Just tuning in as it was underway so I'm not sure of the backstory here but it sounds like the judge is making an adverse ruling against the state? Is he dropping another charge?

WATCH LIVE: Imprisoned Son Trial — FL v. Timothy Ferriter — Day Six

Florida man Timothy Ferriter is accused of locking up his adopted son inside of a room he had built in the family’s garage. Ferriter faces charges of aggravated child abuse, false imprisonment and neglect of a child. Court records out of Jupiter, Florida show that the door to the room had a deadbolt on the outside, along with multiple other locks. Investigators also found video from a ceiling camera that showed Ferriter allegedly punching, throwing, and beating the son multiple times. When Ferriter's son wasn't in school, he allegedly was locked in the room — only allowed out to eat or sometimes use the restroom.

Tim Ferriter will NOT testify. Defense was successful in get in a jury instruction on the affirmative defense of reasonable parental physical discipline. The jury comes in at 1p, the judge will instruct them, then closing arguments are next.

The law is poorly written, and needs to be changed (updated). It's time to protect children. Justice for RF.

The Defense has rested.

Is the state going to get a rebuttal?

This case is bumming me out. I'm worried the guy is going to get off on some technicality. On the other hand, if he gets any kind of conviction at all, it seems the judge has big latitude for the sentence.

Also, on the "parental privilege" thing.... There's no argument about corporal punishment for the Florida case. The beatings happened in NM. Also, the clause in the charges that referred to physical damage was removed by the judge. So, writing the "parental privilege" piece in the jury instructions may be moot.

Opinion only, today is the first day I've seen him look afraid. Anyone else think this? And, if this is accurate, the fact that this is what it took to get to this point of realization and reckoning is a sad, awful, and tragic shame.

Isn't it ironic how the deliberate insistence to have cameras inside and outside focused on the child 24/7 with the exception of school was precisely what got him (them) caught, even chastising him from a nice air conditioned home through a ring camera for the child's decision to provide his hot and humid garage cell-box with some air.

Imagine if they had remembered these cameras and removed them prior to calling the police and/or LE overlooked that there was once a camera where a hole now stood. This case would be very different, maybe not capable of being charged at all. Thankfully that did not happen. All of this documented video proof exists because of him/them. That's poetic justice.

Yep, is he thinking he should have taken the plea deal of two years in prison and five years probation? moo

Bravo, Bravo, Attorney Coakley!
Magnificent closing argument. Outstanding!!!

The Judge advised her to carry the mic, and she said I never wanted to be a pop star. However, imo, she is a superstar in her industry!
