I heard the prosecution say something about a prior charge and I believe it was something that can be used as an aggravater.

It took the jury more than seven hours to find McTear guilty of all charges, including first-degree murder, kidnapping, battery, aggravated child abuse and burglary. Their verdict set the stage for a penalty hearing in which the same jurors will decide whether to recommend that McTear pay for the baby's murder with his life or that he spend the rest of his years in prison.
snipped

At 21 years of age, he had racked up 16 arrests, beginning with larceny at age 13 and domestic violence at 14. Women who fell for him later asked judges to keep him as far away from them as possible.

So it looks like McTear as a prior record according to the above article.

Wow! I'm glad to know that he will away from society. He's already caused a lot of pain and destruction in his 21 years of life.

So glad this jury got it right!

I sincerely hope that McTear is subjected to everything my mind can imagine. He is an animal.

You should be able to watch the archive on Court Chatter site.

http://courtchatter.tv/mcteararchive.htm

It is not up yet, hopefully soon. If not maybe someone YouTubed it.

Jewels I hope you realize how much I appreciate your posting throughout the days to keep the rest of us informed. I missed the verdict yesterday but your link gave me the opportunity to hear the verdict for myself. :loveyou:

I recall that he does have a prior record. Can that be brought up in the guilt phase?

Now I don't remember a time, but it is on Monday. The judge gave the juror's a 3 day weekend. The lawyers had things to discuss about the penalty phase in court this morning at 9 am. I doubt that was streamed. I didn't even check.

I checked with chatter and didn't find anything. Archives doesn't show it (yet?). Monday will be closing. I'll be here for that!

Dang you are an early bird zoey!

I am too but not by my own choice. My kids are grown but I went off the deep end and have three cats who decide when I am faking sleep long enough and start walking across on me. I don't know how 10 lbs of cat feels like a 50 lb brick but it does. and they are so lackadasical about it, like strolling in the park. They make every footstep count.
