TaxProf Blog: More On The Arrest Of Charlie Adelson In Dan Markel's Murder
6a00d8341c4eab53ef027880794be4200d-300wi

''The arrest of Charlie Adelson came as a surprise to many. Observers of the Markel case have been pushing for one or more of the Adelsons to be arrested for years, but State Attorney Jack Campbell and the lead prosecutor on the case, Georgia Cappleman, have resisted such calls, also for years—until now. What changed to prompt Charlie Adelson’s arrest? Might there be new evidence in the case?

<modsnip>
Charlie isn't aging well at all, is he? It's a huge contrast between the smiling, well-groomed dentist of a few years ago and the disheveled, bushy-haired and wild-eyed prison inmate today. Could eight years of constantly having to worry about being arrested have had this kind of an impact?

She wasn't seen driving by the house on the day of the murder. She couldn't as the street had been taped off. But she was near enough to see police activity. Her excuse for being in the vicinity was to pick up a bottle of Bullit from her former neighborhood liquor store. (Even though there was another store located closer to where she lived (separately from DM), and closer to where she was joining friends for lunch.)

Sorry I don't think you are correct. The House in Trescott drive was taped off at the front. The Street was NOT taped off. She said in court or in a statement prior she drove down a street (one intersecting with Trescott DR ) , saw the incident tape and drove off.

However a LE officer when told where she said she got to , he said she could not possibly see the incident tape from that position. So she seems to have perjured herself . Driving much closer to the house and doing a three point turn seems more likely.

LE Always put an officer out on the street noting number plates (US - Tags) and car types that appear to be doing a turn around for just this reason . Ie criminals may well send someone to report after a violent incident , even sometimes the perpetrator. I imagine LE have Wendi's car cold on this but GC is not going to say that in the first trial because her job is to nail KM and SG to the wall and keep WJA for later .

Wendi was supposedly GC's witness in KM's trial - if you annoy or frighten the witness, they will plead the 5th immediately (Indemnity or not ) That was half the problem.

We'll see if Markus delays, delays, delays the process now that his paymaster is rotting in jail - like they made KM rot for years.

I'd say Donna Adelson has a very strong reason why she'd want CJA bailed and his trial to proceed as fast as possible - so he does not decide to do a deal and take her with him . Would the justice system bail CJA with the condition of an ankle monitor and daily or two daily reporting ? it 's a risky proposition since FL is so close to international borders.

KM is a different kettle of fish in terms of delay. Her realistic sentence after time off for good behaviour would be about 8,5 years or so. She's already done 6.5 in lock up. If she got convicted tomorrow, Donna could arrange for appeals to go on for a couple of years just to keep KM happy.

Charlie's prospective sentence is much longer. Delays assume something will change in the future like a new SA not wanting to spend more state money on prosecution. Would you pay D O Marcus legal fees month after month to think up new delays based on such a vague future outcome ?

Who woulda thought that a defense attorney could keep himself busy just representing dentists accused of murder?

"Three attorneys who represent Rudolph—David Oscar Markus, Margot Moss, and Lauren Doyle—slammed the 'outrageous prosecution' against the dentist in a statement to The Daily Beast, whom they said, 'loved his wife of 34 years and did not kill her.'"

I have a collection of true crime books in which the murderer is a dentist. I have been collecting for more than ten years, but only have five books so far.

The crime of First Degree Murder is a Capital Offense in Florida and only has two possible sentences: Death, or; Life without the possibility of parole.

Possibly a dumb question, but I will ask anyway.

CA's indictment lists CA and KM as co-defendants. Does this mean CA's trial is already set for May 16?? Or doesn't that mean they have to be tried together?

So you think she actually drove down Trescott and turned around before the driveway? Wow. Then that is interesting.
Did she say why she turned around?
I'm sure (or so I hope) they have phone records showing she called CA after tha

I’ve wondered - would Katherine have ever been allowed to cooperate with Georgia Cappleman - or would her attorneys never allow/advise her speak with them? Wondering if she has any control at all? Does she have to fire them in order to cooperate?

KM was originally offered a full immunity deal in exchange for ratting out the alleged mastermind(s) but she refused the deal on the advice of her "independent" attorneys. Who is paying her attorneys? Who are they really working for? Who is directing them? Penthouse One?

It's been way too many years for my memory....
but I recall something about a downed tree because of stormy weather. I found a 2016 news article about the downed tree.
I also recall seeing a photo that showed the road taped off further away from the house because of the tree damage, but did not yet locate a photo.

Wendi Adelson drove on Trescott Drive around noon the day Markel was shot. She said she thought the road, which by that time was cordoned off by crime scene tape, was closed because of a downed tree.

She went around and bought a bottle of Bulleit Rye Whiskey from the nearby ABC to take to a party later that evening.

Before that, she said she had been working at home after fielding the TV repair man that morning.

I'm not going to map it, but I think this aspect of the case against Wendi would be more solid if it could be shown that the route she intended to drive, past Dan's (her former?) house, made no sense in navigating around, ie would never be recommended by google maps, or didn't save a tricky left turn into traffic, etc.

So even though they are listed as co-defendants on an indictment, that doesn't mean they are being tried together?
To me, that makes no sense for the prosecution. They already had a hung jury because the mastermind had not been convicted. They need to try them together to show she was essential to the crime, or get her to agree to testify. Perhaps this move is part of that plea dealing.

Also, I would think now they have new evidence, there's going to have to be more process of discovery and the defense and prosecution needing extra time to prepare their case to accommodate it.

She does later on discuss this in the interview, after the victim advocate enters. She talks to the detective, asks him the prognosis, is he awake, etc. She says she thought maybe she should take the boys to see him if he is awake. But this is much later. She really stays there a long time and talks. A lot.
She does talk a lot and seems quite willing to help. It could be to throw suspicion off of her…

Re Wendi, has anyone verified with Best Buy whether the Geek Squad actually did visit her home that morning? If not it doesn’t totally exculpate her but it lends truth to the story that there was a TV repair involved, however dated that seems. But if BB/GS has no record of such a visit that’s hugely damaging to her.

I believe that was verified.

Funny, her being a lawyer and all - lawyers usually tell their clients to say nothing and contact your lawyer asap.

Too bad her brother and mother didn't do the same, she must have advised them during their alleged conspiring to not get a lawyer, talk to police a lot and try to be as helpful as possible. Maybe if they'd followed her advice, Charlie would have outsmarted police too.
