A circuit judge has denied William Robert Wiggins’ request to withdraw a plea agreement signed in April in exchange for his testimony against his brother, who is charged with three counts of first-degree murder in a 2020 triple homicide in Frostproof.

The prosecution has filed paperwork with the court showing they intend to pursue the death penalty against TJ Wiggins if he is convicted of the murders.

If he were to go to trial and be convicted of the accessory charges, each count is punishable by up to 30 years in state prison and a $10,000 fine, according to Florida statutes.

Robert Wiggins remains locked up without bond in the Polk County Jail awaiting his brother’s trial, which has been delayed until he has been tried in a Tampa federal court on charges stemming from possession of ammunition by a convicted felon.

The defense and prosecution argued for and against the motion to withdraw Robert Wiggins' plea agreement during a hearing Dec. 4 at the Bartow Courthouse before Circuit Judge J. Kevin Abdoney.

Assistant State Attorney Mark Levine told the judge he objected to the defendant’s motion to withdraw his plea agreement. Based on the evidence, he said there was no good cause for the judge to use his discretion to grant the withdrawal.

The prosecutor then said to the judge that should Robert Wiggins remain incarcerated for eight or 10 years then the situation would become "ridiculous" and such a situation may be more in favor of the defendant. But Robert Wiggins has not been at the county jail for five years so far – the prison term he had agreed to serve.

Abdoney did not find, based on the hearing, any good cause to withdraw the plea agreement even though TJ Wiggins' trial has been delayed multiple times. So he denied the motion without prejudice.

8/16/24 Update: For all the above charges. While Wiggins awaits trial in U.S. Middle District of Florida Court in Tampa, a status hearing was held Friday in Bartow on his & several other pending death penalty cases winding through the 10th Judicial Circuit Court. After his case was schedule for its next status hearing on 12/13/24, the judge & attorneys continued to schedule hearings on several other cases, when a bailiff walked over to Circuit Judge J. Kevin Abdoney for a sidebar conversation. Abdoney then told the defense & prosecution lawyers assembled for the Wiggins trial to go back to the case because Rollins wanted to address the court & he had a right to be heard. “I just can’t understand what a gun charge has to” do with the Polk County case, Cyril Rollins said. The defendant is charged with "murdering three people,” he said “And they’re worried about a gun charge. It don’t make sense to me.” Abdoney then confirmed with Assistant State Attorney Mark Levine that Rollins had been told multiple times that the federal court proceedings come before state proceedings. “They basically win every time, in terms of getting custody of the defendant,” Abdoney said. “Mr. Rollins, I am just as frustrated as you are.” In two separate federal grand jury indictments, Wiggins was first charged with possession of ammunition by a felon & then charged with unlawful transport of firearms, which are both felonies. Court records show the federal trial is anticipated in September. The defense has waived Wiggins’ right to a speedy trial through 10/31/24 & motions such as one to suppress evidence remain pending. Judge Abdoney told Rollins that once Wiggins is returned to Polk County, a trial would be likely early next year.

*William Robert Wiggins (21/now 25) – Plead guilty to a plea deal. Will only serve 5 years in prison & 2 years probation. Will testify against TJ. Status conference hearing on 12/4/24.

I had in my notes that TJ's Federal case was supposed to go to trial on 1/8/25 but just looked at Judge Lemmons' calendar & he is not on there or thru 1/31/25. So do not know "what" happened....

*Status Hearing (@ 8:30am ET) - FL – Damion Allen Tillman (23) Keven Michael Springfield (30) & Brandon Cyril Rollins (27) (July 17, 2020, Frostproof) - *William "Robert" Wiggins (21/now 26) TJ's bro arrested (7/21/20) & charged (7/23/20) with 3 counts of accessory after the fact of a capital felony & 1 count of tampering with evidence. $15K bond for accessory & $1K for tampering charge & charged (7/23/20) & indicted (9/30/20) with 2 counts of nuisance injurious to health. Plead not guilty. Bond $45K accessory ($15K for each count), $1K for tampering & $500 ($250 for each count) for nuisance. Bonded out, all Surety bonds @ $46,500 on 8/7/20. Violated bond conditions, back in jail 8/20/20. Bond denied (7/27/21) & denied bond (4/18/22). Polk County
Trial was set to begin on 5/20/24 was cancelled due to peal deal & plead guilty to all charges. Will serve 5 years in prison & 2 years probation [will be sentenced after TJ’s trial]

I have TJ on 2/14/25 with all his cases & the 4 firearms charges on 2/4/25 & I have kept checking his Federal case where the trial on 1/8/25 was cancelled & nothing new.
