I hate having to do this but I missed some of today’s testimony. Can someone quickly explain about the live streaming issue? TIA.

They found out after the fact that at least two of the witnesses had been watching each other's live stream of the trial. I *think* they said they were watching each other. That part I might have misunderstood. So they are going to let the attorneys have tonight to "figure out who" and then they will talk about it at 8:30 tomorrow morning.

Where was the legerdemain? The "stapled" money backed up by an old girlfriend and received by LR for his part in the hit?
In the trial I have been watching so far it doesn't look good for all three of them, CA/SG and KM.

I kinda got lost at the end (partly because I was listening on my phone when I left my house to go buy wine), but I believe the defense poked some holes in what Rivera said about SG and KM being in communication during the murder trip (or maybe the June trip?) They were able to say that SG and KM were not in "constant contact" as Rivera asserted. But I probably missed some stuff because it was so very tedious.

Oh wow! They should have known not to watch especially since witnesses aren’t allowed to be in the courtroom to hear testimony. I certainly hope it won’t cause a mistrial!

ETA... I realize that sounds a bit naive but still...

Rivera has testified over 9 times. that's a lot of times, a lot of information over a very long period of time, for events that happened a long time ago. i don't think the jury or any reasonable person would expect it to be 100% flawless. i think the star witness Rivera came across very, very, very credible.

A violation of court rules has been spotted multiple times. People who are to be called to testify have been watching the live stream and speaking with one another. Specifically the Adelson Institute employees were seen doing so today. Not sure if any action is being taken.

I think June definitely watched it. Her expression when they started to talk about the stapled money gave that away. Not to mention her rambling about being mad at Charlie before the question was even fully asked. Not sure about the other two. Erica, probably. Not sure about the first lady....the one who seemed intoxicated.

I wasn't following closely either (got boring) - but yes, I think KM's team scored some points. I could be wrong but this is what I got:
1) Corbett conceded that he couldn't say that the phone communications btwn KM and SG and btwn KM and CA during the July 18 time period were unusual/out of the ordinary for them.
2) Corbett also said there was nothing in the phone records to support LR's claim that SG was on the phone with KM before noon on July 17th (the alleged call when LR said they saw the lady with the kids on Trescott).
3) Corbett conceded that cell tower information for KM's phone on the morning of July 19th - i.e., going towards CA's home -- is also near or in the direction of KM's brother's home.
4) Corbett acknowledged that the prosecutor failed to bring out on direct that the July 19 records show a call first from KM to LR and then from LR to KM -- meaning LR was wrong when he (apparently) said that he did not call KM.
5) This part I'm really not sure about but I think KM's attorney's brought out that the alleged July 19th KM/LR phone communications were NOT with the phone number associated with LR's phone, rather it was with a number that was one digit different than LR's number.
Also, it seems KM's attorneys plan to bring in text msgs btwn KM and CA that seem to indicate that there was at least one direct communication btwn SG and CA (I guess supporting KM's theory that CA could have hired SG directly).
Not saying any of these points are earth shattering and perhaps some of it will be cleared up on re-direct. Feel free to correct any of the above that may be incorrect! JMO.

I've been listening to Rivera's testimony and oh boy! I already knew a lot about this case because I watched Dateline (or 48 hours) and I remember back then thinking how stupid they were. And watching Rivera's testimony he just seems so detached. He couldn't even remember the victim's name at the beginning of the testimony. And renting a car, staying in a hotel, posting on social media, I mean how frikkin dumb do you have to be??? Geez! He doesn't seem to care that he's in prison - he seems so relaxed! I just don't even know what to say about him.

Am always surprised how stupid criminals can be. Hello? Cell phones are easily, traced and followed. Thank goodness for LE, criminals will continue to use cell phones while committing crimes.

DM's motion to prohibit DA from unsupervised contact with the kids was filed at end of March. Per the state's case that was the final straw.

IMO it was a strong moment in Det. Isom's testimony when asked, why did a court never rule on that motion? "Because of his death."

Is the silver Nissan they were driving on the first trip to Tallahassee similar model to the car Jeff Lacasse said he was driving at the time he was dating WA? Think the car model he drove was a question from the jury.

Regarding #4, I'm not sure Rivera said definitely SG called KM after the murder, just that they talked. I remember him being asked and being unsure, but maybe he eventually gave an answer....

One thing: #4 deals with calls on the payment date (July 19) btwn LR and KM -- not the 12:30ish SG/KM call the day of the murder (July 18).

Hi friends, I received several questions from friends this week about why Prawfsblawg is not covering the trial of those (thus far) who have been charged with the murder of our blog's founder, beloved leader, colleague, scholar and teacher. We have posted about this decision in the past and I thought I'd reiterate for those who were unaware. We at Prawfs made a decision shortly after Dan's death that this blog, one of Dan's great legacies, will continue to celebrate his life and his love of all things scholarship and legal academia. We decided we would not cover the circumstances of his death and the investigation and the ongoing legal process related to his murder. A friend wrote me today that he was unaware that this was a deliberate collective decision and that he felt it "might be a good post on Prawfs to explain what otherwise might seem as silence on the issue."

So there you have it. I can personally say that I have been glued to the live viewing of the trial that started last Thursday and am following all the coverage. In the past two days, I basically haven't been doing much else other than following the trial and teaching my classes. And I miss our friend every day."
