Tara Kawass said that 1) KM is not involved in the killing of DM and 2) Sigfredo Garcia hates Charles Adelson.
SG defense lawyer Saam Zangeneh also amplified that Garcia hates CA.
Hence, it made no sense that SG would help KM’s boyfriend CA commit murder.

In this line of reasoning, both Kawass and Zangeneh are implying that SG and KM must be innocent.

In the second Magbanua trial, Tara Kawsass said that SG and CA are friends.
And, SG and CA conspired to commit the DM murder unbeknownst to KM.
My own view is that the Defense had absolutely no intention on putting Katie on the stand. They got a hung jury the last trial by catching the State off guard by having Magbanua testify. This time their surprise ace in the hole was Sigfredo Garcia who was going to get up their and tell the world how Magbanua was completely innocent and it was him and Charlie that planned the whole thing. Probably by calling each other on burner phones.

So the Defense opened with "the burden rests completely on the State. But we are going to do something different. We are going to prove to you beyond ANY doubt that Garcia and Charlie Adelson hatched this plan behind Katie's back".

Now look at the Defense's case: they recalled Isom and asked about Charlie's mechanic being in Garcia's phone and Adelson's phone. State nipped that in the bud on cross. They called Charlie Adelsons friend who confirmed that Charlie stapled bricks of cash. Then they called Jason Newland who then confirmed that the reason they never got Rivera's instagram was because those records are lost if they are not retained within 7 days while Rivera's statement was 2+ years after the fact. Then they throw Magbanua on the stand who gets completely annihilated - not only on her prior testimony but most importantly - it allowed the State to piece out and replay and interpret all the most incriminating parts of Dolce Vida and ask KM directly.

Despite some appeals to emotion, the Defense in this case was a complete embarrassment.

And this is all because, again my opinion - they were caught on those jailhouse calls going through dress rehearsal of exactly how Garcia should perjure himself to help Katie.

Should be an interesting ineffective counsel appeal. "Uhhh, my attorneys and I were planning on totally lying but then we got busted in dress rehearsal so then we were stuck with nothing."

Spectating drama were going on in the courtroom. Unfortunately, it appears that we do not have members of the Association of Teachers of Lipreading to Adults (ATLA) at WS. Some fascinating non-verbal cues are going on in this “Wendi Adelson Arriving to Court, waiting in Courtroom” video:

1. At 8:23, DM’s mother is seen standing while her infamous ex-daughter in law Wendi WA is seated two rows before her.
WA sat in between a female (could someone please identify who is she, Grace A. Crawford?) and famous criminal defense attorney John F. Lauro.
The female attorney wears the same color outfits as WA: black and grey.
WA wears the same clothes as two years ago. These are some intriguing clothing choices for a woman.
Then, some “muted” conversations go on among WA and her lawyers.
Please, kindly translate if you knew how to read lips!

2. From 9:12, Kawass the younger is seen “mouthing” to Kawass the older something to the effect of “look who is behind you.”
Then, both looked back at 9:22.
Behind them were WA and her lawyers. DM’s mother was further aft.

3. At 9:45, KM entered the courtroom, walking with confidence.

4. At 10:09, WA’s animated conversation with one of her lawyers continues.
Mama Markel rejoined her seat behind them.
It seems the female attorney paid more attention to the bench of the defendant and her team than to WA.
The arrival of KM has created some palpable tension at her side of the bench.

5. At 11:30, some tense communication happened in between Tara Kawass and DeCoste.
The Kawass sisters’ facial expressions are somewhat displeased.
Then, DeCoste is seen “talking” to someone in the direction of the State Attorneys’ bench side.
DeCoste is making a relatively long talk but unfortunately still in the “mute” mode.

6. At 12:21, Papa Markel enters the courtroom, greets some friendly people, and joins his wife behind “dear Wendi” and her lawyers.

Mama Markel is a prudent person. Albeit she is wearing a face-mask, perhaps concerned about Wuhan coronavirus, she covers her mouth with her hand when she speaks!
Mama Markel is aware that potential lipreaders could be around!

7. It seems that at 13:25 “…. give me the bottle of water” so sayeth Wendi J. Adelson, Esq.
Her female attorney companion obliged.
Then the video froze.
The frozen facial expression of Wendi looks like a preternatural mare, an evil incubus that would give anyone with clean conscience a lot of nightmares.
I cannot help noticing that albeit Wendi displays beauty and charms at times, she really looks evil most of the other times!

Really hope these phone calls get released someday. I still think Siggy would have been shredded on the stand if the plan was carried out.

It is my “informed speculation” that:

1- Tara Kawass wanted Sigfredo Garcia to testify while the “recordings of her phone call coaching” SG are not admissible to be discussed during testimony
2- Georgia Cappleman welcomes SG’s testimony provided that the “recordings of her (Kawass) phone call coaching” will be discussed during cross examination
3- The Judge ruled that some of the “recordings of her (Kawass) phone call coaching” are admissible, and
4- Tara Kawass backed down, abnegating her authority to procure SG at the witness stand.

The judge ruled that the Kawass/Garcia jail house calls were inadmissible because they were protected by the work product doctrine. He said he would allow the English portions of the Magbanua/Gaarcia calls to be used. BBM:

"The first issue was regarding the admissibility of dozens of recorded jailhouse calls by convicted hitman Sigfredo Garcia, recorded over the past week, following jury selection. Some were between himself and defendant Katherine Magbanua, and others were between himself and Magbanua’s attorney, Tara Kawass who was “preparing him to be a witness” on her client’s behalf.

Kawass argued that these calls should be kept from the jury and prosecutors alike, as they represent her “work product” and “defense strategy.” Assistant State Attorney Georgia Cappleman argued that there’s no attorney-client privilege and no expectation of privacy for these conversations, citing case law affirming that the definition of work product doesn’t include witnesses, and that code expressly requires defense attorneys to disclose to the state any statements by witnesses. However, Wheeler ruled that calls between Kawass and Garcia would not be admissible.

The calls between Garcia and Magbanua are another story and include a substantial amount of Spanish or Spanglish that require translation and transcription. To Wheeler, “it’s too late in the game” and “too prejudicial to the defense” to include the Spanish language calls, but the conversations in English would be allowed."

How dishonest are these criminal defense lawyers such as Kawass sisters and DeCoste?

1) "SG and CA are friends" and 2) "SG hates CA" are two statements that could not have occurred at the same time. Hence, Tara Kawass lied!

If it were a witness doing that, would it be a perjury?
Are these lies and other similar inconsistencies proofs that KM committed perjury (Kawass is her lawyer)?
Lawyers are not sworn in with the bible at the start of the trial. They have never attested they will tell the truth or if they tell anything it is their "client's truth". So in general an attny can never be prosecuted for perjury (except at their own trial). Presenting false documents to the court is another matter.

IMO - DeCoste and Kawass put KM on the stand for 2 reasons -

1. for KM to gain sympathy from the jury. it actually worked in the first trial.
2. to help protect the alleged masterminds from any future possible damning testimony from KM. now that KM has testified twice that she was not part of and didn't even know of any plot, it taints any possible future KM testimony against the alleged masterminds.

who is paying DeCoste and Kawass? what do they GAIN? who benefits?

Mentour Lawyer's strongest point in that video is that the defense showed no fear that Wendi would accuse Katie of being a blackmailing mastermind. There's one explanation for this lack of fear: Mutually assured destruction. Wendi and Katie can each bring the other down, but the response will convict the accuser too. If Wendi were not involved, Katie's defense would not have had the confidence to allow Wendi the opportunity to accuse Katie.

Still, it is my hope someone could review the YouTube video and read Kristen Kawass' lips.
The Judge said "Juror number 5, is this your true verdict?"
Then, Kristen Kawass moved her lips.
It is possible she just said some swear words such as "F ... you!"
I am suspicious of something else, though.

The indictment shows his birth date as 10/27/1976. See the document shown at approximate 4 seconds into the following video. Charles Adelson is currently 45.
