GENERAL PENALTIES; REGISTRATION OF CRIMINALS View Entire Chapter
775.021 Rules of construction.—
(1) The provisions of this code and offenses defined by other statutes shall be strictly construed; when the language is susceptible of differing constructions, it shall be construed most favorably to the accused.
(2) The provisions of this chapter are applicable to offenses defined by other statutes, unless the code otherwise provides.
(3) This section does not affect the power of a court to punish for contempt or to employ any sanction authorized by law for the enforcement of an order or a civil judgment or decree.
(4)(a) Whoever, in the course of one criminal transaction or episode, commits an act or acts which constitute one or more separate criminal offenses, upon conviction and adjudication of guilt, shall be sentenced separately for each criminal offense; and the sentencing judge may order the sentences to be served concurrently or consecutively. For the purposes of this subsection, offenses are separate if each offense requires proof of an element that the other does not, without regard to the accusatory pleading or the proof adduced at trial.
(b) The intent of the Legislature is to convict and sentence for each criminal offense committed in the course of one criminal episode or transaction and not to allow the principle of lenity as set forth in subsection (1) to determine legislative intent. Exceptions to this rule of construction are:
1. Offenses which require identical elements of proof.
2. Offenses which are degrees of the same offense as provided by statute.
3. Offenses which are lesser offenses the statutory elements of which are subsumed by the greater offense.
(5) Whoever commits an act that violates a provision of this code or commits a criminal offense defined by another statute and thereby causes the death of, or bodily injury to, an unborn child commits a separate offense if the provision or statute does not otherwise specifically provide a separate offense for such death or injury to an unborn child.
(a) Except as otherwise provided in this subsection, the punishment for a separate offense under this subsection is the same as the punishment provided under this code or other statute for that conduct had the injury or death occurred to the mother of the unborn child.
(b) An offense under this subsection does not require proof that the person engaging in the conduct:
1. Had knowledge or should have had knowledge that the victim of the underlying offense was pregnant; or
2. Intended to cause the death of, or bodily injury to, the unborn child.
(c) Notwithstanding any other provision of law, the death penalty may not be imposed for an offense under this subsection.
(d) This subsection does not permit the prosecution:
1. Of any person for conduct relating to an abortion for which the consent of the pregnant woman, or a person authorized by law to act on her behalf, has been obtained or for which such consent is implied by law;
2. Of a person for providing medical treatment of the pregnant woman or her unborn child; or
3. Of a woman with respect to her unborn child.
(e) As used in this subsection, the term “unborn child” means a member of the species 🤬🤬🤬🤬 sapiens, at any stage of development, who is carried in the womb.

Moo .. Andreae was 4/6 weeks pregnant so that is very early in pregnancy. Moo An autopsy will be needed to confirm pregnancy. Moo

Just curious...why? Is her pregnancy in question? Everything I've read says that she was pregnant with her 3rd child.

I don't know for certain, but I imagine it's to determine cause of death for the baby. If the beating killed the baby before he killed her, I would imagine the charges would be worse than if the baby died because the mother did.

For most of Wednesday, long after a family member of a missing abducted woman led police to him and several hours after human remains were found, Xavier Johnson denied having anything to do with Andreae Lloyd’s disappearance. An uncle who found Johnson near his parked truck along a canal in deep South Miami-Dade said when he approached Johnson he was pacing back and forth saying he was searching for her. Late Wednesday night, police said, Johnson, 32, finally cracked and admitted to killing the woman he lived with, shared two children with and who was six weeks pregnant. Why he did so, police — if they know — wouldn’t say. Human remains recovered Wednesday were positively identified as Lloyd’s early Thursday afternoon. “They questioned him for several hours at headquarters while the search was ongoing,” said Miami-Dade Detective Angel Rodriguez. “We know he confessed. As to the reason why, I’m not sure.”

Lloyd's father, AL, said he confronted Johnson, who told him he was looking for Andreae.

“He told me she was missing before she even got off of work. She is supposed to get out at 7 and he told me at 6:45. How you know she missing already?" Arnold Lloyd said. "That’s fishy."

So she was going to leave him huh? I wonder if she had already broached the subject with him and his reaction stalled her from actually doing it. It doesn't appear to be something that the family knew about since the nephew believed the relationship was a happy one. Well except her father since he states that he knew the 3rd child didn't belong to XJ. I also wonder if her father was helping her to try to find a way out? How tragic.

ETA I know some articles have described the murderer as the father in this pregnancy, but it appears her father thinks otherwise. Her final post to Facebook tells me there was trouble in paradise. IF she was planning to leave him and/or IF she had been seeing someone else, this could explain his motives.

I couldn't for the life of me figure out why a pregnancy might cause him to kill her when they already share two children and an 11 year relationship. Despite other relatives thinking the relationship looked perfectly happy from the outside. AL's dad feels otherwise.

Fla. Stat. Ann. §775.021(5) states that anyone who commits a criminal offense and, in the process, causes bodily injury to or the death of an unborn child commits a separate offense if the provision or statute does not otherwise specifically provide a separate offense for such death or injury to an unborn child. At the end of the subsection, the state defines unborn child as a member of the species 🤬🤬🤬🤬 sapiens, at any stage of development, who is carried in the womb.
