Murdered Child's Mom Takes Stand During Trial

SEMINOLE COUNTY, Fla. -- The retrial of a man accused of killing his girlfriend's toddler was underway Wednesday afternoon, and the mother of the child took the stand.

Investigators say Jason Lenz slammed the child's head into a hard surface, killing him. His first trial ended with a hung jury. Defense attorneys wanted another mistrial declared Wednesday, but the judge denied that request.

The attorney for Jason Lenz was upset over a comment that the victim's mother made in passing on the stand Tuesday. A comment he worried might unfairly prejudice the jury in the child murder case.

After sitting stone-faced through much of his last trial, Jason Lenz appeared to cry several times Wednesday.

Defense attorneys were concerned about a comment from Tracey Goldreen Tuesday when she said Lenz actually created one of the dents in her home's wall when he got angry and punched it.

Why does his little face look red and raw in so many of the pics, and there are more of him with what looks like bruises, a black eye, and scratches on his little face? What a beautiful baby. RIP little angel. I hope these monsters pay dearly for what this sweet boy had to endure.

SANFORD (CBS4) - A Central Florida man accused in the death of his girlfriend's child could be re-tried as early as next month.

On Saturday a Seminole County Circuit Court judge declared a mistrial in the felony murder and child abuse case of Jason Lenz after the jury reported they were deadlocked.

Jason Lenz, 35, was sentenced to life in prison without the chance of parole on the murder charge. Jurors also found him guilty of aggravated child abuse, which resulted in a sentence of 30 years.

Prosecutors said Lenz fatally beat his girlfriend's son, Anthony Jesy "A.J." Cabral, Jan. 24, 2009, in the home they shared

Mother should have been charged she knew he was abusing her son.I was shocked to see who his defense attorney was and how in the world could he say this:
Defense attorney Richard Hornsby told jurors that prosecutors failed to prove that Lenz intended to hurt the boy.

And here I thought he was one of the good guys.

The verdict was just ,but the DA failed Anthony when he did not charge the mom.She knew about and allowed the abuse :furious: She failed her son in so many ways.Why are the mothers never charged?:banghead::furious:These children have no choice who their mom moves in with but they suffer.I am fed up with these so called moms who sacrifice their children and only think of themselves.They need to start charging the so called moms along with their boyfriends.IMO both are and both are guilty:furious:
