who could tell them what to do if [insert parameter] drops to twenty? Do they even have the equipment to monitor [insert parameter]?
My guess is no.

If I were considering any type of long-term care for a loved one, I would want to have a tour of the facility, meet with administrators and staff, discuss the care that would be provided, etc. How can Jahi's family make the decision to transfer the teen to a facility that is clear across the country without visiting beforehand?

If I were considering any type of long-term care for a loved one, I would want to have a tour of the facility, meet with administrators and staff, discuss the care that would be provided, etc. How can Jahi's family make the decision to transfer the teen to a facility that is clear across the country without visiting beforehand?

The long term inpatient facility is still under construction. So they would have to be meeting with construction workers instead of staff.

That's easy. CHO won't feed her or put a trach in her for transport.

IMO, NB is out of their depth and is basically being used as a stall technique by Mr. Dolan. Mentioning NB is driving people to their website and IMO, NB is hoping people who believe strongly that Jahi is still alive, will donate to their facility. Of course MOO. Personally, I find it unethical on the part of NB and Mr. Dolan. IMO

I am having a hard time believing that going this route (medford ny facility) is the result that the family/dolan are truly wanting to happen. jmo

Not one mention has ever come from the family about visiting the Medford, NY facility and at least meeting the physicians and nurses who are supposed to care for Jahi.

Even the LVN grandmother has not mentioned it and she is the only one in the family with any patient care experience.

This, alone, tells me the family is not serious about wanting to assume responsibiliy for her care or care decisions.

Having a permanent tracheostomy and a G-tube are not going to change the fact that she is legally dead, and there is no insurance that will pay for her care. I think any long term acute care facility that has the capacity to attend ventilator dependent patients will need clearance from the medical director and their governing board to accept someone brain dead and uncompensated. This is as much a slippery slope for them as it is for CHO.

Avoidance?

Delusional thinking? Magical thinking?

I have another question that I think is valid.

How is it "okay" that unscrupulous people are allowed to hold out false hope, and take advantage of vulnerable people in a crisis, who need clear and accurate information?

And why is it "okay" for the media, the courts, and everyone else to pretend that this place in NY is a "valid" choice or option? This is what political correctness has produced-- a fairytale situation where few people want to say the truth, for fear of "offending" someone.

The whole thing is like a bad modern day version of "The Emperor's New Clothes", IMO.

The NB place is a fine idea for consolidating services for outpatient TBI patients, but it is just not any kind of health care facility. I cannot believe anyone is pretending to "respect" this as an option. It's preposterous.

You are not alone in your thinking, Zuri. I think it stopped being about what's best for Jahi quite a while ago, and is now about what's best for bank accounts. In my opinion, of course.

That's the point: If someone from the family visited New Beginnings, they would soon learn that it is not an appropriate environment for Jahi. I don't know how this family can make a decision to move the child across the country to a medical facility that doesn't exist :eek:

I am thinking that previous articles saying this was a "Settlement" conference were incorrect. This sounds more like it. Mediation.

A federal magistrate is scheduled to mediate talks Friday between the family of 13-year-old Jahi McMath and the Oakland hospital where the brain-dead girl continues to be kept on a ventilator per a court order.

Each side is slated to present its case to the magistrate during the session. Children's Hospital Oakland argues that Jahi is legally dead and opposes performing medical procedures on a "deceased person." Jahi's family insists that she is still alive, and wants her transferred to a long-term care facility despite a consensus among neurologists that she is dead.

The Board of Health for whatever state the outpatient facility would be in would step in and serve and injunction against the facility. It would not be allowed to happen as they are operating outside of their license and in violation of the health facilities licensing rules of whatever state it was.

Maybe Dolan should be looking for something in Mexico.......

They obviously haven't explored the big picture. Do they have means to move the family across the country, stay in hotels or temporary housing, etc. for weeks, months, or longer? It's all so impractical, but I appreciate that they are acting out of desperation and are not considering the future ramifications of this choice. :moo:
