The odds that one person on a N Florida jury would hold the view that "the government" is somehow an evil entity that is designed to oppress and defraud are not low. DeCoste is basically trying to change the state from the good guys seeking justice to the bad guys who are arbitrarily throwing around their power to crush innocent people. Total BS IMO but if you can make that narrative stick with one person--mistrial.

Again DaCoste is fibbing here - Rivera never said they were smoking marijuana in the car and there's no way for Trooper Downing to smell cocaine. Maybe he could smell alcohol but he may just have been phoning it in that day. And if he didn't get close to Rivera's face, he wouldn't smell it. Either way, this misleading of the jury is bad for defense.

Whatever the reason, that trooper is probably still here with us because he didn't ask any questions of them that day. I have to believe that Rivera wouldn't have hesitated if it had come down to it.
That trooper would have smoked em both. They don’t play. Problem would have been solved and Danny would be alive.
