It has been my opinion that once they could possible get this hospital to just do these two little procedures we will be on our way and after surgery then take the hospital back to court a argue why would a hospital do those procedures to a dead person and then fight to make them keep her there and alive. jmo idk

iirc the family assumes responsibility of Jahi in the PICU and then the transfer begins.

I followed his argumentation better in the first federal petition but I just can't see any connection between fetuses and the family's rights to make medical decisions for Jahi.

Anyway, I never thought that there is a privacy right to dictate to the doctors what treatments they should be prescribing. I thought you can refuse the treatments they recommend but if they don't want to prescribe a medication or order surgery and scans they don't consider medically indicated, you can't say that they have to because it's your religion.

Did Dolan write about fetuses because the judge has a degree in Divinity? IIRC, it was mentioned up thread by a poster who posted the judge's CV. Do lawyers typically do this kind of thing?

Probably because the family knew they'd never be moving her to New York. All a stall tactic.

They want her at CHO while they bash them in the press. IMO of course :)

That's the thing. Stalling for what? :waitasec: Let's sum up today.

1. The judge says she can leave the hospital (with conditions).
2. Nobody will take her without a feeding tube and trach.
3. Judge denies request to force #2 to be done, and won't allow a third party to do it.
4. Death Certificate lists date of death as 12/12/13.

To me, nothing has really changed after today's hearing (the state one). So they are just stalling the inevitable. OR am I missing something? :waitasec:

Oh I have been lurking a bit and keeping tabs with everything. Things got a bit confrontational here a few days back and I hate that. I was enjoying the intelligent, thoughtful and respectful conversation that was going on before that point and it seems like it is all back to good again. So here I am, lol.

I really appreciate everyone here and what they have contributed with their medical expertise, personal experience, personal points of view and the research that everyone put into it. Our med experts here such as Zuri, K_Z and all of the nurses have been such an amazing asset to this conversation.

"Anonymous" doctor? He or she has to be credentialed and given medical and operating privileges at CHO for him to perform the procedure. You can't just walk in and start operating in a hospital! In fact, CHO might actually be prohibited by their insurer to allow such a thing without following a very set and defined protocol which may take longer than a couple of days (e.g verifying background, checking licence, verifying BE/BC, perhaps drug testing, etc...).

It's a trap Dolan wanted to set up.

I am also concerned that he is setting up some sort of suit by having CHO allow the mother, who has no medical background, and does not appear to have engaged the private services of a medical professional (the grandmother doesn't count) to assume full care responsibilities.

It's an odd Catch-22.

I was confused about Dolan's statement that there's no prohibition against an outside doctor performing the procedure at CHO. Even if they have found the "anonymous doctor" willing to do this when there's a death certificate, where will they do it? Does CHO have to let an outside doctor do a procedure in their hospital? Doesn't seem like it...

The insurance ceases the moment her brain death is recorded in the chart.

That includes Medicare and Medicaid/Medical.

All costs will have to be either paid by the responsible relative, paid by contributions or charitable organizations, or assumed by the "facility".

This has nothing to do with the ACA.

Wouldn't insurance pay for a few days past the brain death diagnosis? It was posted on the other thread that Usher's brain dead stepson's mother wanted to keep him on the vent but she said insurance would only pay for a couple of months. She made that statement after one week and he was disconnected on the second week. So I would think he was disconnected because of insurance.

I got the information from a California attorney interviewed on Fox News last night.

Take it for what it's worth, but he said the insurance ceases effective the date and time of brain death is written into the medical record, just as when a person expires as a usual cardio-respiratory death.

A low-level person at the insurance may have given Usher's stepson's mom incorrect information and it may have taken a week for her to get the final decision from the insurance company.
