According to 1993 rules, guidelines for 2nd degree murder range from 7-22 years. State wants an upward departure from that, and would have to prove an aggravator (like the crime is heinous, atrocious or cruel) to do so #MichaelHaim

Agreed. This was posted by a journalist a few minutes ago r.e. the aggravating factors the jury is deliberating. Note the certificate of service date - 3/20/19.

I'm confused. Did the jury have to find guilty on ALL 4 points for the verdict to be "2nd degree with aggravating factors"?

That only impacts the sentencing guidelines and how much time the judge can make him serve. He's been convicted and will serve time. I don't know if the judge can impose more time for each additional aggravating factor, or if it's "one and done". Also the rules now are different than they were in 1993 - local news just had an attorney on who said the aggravating circumstances may allow the judge to provide a sentence closer in total time to what Haim might serve had the crime been committed under the state's current (harsher) sentencing guidelines.

Is he guilty of "second degree murder" or "second degree murder with aggravating circumstances"?
