GUILTY FL - Derek Rosa, 13, charged as adult in stabbing death of mother Irina Garcia in her sleep, 13 Oct 2023

  • #561
He reminds me of Philip Chism who stabbed his young teacher to death for no reason, even looks like him.
No remorse, no conscience. Just a mad killer. When he gets out, possibly in ten years, look out.
This evil seems unexplainable on a human level. JMO.

Will we ever know why?

It's a fascinating psychological question, because he had such a childish mind, obsessed with violence and thinking that showing it to others was the thing to do. He showed a violent video to his girlfriend, for goodness sake.

No care regarding how others feel. Maybe he is empty inside. No sense of self or of understanding others. Maybe violence actually made him feel... something?

There are anti-women/mother, anti-parent, pro-violence influencers out there posting their content for kids and teens to see. I believe his actions are the worst result of this kind of thing. Because not all teenagers have really developed empathy yet.

He reminds me very much of D4vd---the macabre popstar who is under suspicion after his 14 yr old girlfriend's remains were found in his car trunk.

He writes very gory, obsessive song lyrics and wears bloody shirts onstage, with flowered caskets around him. And the fans loved him, thought he was speaking in metaphors, or figuratively, but now we know he was quite literal when he spoke of 'Romantic Homicide" ---title of his album and hit single.

Waiting for FL v Derek Rosa status hearing, this guy before him was sentenced and.........apparently passed out. They called for medical help, cleared the courtroom, and now the Rosa hearing is moving to another courtroom.

I still don't understand what his motives were. What happened?

Why do I think that he will do this again? No one is safe around him.

I feel sorry for his sister. Once he gets out she’ll live in fear for the rest of her life.

Me neither. Either he was obsessed with stabbing someone (as his interests indicated) and his mom was the closest/easiest victim, or maybe some Oedipal complex on top of it?

It appears we are finally learning the State's theory on DR's motivation to murder his mother. Please read 11/7- STATE’S NOTICE TO ADMIT SIMILAR FACT EVIDENCE PURSUANT TO F.S. 90.404(2)(a) AND/OR INEXTRICABLY INTERTWINED EVIDENCE. (pgs 1-7).

In brief, the State's theory is DR was, at least in part, motivated by a desire to shock others, as well as a morbid fascination with blood, death, and gore. IMO, if not his mother-- an easy target, it would have been somebody else. The kid's not right....

Excerpt from Docket #610 on 11/7/25:

Pages 4-6 /of 7:

ARGUMENT

1. “Similar fact evidence of other crimes, wrongs, or acts is admissible when relevant to prove
a material fact in issue [ ].” F.S. 90.404(2)(a).

2. Evidence that the Defendant shared the “Ronnie Mcnutt” video with others is relevant for
several purposes to prove material facts in issue.

3. First, the “Ronnie Mcnutt" evidence supports the testimony of C.G., as well as the
corresponding digital forensic evidence, that the Defendant was showing off and laughing
following the killing.

4. This evidence demonstrates that the Defendant enjoys sharing disturbing images with
friends for the purpose of witnessing their reactions of shock and disgust.

5. Much like his late-night call with C.G., and sending photos through the Discord application,
the Defendant shared the “Ronnie Mcnutt” video unprompted, with the purpose of
provoking a reaction.

6. Further, the evidence demonstrates that the Defendant was motivated, at least in part, due to
a morbid fascination with blood, gore, and death, as well as his desire to share this interest
with others.

7. Indeed, the “selfie” photo depicts the Defendant posing with his blood-stained hand, with
his tongue stuck out in a playful manner. This photo was taken immediately following the
tragic killing of his mother, less than an hour before midnight on Friday the 13th.

8. The evidence also disproves any misconception that due to the Defendant’s age, he would
not have sufficient life experience, or even psychological capacity, to commit such a
heinous act of violence. His attraction to a graphic, bloody suicide video, in combination
with his interest in showing it to others, demonstrates he has such capacity.

9. Moreover, the “Ronnie Mcnutt” evidence refutes any defense that the Defendant was
manipulated to commit the homicide, or otherwise coerced by unknown persons. The
shared video is independent evidence that reflects on the Defendant’s state of mind on the
date of the incident, as well as his voluntariness when committing the act itself.

10. In addition, this evidence reflects on the Defendant’s voluntariness and pride in sharing what
he did with others, as well as with detectives and the 911 operator.
This includes his
decision to voluntarily waive his Miranda rights and speak with detectives about the murder.

11. Sadly, the autopsy evidence shows that not only did the Defendant want to kill his mother,
but that he wanted to do it in the most brutal and bloody manner possible, targeting her face
and neck, specifically the carotid artery.

12. Lastly, admission of the “Ronnie Mcnutt” video would not be to prove “bad character” or
propensity, as there is a temporal and subject-matter nexus connecting the similar fact
evidence with the crime itself.
The probative value outweighs any argument that the
evidence should be excluded under F.S. 90.403.

CONCLUSION

For the aforementioned reasons, the State requests that this Court permit admission of the
following testimonial and digital forensic evidence as similar fact evidence under F.S. 90.404(2)(a):

1. “Ronnie Mcnutt” video depicting a man committing suicide using a rifle, causing his head
and face to graphically “explode.” (Video)

2. Evidence that the Defendant shared the “Ronnie Mcnutt” video with a group chat
composed of minors to scare and shock them. (Text messages/testimonial evidence)

3. Evidence that after the young men in the group chat reacted with shock, the Defendant
sent a text message including a smiley face emoji with a gun to the head, referring to the
suicide victim as a “bozo.”
(Text messages/testimonial evidence)

4. Evidence that on the afternoon of the homicide, the Defendant shared the same graphic
video on the school bus with his girlfriend E.P., who also reacted with shock and disgust.
(Testimonial evidence)

5. Evidence that the Defendant found the video funny, and was “laughing” as it was shown
to E.P. (Testimonial evidence)

6. Evidence that E.P. ended the relationship after seeing the disturbing video later that
afternoon. (Text messages/testimonial evidence)

7. Evidence that the Defendant wanted to be Jason Voorhees from the “Friday the 13th”
horror movie series, and that the homicide occurred approximately an hour before
midnight on Friday the 13th.
(Text messages)

The above-described evidence corroborates other evidence in the case, including the fact that
the Defendant voluntarily shared images of his dead mother in a pool of blood with friends, and
found her death to be a source of amusement and pride. The Defendant was, at least in part,
motivated by a desire to shock others, as well as a morbid fascination with blood, death, and gore
.

Introduction of this evidence is therefore relevant to establish identity, motive, premeditation, intent,
voluntariness, and state of mind on the night of the incident, and to refute any defense that the
Defendant was improperly influenced, coerced, or manipulated by others to commit the homicide of
his mother.

Yikes, Seattle,
This is one of the sickest, most twisted youngsters I've seen. And to think how his extended family and friends have been so supportive of him, always acting as though he is innocent and should be released to them....

A group of supporters traveled to Miami to support the teen who confessed to stabbing his mother to death.

The hearing cancellation came as a surprise to more than a dozen Rosa supporters who came to town from as far as Chicago.

“You know what a lot of kids can be manipulated, and I think he was manipulated. This is why I’m here,” said Ariana, a mother from Chicago outside the Miami-Dade Justice building. “To protest and to speak my voice. Like we are all here to do. I think he’s innocent."

Ariana was hoping to meet the defendant's family, see Rosa, and listen to the hearing.

Derek Rosa, 13, appeared in court for a standard status hearing as he faces a first-degree murder charge for confessing to killing his mother with a kitchen knife.

Since his first appearance in front of a judge, Rosa’s maternal grandmother and father have shown up every time.Today, that support grew when around a dozen mothers and grandmothers sat in the courtroom gallery wearing t-shirts stating, “he is not an adult, he is a boy,” “justice for Derek,” and “we are all Derek.”

The other teens or kids he showed that video to are victims in a way, too.

Some of us let our teens communicate online with their classmates, and we know they're sharing videos off Youtube, but you don't imagine your teen is going to be shown something like a graphic suicide video from a classmate.

And then to find out he brutally murdered his mother, stabbed her that many times, and wasn't horrified by what he did. That's definitely a mis-wired brain, and he could have just as easily done this to a classmate at school. I could see him following someone into a bathroom and then attacking them. JMO.

The women who went there to support him should think about the safety of their kids.

DR's defense did their best to initially paint him as a well-mannered, quiet, honor student.

Then, it was that he was learning disabled, autistic, and easily manipulated by others (inferring the husband/step father was responsible for the brutal slaying)!

Next, celebrity defender Jose Baez joined the team -- and they leaned heavy on the tactics above to fuel the crowdsourced supporters who began writing letters to the Court, and showing up for his hearings!

But the defense fight ultimately began to crumble when their best efforts to suppress evidence, including his video interviews with investigators, 911 call, and his prior acts evidence, were all ruled admissible evidence for trial.

This was in addition to their own proposed expert witnesses failing to prove that DR was ever professionally diagnosed before or after the murders with any mental defect, and that DR was not being treated in jail for any condition alleged by his defense!

At his change of plea hearing last week, under oath, DR confirmed to the Court that he does not take any medication for any medical condition!

Not even Jose Baez (who withdrew in November) could save this cause for another day. Two days ago, Baez announced he will be going live on Instagram to make a statement about the final deposition of DR's case, but he first must talk to DR and his family. JMO

So Baez is complaining about poor little Derek being charged as an adult? He calls it reckless, irresponsible and disgusting?

If anyone was reckless, irresponsible and disgusting it's Derek. He is absolutely old enough and mature enough to understand it is 'wrong' to stab one's mother to death. And wrong to send a video of that horror to one's friends for laughs.

That killer does not need protection from adults, the adults need protection from him. He is not going to 'mature' and then at 18 he will suddenly understand that violent killings are not Okay.

Doing it on Friday the 13th knowing he loved that movie makes it 1st degree in my mind. That was planned.

No. No, we are all not Derek.

Although it’s appalling that he will be out when he is only 38 or 41 years old, I’m glad he pleaded guilty in light of all these delusional supporters who somehow still believed he was innocent, despite the unbelievable evidence against him. I’m also glad that the state released that evidence that showed how disturbed and sick he really was. I would love to hear what these supporters think now.

I hadn't realised before about the Friday 13th thing. I wonder how long he had been planning his poor mother's death. Weeks? Months? When he was 12? That poor doomed lady, having no idea of her evil son planning her slaughter. He should never ever be freed IMO.
