Tampa, Florida -- A judge has ruled a mistrial in the case of Richard McTear, the man accused of throwing his ex-girlfriend's 3-month-old son out of a moving car.

The ruling comes a day after the baby's mother, Jasmine Bedwell, took the witness stand.

During testimony, Bedwell told the jury that on the day before the murder, Richard McTear called her saying he wanted to come over and when she told him no, he said he'd still come over, shoot both her and the baby and then urinate in the baby's mouth.

I heard the prosecutor say he wasn't expecting her to say what she did. The judge immediately sent the jury out. Then this morning they had the mistrial hearing.

I think the prosecutor was playing dumb. imo

They hope to re-try by the end of the year.

The Prosecutor should have advised her not to even discuss the phone call, not say after the fact he wasn't expecting her to say what she did. imo

I totally agree with you. I just caught part of what the prosecutor was saying to the judge this morning. Then I switched back to the Andrea Sneiderman trial.

But why would he even make a question that could possibly elicit reference to it? This is mega effed up. :stormingmad:

The baby's mother took the stand on the first day of the first-degree murder trial for McTear, 25. Hillsborough Assistant State Attorney Ron Gale asked Bedwell about phone calls she received from McTear before baby Murray's death.

I haven't seen this article here. I would encourage everyone to read it.
I think it paints a different picture of this mother.

Also, Emanuel's picture should be in his thread.
And I will alert to change the spelling of his name. It only has one M.

Jasmine Bedwell loved her baby. In early April, afraid a boyfriend would hurt her 3-month-old, she sent little Emanuel Murray home with a friend for a week.

But this week, the violence caught up to her and her son.

Jasmine Bedwell wanted to give her child a good life, and case workers saw her turn around dramatically in recent months, Rainey said.

They helped her get her own apartment and gave her bus passes, because she didn't have a car.

They helped her enroll full time at an adult learning center. Bedwell went to parent training programs and enrolled in Healthy Start, all on her own volition, Rainey said.

She asked Hillsborough Kids for diapers and formula when she ran out.

"From everyone we talked to," Rainey said, "she was a very good mother.

After 15 days, Bedwell had to return to court to let the judge know she still wanted a restraining order.

This time, she didn't return the next day to pick up paperwork, as required.

It was a difficult task for a young mother and student dependent on buses and rides, Rainey said.

Had she picked up her paperwork, she might have known a hearing had been scheduled for Monday.

She didn't attend the hearing.

I just read the story about this case. Seems the first trial was a mistrial.

The new trail to begin in July 2014. My understanding is death penalty is still at stake.

Thank You Sugar Queen and Mikkismom for bringing this thread back up. I had forgotten about this case. I am embarrassed about that also.

I wonder when this will go back to trial? I tried to google search and no new date came up for me anyway.

This case and its entire cast of characters makes me furious. JB had been warned not to bring up the assault because he had been acquitted of that charge. It would seem to me that a mother that was seeking justice for her son who was brutally murdered would follow the judge's instructions to the letter.

And I see she went right back out there and had another baby. It was another boy and OF COURSE has been taken away by child protective services.

I think Jasmine has some issue's with not being able to tell when she is raising her children in dangerous situations. I am glad the state of FL removed her newest child. Why oh why did it take a yr?

Jury selection begins today for the man accused of murdering a baby by throwing him out of a car window in 2009.

The first trial for Richard A. McTear Jr. ended in a mistrial in last August after testimony from the baby’s mother, Jasmine Bedwell, when she was asked by a prosecutor about the nature of phone calls made to her by McTear on May 4, 2009, a few hours before her baby’s killing.

I hope there is no foot in mouth evidence given so thre is another mistrial, I see Emanuel Murray back in gaol February this year. Wonder if that had anything to do with child protective services taking the other child. JMOO
