ETA, I thought he said death????

I registered, and step 2 said death, then step 3 said aggravating was not greater than mitigating. But he never said life without parole so sorry about that guys.
So did i, thought they said DP!

I'm disappointed I think he should have gotten the death penalty. This was cold, calculated premeditated murder. Plenty of people have terrible childhoods, they don't murder people.

So LWOP - Not surprising! I think that's the appropriate verdict. Now we'll find out what the poll was on the KM verdict. Hopefully the judge will ask before he dismisses them.

The jury only completed the aggravating and mitigating factors form and found the state proved 3 out of 4 aggravating factors, so I think now it goes to the judge for formal sentence, which I think has to be life, right?

that's what I understood ... may be wrong

Actually I think I/we were wrong.....I think only one aggravating factor has to be proven, and it was (3 were), so it can be death. Since one was proven there was no need to go into mitigating?

Jury found State proved one agg factor beyond a reasonable doubt -- cold, calculated premeditated -- but that the mitigators outweighed that, therefore it is LWOP. It is not a recommendation. It would only be a recommendation if they came back with Death, then judge could still over rule and give Life.

I'm interpreting this to mean that jury did not find that the state proved the other claimed agg. factor -- for pecuniary gain -- beyond a reasonable doubt. If not for pecuniary gain, then why did he do it? KM? JMO.

State only argued 2 aggs. They dropped 2 other aggravators and never argued them to jury when judge indicated they were not applicable under case law.

Not understanding at all, I was hoping that before the jury was released they could be polled on the other case. But I guess it's too late. The only way we will find out I think, will be if the jurors tell the state?

My Law & crime feed has just gone blank. I would expect the state to do a presser afterwards, and sometimes they do jury pressers but it wasn't mentioned by the court they were going to do one. If anybody see such please post a link.
