Supposed to be a case management hearing at 10:30 but no sign, anyone know anything?

KM plead not guilty. Set trial for end of Feb.

SG's lawyer brought up the indigent issue but judge said he never saw a copy of the motion. It had not been sent to his office, so he could not rule to it. Another case mgmt set for him next month.

KM sat with her back to SG - they were about 4 feet apart. She looked at him once out of the corner of her eye.

Thank you for the update! I'm actually surprised they brought them into the courtroom together. I was thinking they would keep them separate. Interesting that she wouldn't look at him. Probably because she's going to flip on him, and he knows it.

At at one point SG turned around and looked me in the eye. Ooof!

1. as someone said earlier, this is a game of chicken right now. both sides are just trying to get the best deal for themselves, but a deal will come IMO.
2. it's every man (or woman) for themselves now.
3. i have to believe that the alleged masterminds are being watched by LE 24/7/365. LE probably considers them a flight risk. but my guess is that their highly paid attorneys are reassuring them not to worry and that everything will be just fine - and they'll reassure them right up until the bitter end - and that they are narcissistic and arrogant enough believe it.
4. news of any arrest(s) should come before the news of any plea deal.

Another source of leverage prosecutors often apply is to put pressure on the man to make a deal that includes leniancy for his wife and children's mother.

Poor SG. You gotta feel for him a teeny tiny bit. He just can't seem to get anything to go his way.

If I'm not mistaken, and I may be, I recall on their jail phone call that he wanted her to ask his mother and cousin for help. (When she was living alone w/the children). I wonder if SG's momma has the kids.

Chief Assistant State Attorney Georgia Cappleman said she would like to strike a deal with Magbanua similar to one made with former defendant Luis Rivera that led to her arrest.
At this point, Magbanua’s attorneys, Tara Kawass and Christopher M. DeCoste, are “indicating that she’s wanting to go to trial and not willing to waive her speedy trial rights at this time,” Cappleman said.
That may change in the future, she added.
Cappleman said before Magbanua was arrested Oct. 1, prosecutors gave her the opportunity to tell them what she knew. She declined.
“I would be interested in hearing a proffer from her,” Cappleman said. “I hope it could potentially implicate other co-conspirators that have not yet been indicted.”

I’m not sure KM would qualify for Federal Witness Protection, but she may qualify for protection by the State of Florida:

914.25 Protective services for certain victims and witnesses.—
(1) For purposes of this section, the term:
(a) “Victim or witness at risk of harm” means a victim or witness who, as a result of cooperating in an investigation or prosecution of a serious felony offense, has been subjected to violence or other forms of intimidation, or who is the subject of a substantial threat to commit violence. The term also includes a member of the victim’s or witness’s immediate family.
(b) “Serious felony offense” means one of the following offenses, including an attempt, solicitation, or conspiracy to commit one of the following offenses: murder, manslaughter, sexual battery, aggravated stalking, aggravated battery, carjacking, home invasion robbery, burglary, arson, robbery, kidnapping, racketeering, or trafficking in a controlled substance.
(2) A law enforcement agency is hereby authorized to provide protective services, including temporary relocation services, to a victim or witness at risk of harm. Protective and temporary relocation services, as deemed appropriate, shall be provided pursuant to the provisions of this section.
(3)(a) The statewide prosecutor, any state attorney, or any law enforcement officer may identify a victim or witness as a victim or witness at risk of harm. Upon such identification, the statewide prosecutor, the state attorney, or the law enforcement officer must notify either the statewide prosecutor or the state attorney who has jurisdiction over the criminal investigation or prosecution, if necessary.
(b) The statewide prosecutor or the state attorney, as appropriate, may determine whether an identified victim or witness at risk of harm is critical to a criminal investigation or prosecution. If the victim or witness at risk of harm is deemed critical, the statewide prosecutor or the state attorney may:
1. Certify that the victim or witness receive protective services; or . . .

Thanks. You are correct. I read a bit more about it, and should have posted. I was not even aware that there was a Federal Program vs State Program. In addition to meeting the requirements, the State Program is newer and has problems. It only helps the testifying witness for a short time after the trial. CA has just gotten some money to make theirs better.

The Federal program began in the 70's (1971? I think) by someone by the name of Shur or Scher because they needed mafia to testify against their bosses. No one really expected it to work but it was a great success. But the Feds have a lot of money. When the witnesses have to serve some time before relocating, they are put in special prisons and isolated.
By all accounts it is very difficult to start over in another life and some people leave the program. Some have been killed as a result.

The important thing is to have birth certificates, passports, doctor's records, social security numbers, all matching the new identity. Children's school records, etc. I understand that providing housing and money to live is expensive, but it should not be so expensive to just provide the new identity.

I also read that the internet has made everything more difficult.

On the other hand, CA's abilities to mastermind a hit are lacking, and easier to evade than the mafia

When the news first came out about Daniel Markel, who could have imagined that this woman, would be the face in the paper associated with his murder?
The alleged payment for that crime, like a pair of balls and chain that proceed her every step ?
speculation, imo.

Prosecutors told the judge Friday they believe Charles Adelson paid for Magbanua to get a breast augmentation in October 2014. That's about three months after Markel's murder.

They told the judge a witness claims Adelson paid half the cost of the $6000- $7000 procedure.
"If Charlie Adelson paid for it, that would be very significant in a homicide investigation where there's a conspiracy between him and Miss Magbanua," prosecutor Anna Norris argued.

I had the same reaction. Also, if you are going to obtain financing for a breast enhancement from a man you're sleeping with, please insist on 100%. Baffles me that it was negotiated.

I immediately noticed KM looked very 'perky' too lol. And I've also wondered why CA only paid half (allegedly) of the boob job. What's up with that?

Regarding the bond hearing for her on Friday.....I'm sure she'd really like to be home with her children for Christmas. Would granting a reasonable bond be part of a plea deal maybe?

Tough call when kids are involved and especially during holidays, wondering if it would even be safe thing to do for all involved, especially KM.
imo, speculation.
