Interesting. Although I defended Judge Scherer in how she handled defense in the Parkland case I can see that’s she’s also opened the door for defendants to make this claim. It’s all about perception.

Ultimately, she didn’t have the right temperament for the job. I also wonder how much pushback she was going to get from defense lawyers moving forward - how many were going to move to disqualify her from their cases based on her alleged bias? I bet that was gonna be an ongoing problem.

Peterson’s attorney, Mark Eiglarsh, said there are 22 defense witnesses who will testify that they also thought the shots were coming from somewhere other than inside the classroom building.

“He’s not the only one who heard those shots and believe they were coming from a different location,” Eiglarsh said.

Peterson retired shortly after the shooting, was fired retroactively and charged a year later.

Jury selection begins Wednesday in the trial of former Broward County Sheriff's Deputy Scot Peterson, who remained outside a three-story classroom building at Marjory Stoneman Douglas High School during Nikolas Cruz's six-minute attack on Feb. 14, 2018. Opening statements are scheduled for early June, and the trial could last two months.

Peterson, 60, is charged with seven counts of felony child neglect for four students killed and three wounded on the 1200 building's third floor. Peterson arrived at the building with his gun drawn 73 seconds before Cruz reached that floor, but instead of entering, he backed away as gunfire sounded. He has said he didn't know where the shots were coming from.

Peterson is also charged with three counts of misdemeanor culpable negligence for the adults shot on the third floor, including a teacher and an adult student who died. He also faces a perjury charge for allegedly lying to investigators. He could get nearly a century in prison if convicted on the child neglect counts and lose his $104,000 annual pension.

For Peterson to be convicted of child neglect, prosecutors must first show he was legally a caregiver to the juvenile students. Florida law defines a caregiver as “a parent, adult household member or other person responsible for a child’s welfare.”

Eiglarsh has argued there is an exemption for most police officers that covers his client. Circuit Judge Martin Fein ruled that is for the jury to decide, noting that Florida courts have found babysitters, landlords and even kidnappers to be caregivers.

If jurors find Peterson was a caregiver, they then must determine whether he made a “reasonable effort” to protect the children or failed to provide the care necessary to maintain their health.

To me it is just sad and astounding that this trial is even necessary. The legalities of this are complicated but and who knows how an appeals court would handle it.

Circuit Judge Martin Fein had tentatively scheduled three days of preliminary jury selection, seeking 50 candidates whose schedules and employment would allow possibly two months of service at the trial of former Broward County Deputy Scot Peterson.

But by the end of Wednesday, the judge ended the process after finding 55 finalists out of 300 prospects interviewed.

Curious to see what the evidence will be... however, thinking it's a waste of taxpayers dollars. Most importantly, this poor man, worked hard and lived (from what I've read) his whole life respectively, and this is what he gets? MOO

Scot Peterson was assigned to Marjory Stoneman Douglas in Parkland as a school resource officer when a gunman opened fire at the South Florida high school on Feb. 14, 2018, killing 14 students and three staff members.

"School resource officers need to be carefully selected and specially trained to do the job that they are tasked with doing. They no longer can be that officer that's at the end of their career, in their late 50s. It's no longer a job just to sit behind the desk," said Max Schachter who lost his son, Alex, in the 2018 mass shooting.

Peterson "is just a coward," parent Andrew Pollack said, calling him an obscenity. His 18-year-old daughter Meadow was the adult student murdered on the third floor.

"He wouldn't have gone in with full body armor and a bazooka," Pollack said. Other victims' relatives have made similar statements.

A Broward sheriff's deputy for 32 years, Peterson had been at Stoneman Douglas for nine years after 19 years at other schools. He said he's"eager" for the trial to start.

"I want the truth to come out, and if it is going to be through a trial, so be it," Peterson said. "Not only the people in Florida, the country, and most importantly the families, they need to know the truth about what happened, because unfortunately it has never been told."

There were 55 prospective jurors as of Monday afternoon. That pool will be narrowed down to 10 — six jurors and four alternates.
