I'm surprised the State did not call psychiatrists to testify about JS's mental state while in custody. Unless the defense is going to say that JS was insane during the act only.

Well, it's not like she suddenly recovered. She's been mentally ill for years (I think I remember reading somewhere that she was hospitalized for 9 months at one point). The defense has to prove that she didn't understand right from wrong at the time she murdered her children. The interrogation tape provides fairly powerful evidence that she was out of touch with reality (after the murders). But the hardest part is the premeditation thing. I think they'll probably argue that her intent was suicide (which she repeated throughout her interrogation), and that she decided to take the kids with her for whatever reason (fear that they would inherit her disease, fear that they would be embarrassed) that in her twisted mind made evil seem "good."

And she did go off track, but whether that was deliberate or due to the fact that she was impaired is impossible to tell. My impression is that she was being as honest as she could, and I don't know exactly why I feel that way...maybe because she was so messed up and clearly knew she was busted. No matter how messed up she was from MI and drugs (including booze), she knew she wasn't getting out of this one. So she's clearly not stupid.

I also want to add that the detective treated her with respect, from what I heard--will review the interview tonight since I missed a lot today.

It's crossed my mind that with her intelligence and experience in interrogations that she could have been playing the detectives. However, I don't know if she'd been able to do that as doped up as she was. I kinda thought the detective had already gathered info that she'd been a linguist/interrogator -- I think he was the one that brought that up -- I think he wanted to throw it into the interview so it would be there at trial -- to put that seed of doubt about her testimony at the interrogation. Also, it was clear that some of the questions they were asking were to assess her state of mind at the time of the interrogation.

I just finished catching up! Thank you all for a wonderful job. I saw the part where she still had trouble with the stipulation. She was most certainly (IMHO) being passive-aggressive with the judge.

1. She's very intelligent. Heck, learning to speak Russian fluently enough to be a military translator in interrogations isn't very easy. I'm betting she could still speak Russian even in the worst depression ever.

2. She manipulated her situation with doctors and husband so there could be no helpful collaboration so much needed to help the patient and family to deal with the situation. I'm sure PS must have been frustrated with the number and dosages of her medications. When dealing with medications, a spouse might be able to see that she keeps on her schedule, but only if he knows what it is.

3. She was able to state very clearly that she had "been advised to say yes" which was a lot more sophisticated than just saying yes.

I know I'm being hard on her here, but I will listen clearly to the doctors' testimony both in the defense CIC and the prosecution rebuttal. Perhaps they will change my mind.

I just can't get over the premeditation and stated motive. She did say she was sparing them in there as well. Too bad she just didn't spare herself and let her children deal with their anger at her.

Ok..so court in session Friday..are we in agreement? Fav foods; watch trial and and check webslueths? Someone better get a pie ready.

Still not sure of insanity. The premeditation makes me hesitate. In Colorado, we are dealing with James Holmes. He is certainly insane but doubt he will be found legally insane.

As for Friday, we are known for craft beers, but better wait until later in the day..maybe go for some of our famous Silver Grill cinnamon rolls.

Is the part about the stipulation online anywhere? I haven't been able to find it. It seems that it depends on whatever feed you were accessing.

can anyone explain to me what kind of a doctor would listen to a woman repeatedly talking about suicide and then advise he "you better make it on the first try"? Julie said that to the detective and he repeated it back because he could not believe it and I don't either. I want to see this "doc" on the stand...same one that told her 2 drinks okay with meds.

I only got to see it because I had WAT on, and was able to rewind the DVR.
Not seeing it yet on Ytube (Croakerqueen has the day but that part seems skipped over, and LadyJustice does not have the end of the day loaded yet).

I agree with everything you wrote. And the fact that she has taken this to trial makes me think she's not sorry for what she did. If she truly was in sane at the time of the murders, and know is fit to stand trial, why would she want to put Parker and the family through all of this? I would want to do whatever I could to stop any more hurt to Parker and the rest of the family. I think she has mental illness, but knew what she was doing and is responsible and very, very selfish.

I am so glad I spent time watching the trial today because it changed my perception of her in a very radical way. Prior to today I have to admit I was pretty 'open' to all possibilities but the stipulation conundrum was a ruse. The stipulation was put to her prior to the day's proceedings after her late arrival in court (as a result of her leg numbness). Her look and her body language was that of a recalcitrant four year old throwing a hissy fit during a shopping trip with mommy and set the tone for most of the day. When the stipulation was presented again at the end of the day again she balked. Third time she was forced to give an answer and her fake tears of frustration didn't help her cause one bit. To me she didn't look befuddled by the question, she instead looked like a person who was forced to take a different tack hopefully to steer things in the direction she felt it ''should take''. She was hopeful for sympathy and sadly I for one am less sympathetic today after seeing her performance.

Dear Angels In Heaven - this woman is amazingly ''lucky'' or devious -- how can you deek out of a hospital after a MVA without getting a blood test for BAC? Did she sweetly smile and say I am just going out for a cigarette or what LOL

This is the second time in open court, but outside jurors presence, the judge placed the stipulation to JS and she would not/could not answer yes or no as ordered. This angered the judge who made comment about not playing games with her.

Trying to calculate if this is the only way, since it's nothing more than a cut and dry series of events. We'll see some volleyball here - with rebuttal.

Cannot believe the sophomore Defense attorney is asking for an acquittal. Just stick with the insanity defense ( the absence of this current argument could be used to fill paper on the appeal). This is a dangerous trial - she may get off.

I am disappointed in Parker's testimony. I noticed smiling, and some laughter once). In the eyes of the jury, his testimony, his evidence, should be representative of the complete horror and devastation caused by this event. He showed less emotion... given the time that has passed, still, and Parker addressed this in his statement to the media - he needs to ensure "his kids' voices are heard."

She may be acquitted... it is frightening to me- although I am still undecided, and I am sure the jury is in the same place, although they don't have the back of a big 42 inch flat panel tv blocking most of the visual evidence. I am still trying to determine if it merits such a decision. Still more to come... what is the general point of view here, with you guys?

And for sure, I will be here Friday for trial viewing, knoshing and WS discussing.

Watched a little Nancy Grace tonight who discussed this case. NG reported that JS was "lounging by the pool, reading a self improvement book" when police arrived. A blatant lie!

anyone know where a defense witness list is. they will call Parker S and some mental health people but I have not heard mention of them calling this doc that prescribed all the meds???

One of the local Tampa Bay Internet news sites may have it.

WOW - good call on the defense calling Parker as a witness. I think they are well positioned... plus, Parker is military, and he will be emotionless. A jury will not understand this ( I feel we should institute a qualifying exam for jury members), so it will fill in some of the hole the defense is currently resting in. Could be short term, though, we could see a major swing... although seeing is an issue in this case,,, but that's another story, for another day.

I've been looking but can't find anything. Seems like Croaker Queen uses the same feed I was watching today, where at the start of the break they went to a press conference and missed the entire exchange between JS and judge regarding the stipulation.

Lady Justice did not upload anything after the recess for the break prior to the exchange between JS and judge regarding the stipulation.

I'm so frustrated! The only portion I missed isn't available to watch anywhere!! :banghead:

After watching Juan Martinez, his cases were mostly tried in rebuttal. I found it brilliant personally. I am hopeful the jury will get this one right. As far as PS, I think the jury may understand him and his demeanor. Hell. He is living it, recalling it. I will accept however he sees fit to respond at face value.
