TALLAHASSEE — This could be the year the Republican-led Florida Legislature succeeds in enacting a controversial change to the state's "Stand Your Ground" law that prosecutors warn could lead to a flood of self-defense claims and would force state attorneys to essentially try cases twice.

If the bill was already law, for example: In the recent high-profile case of former Tampa police captain Curtis Reeves, rather than requesting immunity from prosecution for allegedly killing Chad Oulson at a movie theater, Reeves wouldn't have had the pressure to explain himself before trial.
Rather, by Reeves asserting "Stand Your Ground," Hillsborough County state attorneys would have had to show evidence "beyond a reasonable doubt" — the same standard required at trial — of why Reeves should still be prosecuted. As happens now, a judge — not a jury — would decide whether the case advanced to trial.

Since Curtis Reeves doesn't qualify for a "stand your ground" defense, now it looks like he won't be going to trial for another year (from November 2017), or longer.

So, I can't remember, but is he still under home incarceration? Or was he removed to the jail?

There is another Pretrial Conference scheduled for 9 AM on Feb. 15, 2018, but that was scheduled before Reeves' attorneys filed their appeal with the District Court of Appeals objecting to the trial court judge's decision that Stand Your Ground defense did not apply to Reeves.

Now, the trial court proceedings are stayed pending the resolution of the issue on appeal. Reeves' attorneys want the Court of Appeal to rule (issue a writ of prohibition) that Reeves can use stand your ground, based on some new changes to the stand your ground laws that his attorneys believe qualify him for that defense.

So, unless the Court of Appeal acts quickly, I guess the Feb. 15, 2018 pretrial conference will be postponed.

Replying to my own post. Yes, he is still under home incarceration. If he were not, things would not be proceeding at a glacial pace. Home incarceration is preferable, I am sure, to the alternative -- life sentence in prison. (IMO)

That legal quandary has stalled cases across Florida as prosecutors, defense attorneys, and judges wait for clarity from the appellate courts. Meanwhile lawyers keep filing appeals, including for at least four defendants in Tampa Bay.
"Now we’re in a position where we have to figure out how to wade through this confusion and gridlock," said Hillsborough State Attorney Andrew Warren. "It’s a waste of taxpayer money and it disrupts our system when we don’t have consistency."
The fate of those defendants — many of whom are accused of taking a life — could ultimately be decided by the state’s highest court.

In March, before the new "stand your ground" law was enacted, Reeves’ lawyers argued in a two-week hearing that their client acted in self-defense. The judge denied his claim.
Now his lawyers are appealing that decision.
If a higher court doesn’t rule in their favor, said defense attorney Richard Escobar, "I believe it’s clear that Mr. Reeves is entitled to a new ‘stand your ground’ hearing because of the change in the law."

Thanks so much, SeesSeas, for keeping a close watch on this case for us. There may be a further delay if Reeves' asserted retroactive right to a new "stand your ground" hearing now has to be decided by the Florida Supreme Court. According to the article you posted, the two courts of Appeal did not agree on the retroactivity issue. Confusing, but inevitable.

I can't believe it has been four years since this stupid and senseless act was committed by Reeves.

Pinellas-Pasco Circuit Judge Susan Barthle has set a trial date of Feb. 25, 2019, in the case of Curtis Reeves, the retired Tampa police captain whose shooting of another man in a Pasco County movie theater.

Barthle set the date at a Tuesday afternoon hearing, declining a defense attorney’s request to hold off.

Sheriff Bob Gualtieri held a press conference today and provided the media with the facts surrounding the shooting that killed a man outside a convenience store in unincorporated Clearwater yesterday.

During the press conference, Sheriff Gualtieri outlined the subjective standard set by the Florida Legislature that precluded the Sheriff's Office from making an arrest by Florida State Statute under the "Stand Your Ground" law.

UGHHHH. Backwards and backwards to "Wild West"-style of settling scores. Don't like someone? Pick a fight and then kill them when they start kicking your rear end. Thanks, Florida. It's not enough, apparently, that we're already swamped in violence and hatred and on the brink of civil disorder. Now we have to make it easier and legal for certain people to kill people they claim to fear, regardless of their own culpability. IMO it's sick and overwhelmingly benefits people who already have the most advantages when it comes to the "justice" system.

Man, I am clearly culturally different that some of the people in the U.S. In my mind humanity always outweighs 'property'. Empathy outweighs fear. What is wrong with this world? :mad:
