According to 1993 rules, guidelines for 2nd degree murder range from 7-22 years. State wants an upward departure from that, and would have to prove an aggravator (like the crime is heinous, atrocious or cruel) to do so #MichaelHaim

Agreed. This was posted by a journalist a few minutes ago r.e. the aggravating factors the jury is deliberating. Note the certificate of service date - 3/20/19.Defense was well aware of this as the prosecution did file notice and the judge agreed they did. The judge even brought it up earlier today.

Jury decision on the 4 aggravating factors...the crime:
-was committed in front of a family member - Yes
-was committed during the commission of a tampering w/ evidence - Yes
-was committed in a heinous/atrocious/cruel manner - No
-inflicted severe/emotional trauma on the victim, Aaron, & the victim’s family - Yes
No. That only impacts the sentencing guidelines and how much time the judge can make him serve. He's been convicted and will serve time. I don't know what the standard max was at the time the crime was committed and what the max additional was for aggravating circumstances, however.
